DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, SEPTEMBER 279 2004
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Michael M. Daly and Dennis R. Luke; Commissioner
Tom De Wolf was out of the office. Also present were Mike Maier, County
Administrator; Mark Pilliod, Legal Counsel; Tom Blust and Gary Judd, Road
Department; Roger Kryzanek, Mental Health Department; Doreen Blome',
Community Development Department; Dan Peddycord and Muriel DeLaVergne-
Brown, Health Department; Julie Lyche, Commission on Children & Families;
Laura Wolfe, 9-1-1 County Service District; Lane Roberts, Chair of the 9-1-1
Executive Board; media representatives Barney Lerten of The Bugle and
bend.com, and Chris Barker of the Bulletin; and one other citizen.
Chair Michael Daly opened the meeting at 10:01 a.m.
1. Before the Board was Citizen Input.
None was offered.
2. Before the Board was a Discussion and Consideration of Signature of
Resolution No. 2004-114, Declaring Opposition to Oregon Ballot Measure
No. 33, regarding Amendments to the Medical Marijuana Law.
This item has been postponed until all three Commissioners can be present.

3. Before the Board was a Discussion and Consideration of Signature of
Document No. 2004-467, an Intergovernmental Agreement between
Deschutes Oregon and the State of Oregon Elections Division regarding the
Production of the Joint Voters' Pamphlet for the November 2, 2004
General Election.

4. Before the Board was a Discussion of a Public Hearing on the Final
Assessment for Bull Bat Lane Local Improvement District; and
Consideration of Signature of Order No. 2004-081, Establishing Bull Bat
Lane as a County Road; and Order No. 2004-080, Certifying the Final
Assessment on Bull Bat Lane LID.
Gary Judd explained that no opposition has been received. The work is
completed and the residents appear to be satisfied.
This item will be addressed at the Wednesday, September 29 Board meeting.
5. Before the Board was a Discussion and Consideration of Signature of
Documents No. 2004-461 through 2004-466, Subcontracts for Chemical
Dependency Treatment Services Provided under the Oregon Health Plan.
Roger Kryzanek stated that these subcontracts are with the providers as in
previous years. Funds from the State are used for these costs.

2004-454 through 2004-456, Contracts with Rural Community Action
Teams regarding Drug -Free Communities Grants and Other Funding.
Julie Lyche gave a brief overview of the agreements.

7. Before the Board was a Discussion and Consideration of Signature of
Letters Reappointing James Diegel, Dr. Allen Merritt, Dr. Jeanne Kuhar
and Nancy Knoble to the Public Health Advisory Board.
Dan Peddycord said these members are interested in staying on the board for a
longer period of time.

8. Before the Board was a Discussion and Consideration of Signature of
Document No. 2004-471, a State Homeland Security Grant to be Used for a
Preparedness Storage Trailer.
Muriel DeLaVerge-Brown gave an overview of the grant, which is part of a
collaborative effort with St. Charles Medical Center. It could be used for any
kind of natural disaster or for setting up a triage unit away from the hospital.

9. Before the Board was a Discussion and Consideration of Signature of
Document No. 2004-472, Amendment #1 to Multnomah County Service
Contract #410507 regarding Use of the Communicable Disease Database.
Muriel DeLaVerge Brown said that this amends the original contract since the
database has expanded. The additional cost is about $900. The database tracks
communicable diseases throughout the state.

10. Before the Board was a Discussion and Consideration of Signature of
Order No. 2004-079, Assigning the Name of "Julia's Trail" to an Unnamed
Access Road.
Ed Pecoraro gave an overview of the road naming issue. He said the entire land
use process was followed, including having the issue go before a Hearings
Officer. There was some opposition voiced by some of the neighbors.
Sharon Smith, an attorney representing one of the parties who disputed the
naming of the road, spoke. She said they had wanted the road to be named after
Julia DuQuette, who was an early day settler in the area. The Hearings Officer
decided that the name "Julia's Trail" is sufficient and demonstrates historical
significance; and felt that Code indicates if there is no consensus reached by the
local residents served by the road, this road name should be allowed. Three of
the four property owners wanted it to be named after Julia DuQuette, but the
fourth property owner wanted just "Julia's Trail".
Ed Pecoraro stated that the County's historical expert, Pat Kliewer, has
provided a document explaining her conversation with Forrest Wilson, Julia
DuQuette's grandson. (A copy of the document is attached as Exhibit B)
Commissioner Daly observed that the document does not indicate any
opposition to the "Julia's Trail" name by her grandson.
Commissioner Luke noted that there is more here than just the naming of a
road, and he is not inclined to go against the Hearings Officer's decision in this
case. He said in his opinion Julia DuQuette is being honored by the naming of
the road as "Julia's Trail", even though the applicant's wife is also named Julia.

11. Before the Board was a Discussion of a Public Hearing and Consideration
of Signature of Order No. 2004-013, Approving a Petition to Annex a
Territory into the Deschutes River Recreation Homesites, Unit 6, Parts I &
II, No Shooting District.
Doreen Blome' said the chief petitioner will be at the Wednesday meeting. It
involves four lots located on the north end of an existing no shooting district.
(She pointed out the lots on an oversized map.) No opposition has been received.
This item will be addressed at the Wednesday, September 29 Board meeting.
12. Before the Board was a Discussion and Consideration of Signature of
Letters Reappointing Robert Morrissey, Laurel Pierson and Lani Sykes to
the Deschutes County Dog Control Board of Supervisors, through June 30,
2006.

CONVENED AS THE GOVERNING BODY OF THE 9-1-1 COUNTY
SERVICE DISTRICT
13. Before the Board was a Discussion and Consideration of Signature of
Documents No. 2004-444,2004-445 and 2004-446, Intergovernmental
Agreements for Services Provided by Deschutes County to the 9-1-1
County Service District.
Laura Wolfe explained that these agreements solidify the services provided to
9-1-1 by various County departments. Indirect costs are already being paid, and
the services are already being provided.

Mike Maier said that some concerns regarding these agreements have been
voiced by the Commissioners, and that one agreement rather than three would
be preferred. Another concern is wording that the County will comply with the
policies and procedures of the District; this language cannot be authorized.
He suggested that a simpler document indicating that the County will provide
services to the District in the same manner, and using the same fee schedules as
used for other County departments — no more and no less - be drafted.
Commissioner Luke indicated he would speak with Ms. Wolfe and Legal
Counsel to work out the details.
This item will be addressed at a future Board meeting.
14. ADDITION TO THE AGENDA
Before the Board was Consideration of Signature of Documents No. 2004-
473 and 2004-474, a Bargain and Sale Deed and an Acceptance Deed,
relating to the Refinance of the Community Development Department
Property.
LUKE: Move approval of these documents.

Mark Pilliod said that he needs to give some background on the contract with
Pahlisch Homes regarding the La Pine neighborhood, prior to the Wednesday
meeting.
This issue will be discussed today at 3:30 immediately following the
Commission on Children & Families' regular update. This item may be added
to the Wednesday Board meeting agenda for action.
Being no further items brought before the Board, Chair Daly adjourned the
meeting at 10:40 a. m.

Julia's grandson Forrest Wilson of Tumalo called me
and he is thrilled that the street is being named
for his grandmother, Julia DuQuette.
Then Louis and Lila DuQuette called me from
Roseburg. They are thrilled, also. Both have
photos and family history they are emailing me. I
will forward them as I get them.
Here are some highlights: I would have loved Julia.
They sure did. Lila met Julia at Julia's 50th
Wedding Anniversary party. She and Louis have been
married 48 years.
Julia and husband Alfred moved from Wisconsin to
Wolf Creek near Eugene in 1909 and homesteaded.
They proved up the claim and sold it then moved to
Tumalo.
Julia's mother Great Grandma Bates came and they
lived across the street from one another for twenty
years. Julia and Fred had four children: Alfred,
OraLee, Elroy and Ruth. Ruth was Forrest Wilson's
mother. Alfred was Louis's father.
They said Julia's husband Alfred Fred) DuQuette was
French Canadian. He was a good farmer and owned
160 acres. The family built three houses there.
Julia and Fred raised award winning crops and
10,000 turkeys! They had two huge brooder houses
with 16 rooms each.
Julia and Fred went to Portland during WWII and
Julia was a welder on the ships at the shipyard.
She was very kind and was known for her venison
mince meat pies. She liked to knit and taught her
grandchildren including her grandsons to knit.
The family was close. The children lived close by
when they married. OraLee married Dale Montgomery.

The old Montgomery house still stands. The grand
kids attended Pinehurst School.
Julia is buried in Medford.
I will keep you up to date as they send me family
information.
