2004-1115-Order No. 2004-072 Recorded 8/24/2004COUNTY OFFICIAL PI NANCYUBLANKENSHIP, COUNTY CLERKDS VV 2004.1115 REVIE D COMMISSIONERS' JOURNAL 08/24/2004 03:46:15 PM IIIIIIII IIIIIIIIIIII IIIIIIIII III L GAL COUNSEL 2004-1115 1, or Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Establishing Service Levels and Rates For Franchised Collection of Waste and * ORDER NO. 2004-072 Recyclables In The Unincorporated Areas of Deschutes County WHEREAS, Companies holding County franchises to collect solid waste within unincorporated areas of Deschutes County, Oregon have requested a rate increase in accordance with County policy, and WHEREAS, Deschutes County has established Rural and Distant Rural Collection Areas in unincorporated areas of Deschutes County to facilitate implementation of recycling services in the Rural Collection Area in order to increase diversion, and WHEREAS, The Administrator has reviewed the rate request and made recommendations regarding rates and collection services levels to the Board of County Commissioners; and WHEREAS, The Administrator has recommended that the maximum rates established in December 2001 for solid waste collection within unincorporated distant rural collection areas for can and roll cart services, as set forth in Exhibit C, continue in effect; and WHEREAS, The Board of County Commissioners has reviewed the proposed adjustments and the Administrator's recommendation; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. The minimum service levels for curbside collection of recyclables set forth in Exhibit A, attached hereto and by this reference incorporated herein, are hereby approved. Section 2. The Maximum rates for the collection of solid waste and recyclables within the unincorporated area of Deschutes County designated the Rural Collection Area set forth in Exhibit B, attached hereto and by this reference incorporated herein, are hereby approved. Section 3. The maximum rates for the collection of solid waste within the unincorporated area of Deschutes County designated as Distant Rural Collection Area established by Order No. 2001-121, and set forth in Exhibit C, attached hereto and by this reference incorporated herein, are hereby approved. The maximum rates for services rendered to the Deschutes County Department of Solid Waste by the Deschutes Transfer company as set forth in Exhibit D, attached hereto and by this reference incorporated herein, are hereby approved. ATTEST: Recording Secretary PAGE 2 of 2- ORDER No. 2004- 072 (08/23/04) BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON EXHIBIT "A" Minimum Service Levels For Curbside Collection Of Recyclables In The Rural Collection Zone Serviced By Bend Garbage and Recycling, Brownrigg Investments, and High County Disposal In addition to established service levels for collection of solid waste Bend Garbage and Recycling, Brownrigg Investments, and High County Disposal shall also provide the following minimum recycling services within the rural collection zone, but not the distant rural collection zone: 1. Twice monthly curbside collection of recyclable items shall be made available to all service customers. 2. Recyclable items include: newspaper, aluminum cans, cardboard, tin cans, magazines, mixed waste paper, telephone books and plastic bottles, but does not include: used motor oil and glass containers. 3. All service customers shall be provided with an appropriately sized roll cart for holding recyclables. 4. All collection of recyclables shall be at the curbside. 5. The effective date for implementation of the above described services with the accompanying rate set forth in Exhibit B shall be November 1, 2004. 6. Under no circumstances shall the accompanying rate set forth in Exhibit B be implemented prior to implementation of the additional service.
