OF DESCHUTES COUNTY, OREGON AND CROOK COUNTY, OREGON
A Resolution Regarding Participation
In The 2005-2007 Community * RESOLUTION NO. 2005-038
Dispute Resolution Grant Program.
WHEREAS, the Boards of Commissioners believe that the settlement of disputes by
mediation may lead to more long-lasting and mutually satisfactory agreements; and
WHEREAS, mediation may reduce the need for time-consuming and costly litigation;
and
WHEREAS, the Oregon Legislature has charged the Oregon Office for Community
Dispute Resolution (OOCDR) at the University of Oregon School of Law with the responsibility
to foster the development of community mediation programs by making available to
participating counties funding from a surcharge on civil filing fees, and
WHEREAS, any county wishing to participate must formally notify the OOCDR of its
intentions, and if a program is to serve more than one county, that notification shall be by joint
resolution; now therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY AND BY CROOK COUNTY COURT, OREGON, as follows:
Deschutes and Crook Counties hereby notify the Oregon Office for Community Dispute
Resolution of their desire to be participants in the expenditure of funds for community dispute
resolution programs within the tri -county area, and Deschutes and Crook Counties agree to
engage in a selection process and to select as funding recipients those entities both qualified by
the standards and guidelines adopted by the OOCDR and capable of and willing to provide
community dispute resolution services according to the rules adopted by the OOCDR.

RE: 2005-2007 Community Dispute Resolution Grants
Dear Ms. Ross:
This is an invitation for your County to participate in the selection process for the 2005-2007
Community Dispute Resolution Program (CDRP) Grant Funds pursuant to ORS 36.160.
Assuming funding for 2005-2007 is reauthorized by the 2005 Legislature, grant funds for your County
will be approximately $36,900 for the period July 1, 2005- June 30, 2007. As the funding is from a
surcharge on civil court filings, which fluctuates with the number of cases filed, the total biennial amount
of the grant will be subject to adjustments. The grant agreement will specify the nature of grant
limitations based on these issues.
Enclosed is a packet of all of the materials necessary to proceed with the grant process as well as a
current list of the Oregon Community Dispute Resolution Programs (CDRPs).
The first step in the local selection process is the County's adoption of a resolution to participate. ORS
36.160 requires that a County notify the Oregon Office for Community Dispute Resolution (OOCDR) of
its intent to participate in the funding and engage in a selection process to award the grant funds. A
sample county resolution is provided in the enclosed county information packet. Upon your County's
adoption of the resolution, please send a copy to the OOCDR. To ensure that there is not break in
services, we recommend the following timeline for the 2005-2007 grants:
By March 31, 2005 County Commission adopts a resolution of desire to participate in the process.
April 8, 2005 Legal ad published by the County to announce the application process (sample
included.) The County and the OOCDR make RFA packet available to
participants.
May 6, 2005 Applications must be received by 5:00 p.m. at the County and the OOCDR. Late
applications will not be considered.
May 27, 2005 OOCDR issues notices of eligibility to applicants and County.
June 3, 2005 Any appeals from applicants determined ineligible by the OOCDR must be
received by 5:00 pm.
June 17, 2005 County Commission selects grantee(s) and notifies OOCDR of selection.
June 30, 2005 OOCDR enters into Grant Agreement with the grantee(s).

According to OAR 718-020-0120, each County Commission needs to designate someone to serve as
the County's dispute resolution program coordinator. To ensure neutrality and the absence of any
conflict of interest, the coordinator may not directly participate in any CDRP. OOCDR staff provides
technical assistance and advice to this County staff person to make sure the process runs as smoothly
as possible. If you have received this letter and are not the County's dispute resolution program
coordinator, please forward these materials to the proper person.
The OOCDR encourages collaboration in all phases of the grantee selection process. In many
Counties, it is likely that there will be only one interested and qualified applicant. However, Counties
currently served by two or more community dispute resolution programs may wish to talk with the
applicants to find out how they are working together to offer dispute resolution services in an efficient
and effective manner.
