BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Declaring an Exemption from
competitive bidding requirements for the Mental * RESOLUTION NO. 2004-120
Health Department to renew existing contracts
with Adolescent and Adult Alcohol and Drug
Treatment providers.
WHEREAS ORS 279.029 generally requires that all contracts for public improvements be let to the
lowest responsible bidder; and
WHEREAS ORS 279.015(2) nonetheless allows certain exemptions to the general requirement for low
competitive bidding upon the making of certain findings by the local contract review board of a public agency;
and
WHEREAS, The Deschutes County Code, Section 2.36.010 designates the Board of County
Commissioners to act as the local contract review board; and
WHEREAS, after due notice, the Board, acting in its capacity as the local contract review board, held a
public hearing on October 06, 2004 to receive comments on the draft findings for this exemption as required by
ORS 279.015(3). No one appeared at the hearing to object or offer comments and no written objections or
comments were earlier received.
Now, Therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. Based upon the information stated in this Resolution and the Draft findings submitted by the
Mental Health Department, dated September 09, 2004, which is adopted and incorporated herein, the Board
hereby finds that granting an exemption to the low competitive bidding requirements of ORS 279.029 will not
encourage favoritism in the awarding of public contracts, will not substantially diminish competition for the
contracts, will result in substantial cost savings to the County, and will meet other policy objectives.
Section 2. Based upon the above findings, a specific exemption to the low competitive bidding
requirements of ORS Chapter 279 is hereby granted to renew existing contracts with current Adult and
Adolescent Alcohol and Drug Treatment Providers, the final terms and conditions of which are subject to Board
approval.
Section 3. This Resolution shall become effective immediately upon its adoption.
