DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, FEBRUARY 23, 2005
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Tom De Wo�f Dennis R. Luke and Michael M Daly.
Also present were Mike Maier, County Administrator; Sue Brewster, Sheriffs
Office; LPSCC member Jack Blum, District Attorney Mike Dugan; Jenny Birnie,
Juvenile Community Justice; and citizen Andrea Blum.
Present via conference call was Bill Linden ofPublic Counsel LLC, the County's
lobbyist in Salem. No media representatives or other citizens were in attendance.
Chair Tom DeWo�fqpened the meeting at 11:30 a.m.
County Priorily Issues — Updates.
Substantive Le2islation
Justice Court.
Mr. Linden stated that via e-mail to Representative Burley, it appears they have not
yet come to any kind of conclusion.
Mike Maier said that he has spoken with some members of the Bend City Council
and the City of Bend Manager, and they are interested in supporting the Justice
Court if it means no net loss of revenue for the City. The main incentive at this
time is that they wouldn't have to house the facility. Commissioner Luke observed
that having a Justice Court in the City isn't just to benefit the City. There are a lot
of citizens who could benefit from this, as it would be much more convenient for
them.

Mr. Linden asked that the County ask the City of Bend to provide a letter
supporting the concept to be sent to Representatives Whisnant and Burley. It
should be stressed to the City that without their support the Bill will likely not be
considered, and this Bill would address service and efficiency issues. A letter from
the City would help reduce the Representatives' anxiety level about dealing with
the Chief Justice.
SB 555 Sunset.
Mr. Linden said he talked with Representative Whisnant about this draft; he is still
waiting to look at the language. He will send it to the Board when it is available.
Jenny Scanlon (Birnie) indicated that it has to do with local discretion, and the
recidivism rate continues to drop.
Treasurer and Assessor.
Mr. Linden stated that he hopes to see this come out of Representative Whisnant's
group tomorrow. They are behind on addressing Bills.
PSU Population Data.
This item is in committee at this time.
Close "Slaver" Statute Loophole.
Commissioner DeWolf said that he wants to be sure the people who proposed this
Bill are able to attend, and will need a few days' notice.
PIT Stop Le-gislation.
Two versions were filed; the second version is clearer in regard to investigators of
the Department of Justice. Mr. Linden will forward the Bill when it is available.
He is hoping a hearing will be held soon.

X Force (oppose).
Mike Dugan said this item is on hold at the present time. Recommendations have
been made and a report is to be reviewed by the Attorney General within the next
couple of weeks. At that time some legislation should be proposed that would
replace the current Bill.

Hearings are set for February 24; a copy of the Bill has been sent to Mike Maier
and Sheriff Stiles. Mr. Linden said this may end up coming out of committee and
going to the floor. He is not sure where Senator Westlund stands on this one, and
the Speaker has not yet formally committed.
Insurance Activities Loppose)
There are no Bills on this yet.
Mike Maier asked if there is a Bill to regulate hospital fees or rates. In particular,
St. Charles Medical Center charges different amounts to various groups. Since the
County is self-insured, it gets charged the highest rate. Some legislation to set fees
in the same manner would be helpful; this is costing the County about $350,000
more per year than other groups are paying.
Bill Linden said that there is some interest in what is called price gouging for self-
insured individuals. Legislation is being spawned all over the country on this one.
Mr. Maier stated that he would be happy to weigh in on the issue if needed.
Mr. Maier asked that Mr. Linden e-mail or fax copies of Bills to him, and also to
department heads as appropriate so they can be kept aware of what is taking place
in Salem.
Fundint! Issues.
Mr. Linden stated that nothing is happening yet; the State is going through the first
phase of process, hearing agency input. Subcommittees and Ways & Means
haven't come out yet with any results, so there may not be a budget in place until
mid-March. They are far from any decisions being made at this point.
Jenny Birnie asked if funding issues for Juvenile Community Justice are included
in SB 5530. Mr. Linden said that there is a real interest in increasing bed capacity
and they may want to open Oak Creek in Albany. The source of funding is still
unknown.

Monitored Issues.
Tort reform
Mr. Linden said that tort reform will likely not happen this session. A couple of
Bills were introduced, one of which has to do with public bodies. He will forward
a draft of the Bills to Mike Maier, Mark Pilliod (Legal Counsel) and Mike Viegas
(Risk Management).
Commissioner Luke stated that he has provided a lot of information on Measure 37
to Representative Burley. Mr. Linden noted that probably not much will happen to
address the flaws in Measure 37 this year.
Commissioner DeWolf advised that the next teleconference will take place on
March 16. Mr. Linden added that by that time there should be more to discuss.

12:10p.m.
