2004-1248-Order No. 2004-082 Recorded 9/30/2004DESCHUTES COUNTY CLERKD;S Q 1004.1148 REVIEWED NANCY COMMISSIONERS' JOURNAL 09/30/2004 04;55;03 PM LEGAL COUNSEL I IN 111111111111111111 2004-1248 For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Rejecting all Proposals for an RFP for LaPine Area Thinning Project ORDER NO. 2004-082 WHEREAS, Deschutes County ("County") was awarded a National Fire Plan Grant with a budget of $109,000 to reduce wildfire hazard on an approximately 500 acre property owned by the County north of the La Pine Unincorporated Urban Community; and WHEREAS, on September 10, 2004, the County issued a Request for Proposals ("RFP") for the work described in the grant; and WHEREAS, at 2:00 p.m. on September 28, 2004, the time and date set in the RFP for opening proposals, the County received and opened two qualifying proposals; and WHEREAS, one offer listed offer prices for the respective project areas listed in the RFP as follows: Unit A - $144,000 ($1712/acre); Unit B - $50,700 ($2600/acre); Unit C - $491,200 (15,06/ac); and WHEREAS, the second offer listed offer prices for the respective project areas listed in the RFP as follows: Unit A $52,562 ($625/ac) and Unit B $27,300 ($1,400/ac); and WHEREAS, ORS 279.035 and OAR 137-030-0102 allow a contracting agency to reject all offers for good cause upon a finding that it is in the public interest to do so; and WHEREAS, the prices presented by the Offerors are too costly to justify acceptance and thus, it is in the public interest to reject all offers; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. Based upon the above findings, all offers in response to Fire Fuel Thinning RFP published beginning on September 10, 2004 are hereby rejected. DATED this 29th day of September, 2004.
