3-453-Order Recorded 2/1/1939IN THE COUNTY COURT OF THE STATE OF OREGQN FOR THE COUNTY OF DESCHUTEB In the Matter of the Petition ) to Vacate Portions of a Certain ) .0 R D E R Street and Alley in the Town ) of Sisters ) This matter came on for hearing on the lst day of February, 1939, being the first day of the February term of the County Court, upon the petition of School District No. Deschutes County, Oregon, praying for the vacation of The alley running east and west through Block 1 of Da.vidsons Addition to Sisters, Deschutes County, Oregon, and also Cedar Street from the south line of Cascade Street to the north line of the State Highway running through the said Town of s. Sisters, and It appearing from an examination of the records and files herein that a petition was duly filed in the office of V the County Clerk of Deschutes County, Oregon, on the 29th day-of r December, 1938, which petition was `signed b~ School District No. 6,• praying for the vacation of said described alley and street, and It further appearing from the affidavit of C. T. Leedy that a notice was given and duly posted in three public places ift".the vicinity of said proposed vacation, to--wit: One notice on the bulletin board in the U. S. Post Office at Sisters;; One notice on a telephone pole on the south' side of Cascade Street near Elm Street in Sisters; and One notice at the intersection of Cedar Street and the McKenzie-Bend State Highway that said notice was posted on the 29th day of 'December, 1936, and notified all persons interested that said petition would be pre- sented to the County Court on the lst day of February, 3939, at the County Court House in Bend, Oregon, for hearing any objections that should be made thereto, and Order 1 It further appearing to the court from an examina- tion of said proceedings that they were and are iryall things regular and in conformity with the law of the State of Oregon, and It further appearing that School District No. 6, Deschutes County, Oregon, is the owner of all of the abutting property on said alley and on that portion of said Cedar Street sought to be vacated and that said petition was duly `and regularly signed by said School District No. 6, Deschutes County, Oregon, and No person or persons having appeared At this time or heretofore objecting to the vacation of said alley and street and hereinabove described, and more than 30 days having elapsed since,. the filing of said petition and giving of,noaicethereof as shown ' by the records and files herein,: Therefore, it is :bo eby'ORDEPED 9nd ADJUDGE? that All of that Tortion;;of Cedar Street, in the ply of Davidson Addftio*4 to Sinters, 'loeb:ted nor- therly from the north bogndary of the right-of- way of the MOKe~azia-Bend: Vatp Hi,p hw ' and located souther1J~ tpbm the , soath-"boundary of Cascade Streti°"'he'paid, Portion of said street; being between' tibcks ''1 and, 2 of" the said David- son Addition, and All of the alley located in Block. of the said Davidson Addition, be and the same are hereby vacated.
