Daly and Dennis R. Luke. Also present were Mike Maier, County Administrator; Laurie Craghead and Mark Pilliod, Legal Counsel; Susan Ross, Commissioners' Office; Sue Brewster, Sherift's Office; Gary Judd, Road Department; Dan Peddycord, Health Department; Catherine Morrow and George Read, Community Development; media representative Chris Barker and Lily Raff of the Bulletin; and two other citizens. Chair Tom De Wolf opened the meeting at 10: 00 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was a Discussion and Consideration of the Board's Endorsement of the Purchase of the Rimrock Ranch Conservation Easement. Brad Nye of the Deschutes Basin Land Trust, and Bob Baker, the owner of Rimrock Ranch, requested the County's endorsement of a conservation easement. He explained that there was a subdivision platted of the property in 1979, but this conservation easement buys the development rights to the property, and limits improvements to one single family residence which already exists. Minutes of Board of Commissioners' Work Session Monday, April 4, 2005 Page 1 of 6 Pages This only affects the property owner's rights, but does allow for some public use such as forest restoration groups and educators. There is also a right allowed under the conservation agreement to allow restoration work on Squaw Creek to improve steelhead habitat. The Board referred to maps of the subject property in order to get a clear understanding of the location and size of the property. Mr. Nye stated that the Baker family came to the Deschutes Resources Conservancy voluntarily to work on ways to preserve the quality of the area. The County's endorsement would help with fundraising activities, and a grant was received from the National Fish and Wildlife Foundation, and they would like to know that the County supports this action. Also, the State of Oregon has an agency, the Oregon Watershed Enhancement Board, that funds these kinds of conservation easements and need to know that the County endorses this agreement. Commissioner Luke asked if the owner changes his mind in the future, how that would be handled. Mr. Nye said that it may be possible to amend it in some way, but the intent of all parties is to abide by the terms of the original agreement. Mr. Baker stated that his family will not develop it, but heirs may want to do something in the future and he wants to make sure the area is protected. Mr. Nye said this property is in part of the winter mule deer range and is next to the Crooked River Grasslands area. The primary consideration is to control development in order to protect the wildlife and natural aspects of the area. Commissioner Daly expressed concern about tying up the use of the property in perpetuity. Commissioner DeWolf stated that this is privately owned land, the transaction would be between two willing parties, and it is entirely within the property owner's right to do what he wishes with his property. Before the Board was Consideration of the Reading and Signature of a Proclamation, Declaring April 4 through 8 Public Health Week in Deschutes County. Before the Board was a Discussion of a Presentation of the Public Health Hero Awards: Dr. H. M. Kemple (Individual) and Deschutes County Rotary Clubs (Group). This item will be addressed at the Wednesday, April 6 Board meeting. 5. Before the Board was a Discussion and Consideration of Signature of an Agreement between Deschutes County and Cascade Health Services, Inc. and other Documents relating to the Crisis Resolution Center (Sage View). Mark Pilliod stated that while he was out of the office some changes to the agreements were suggested. He has not had a chance to review the proposed changes. This item will be further addressed at the Administrative Liaison later in the day, and if the questions are not addressed adequately the item will be on the Wednesday, April 6 Board meeting agenda. 6. Before the Board was a Discussion and Consideration of Signature of Document No. 2005-120, an Intergovernmental Agreement between Deschutes County and the City of Bend regarding the 2005 Byrne Justice Assistance Grant (JAG) Program Award. Minutes of Board of Commissioners' Work Session Monday, April 4, 2005 Page 3 of 6 Pages Commissioner DeWolf explained that the grant is a combination of various grants that were awarded in the past. The federal government combined two programs together and reduced the funding. However, agencies other than those for law enforcement can now use the funds. He said he wants to assure that some rules are established so that the appropriate agencies will know how to share these funds in the future. The grant amount is $28,000 at this point. A memorandum of understanding between the County and the City of Bend is required to handle the grant documents. LUKE: Move approval. DALY: Second. VOTE: LUKE: Yes. DAILY: Yes. DEWOLF: Chair votes yes. 7. Before the Board was a Discussion and Consideration of Signature of Order No. 2005-017, Abandoning Arid Local Improvement District. Tom Blust stated that this local improvement district did not receive the required number of opponents, 52% approved. The County has a 60% rule. LUKE: Move approval. DALY: Second. VOTE: LUKE: Yes. Before the Board was a Discussion and Consideration of Signature of Document No. 2005-121, a Subordination and Intercreditor Agreement for Elkhorn Development/Pahlisch Homes for Residential Construction in the New Neighborhood, La Pine. Laurie Craghead said that the County agreed to subordinate trust deeds on the properties for these loans, with Elkhorn paying back for water and sewer development via the trust deeds. DEWOLF: Chair votes yes. 9. Before the Board was a Discussion of a Public Hearing regarding the Community Development Department Draft Work Plan for Fiscal Year 2005-06. Commissioner Daly stated that the draft plan doesn't address mapping for new destination resorts. Catherine Morrow said that it is detailed as County-initiated text and mapping changes under long-term planning. This item will be addressed at the Wednesday, April 6 Board meeting. 10. Before the Board was a Discussion and Consideration of Signature of a Letter Appointing Tom Anderson to the Deschutes County Audit Committee, through November 1, 2006. LUKE: Move approval.
