BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Exempting from Bid Security and
Performance and Payment Bond Requirements a * ORDER NO. 2004-084
Contract for Tree Thinning and Fire Fuel
Removal.
WHEREAS, Deschutes County ("County") was awarded a National Fire Plan Grant (Grant) with a
budget of $109,000 to reduce wildfire hazard on an approximately 500-acre property owned by the County north
of the La Pine Unincorporated Urban Community; and
WHEREAS, on September 10, 2004, the County issued a Request for Proposals ("RFP") for the work
described in the Grant; and
WHEREAS, on September 29, 2004 after the County had opened all proposals, determined that it was
in public interest to reject all proposals, as announced in Order No. 2004-082; and
WHEREAS, the County has a contractual obligation to Elk Horn Development LLC, the successor in
interest to Pahlisch Homes, Inc., the purchaser of Quadrant 2c, located within the property subject to the wildfire
hazard Grant area, to undertake tree thinning and fuel reduction in an approximately 5-acre tract no later than
October 31, 2004; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ACTING
IN ITS CAPACITY AS THE CONTRACT REVIEW BOARD, HEREBY ORDERS as follows:
Section 1. Based upon the above findings, persons submitting bids on a County contract for the tree
thinning and fire fuel removal on an approximately 5-acre tract, located within Quadrant 2c of the New
Neighborhood, more specifically described as running alongside Huntington Road, are exempt from the
requirement for bid security. In all other respects such persons shall satisfy the requirements set forth in the
County's bid documents.
Section 2. Based upon the above findings, the person to whom a contract is award on a County contract
for the tree thinning and fire fuel removal on an approximately 5-acre tract, located within Quadrant 2c of the
New Neighborhood, more specifically described as running alongside Huntington Road, is exempt from the
requirement that a good and sufficient bond be furnished to assure performance of the contract and payment of
obligations incurred in the performance. In all other respects such person shall satisfy the requirements set forth
in the County's contract.
