MINUTES OF ADMINISTRATIVE LIAISON
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, NOVEMBER 29, 2004
Commissioners' Conference Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Michael M. Daly, Tom De Wolf and Dennis R. Luke.
Also present were Mike Maier, County Administrator; and, for portions of the
meeting, Mark Pilliod, Mike Viegas, Anna Johnson, Scott Johnson, Marty Wynne
and Susan Ross.
Also present was media representative Barney Lerten of bend. com and The Bugle.
The meeting began at 1:35 p.m.
1. Discussion of Plan for Improvements to Comply with ADA Requirements.
Mike Viegas provided an overview of the progress made thus far. He said that
Bob Pike has been a big help in accomplishing this work. Some items have
already been addressed, such as TTY notices, work on the elevators, upgrading
of the County website, interpretation devices and so on. Some items have been
delayed due to city permit issues. Many of the smaller items have already been
addressed by the maintenance crew.
Commissioner Luke observed that federal rules can be stricter than State
building codes, but some State codes are stricter than federal rules; this can be
confusing. He said he understands that an effort is being made to have the rules
be more compatible.
Mr. Viegas advised that he will be meeting with Mr. Pike on an ongoing basis.
The restrooms are the biggest problem in most buildings. He added that ADA
rules do not affect just government buildings; Title 3 includes restaurants,
theaters and other publicly -used facilities.

Mr. Viegas then addressed a list, item by item, of the work that has been done
or needs to be accomplished.
The consensus of the Board was for Mr. Viegas to proceed with the items as
presented.
2. Other Items.
Susan Ross explained that CIDA Architects presented a bill for $5,300 for
additional review of ADA issues after the fact. They had met with CORIL
and felt that the work they did was in compliance with ADA rules, so
therefore are billing the County for the additional time spent since then.
Commissioners Daly and Luke asked that the bill be held for further review.
Mike Maier said that he feels it shouldn't be paid at all. Ms. Ross explained
that CIDA had to analyze city, county and state codes versus federal codes
after the fact.
Scott Johnson said that he has been working with Robin Henderson of St.
Charles Medical Center regarding the operation of the Crisis Resolution Center.
Commissioner Luke said the loan would be for $400,000 at no interest, and he
feels there should be a penalty included. There is a five-year obligation on the
grant regarding mental health services from the time use begins, so the
documents need to reflect that. Susan Ross added that the trust deed needs to
show the block grant requirements in regard to use and reporting.
Scott Johnson said for twenty years the maximum cost increase allowed in
any year is 5%. The legal language is still being refined.
Mark Pilliod stated that there is no guarantee they will take all of the
Sheriff's Office clients, and the Sheriff would like a guarantee of at least
seven beds.
Marty Wynne asked what happens if the facility is at capacity. Mr. Johnson
said that the admission criteria cover this on a first come/first serve basis.
Susan Ross added that for the first five years, 51 % of the clients need to be
low to moderate income. Mr. Johnson stated that after that time, if capacity
issues arise the County won't have much say in it, but SCMC will want to
remain a good community partner.

Mark Pilliod asked that Mr. Wynne suggest ways to set the cost index. Mr.
Johnson will keep the Board advised on any changes to the document.
On another note, Mr. Johnson said that he wants the Mental Health
Department to open, at least partially, on Fridays. This is part of his
strategic plan.
In regard to ABHA, there has been no response from the other counties, and
probably won't be until February. Many people are waiting to see what the
legislature plans to do. It is possible that Gary Smith (former Mental Health
Director) will oversee ABHA.
Being no further items addressed, the meeting adjourned at 3:10 p.m.
