Daly; Commissioner Dennis R. Luke was out of the office. Also present were Sue Brewster, Sheriff's Office; Tom Blust, George Kolb and Mike Berry, Road Department; Tom Anderson, Paul Blikstad and Chris Schmoyer, Community Development; Laurie Craghead, Legal Counsel; Judy Sumners, Risk Management; Suzanne Donovan, Mental Health Department; Dan Peddycord, Health Department; media representative Chris Barker of the Bulletin; and approximately thirty other citizens. Chair De Wolf opened the meeting at 10: 00 a. m. 1. CITIZEN INPUT Linda Sullivan, representing a group that is opposed to the Oregon Division of State Lands - Bureau of Land Management proposed land exchange of the Deschutes Market Road parcel, indicated she would like to speak. Chair DeWolf advised that this issue could eventually come before the Board. He added that the Board did send a letter to Bill Bradbury encouraging the State to listen to input from local citizens on this matter. Ms. Sullivan said she has a copy of the letter and intends to send it to Randall Edwards and Governor Kulongoski as well. Commissioner DeWolf suggested she send a copy of Ray Naff at the Governor's Office. She then read a statement to the group. (A copy of her statement is attached as Exhibit A.) Minutes of Board of Commissioners' Work Session Monday, May 23, 2005 Page 1 of 9 Pages Commissioner Daly stated that he has been dealing with State Lands on other issues besides this one. He said this matter is in the process and will probably take two years before it is finalized. It is possible this parcel could be removed from the transaction. State Lands is aware of the concerns of local citizens, but have to follow the process; it will take some time. Commissioner DeWolf stated that he and Commissioner Daly are approaching this issue in completely different ways. County Counsel has advised that this could eventually come before the Board, and they will need to bring an unbiased perspective to it at that time. On advice of counsel, he is avoiding the issue as much as possible to avoid the perception of bias later on. Commissioner Daly clarified that most of his dealings with the Division of State Lands have to do with property located just south of the Fairgrounds which was designated for Fairgrounds expansion. His primary goal when working with State Lands was not with this particular issue, but with other properties that are adjacent to the Fairgrounds. He said he feels he is entirely within his rights to deal with State Lands on this matter. Negotiations are taking place at the current time. Commissioner DeWolf said that he is not suggesting that this is illegal; it is just that ex parte contact can make it more complicated later. Ms. Sullivan stated that she sees this as a blanket caution, but the Division of State Lands has said they don't have to worry about this for years, and this conflicts with what they are saying. Marian Woodall stated that a portion of the property could become part of the Historic Register. She's been in touch with the Historical Commission to see about having it receive a National Historic designation, which would be good for all of Deschutes County. Before the Board was Discussion and Consideration of Signature of Order No. 2005-033, Appointing a Justice of the Peace Pro Tempore to Temporarily Serve When the Justice of the Peace is Absent. This item will be addressed at the Wednesday, May 25 Board meeting. 4. Before the Board was Discussion and Consideration of Signature of Document No. 2005-182, an Amendment to the State Financial Assistance Agreement regarding Funding for Health Services: WIC Services, Komen Breast Screening, and Youth Suicide Prevention Services. Before the Board was Discussion and Consideration of Signature of Document No. 2005-178, a Grant for the Sheriffs Office to Provide Law Enforcement Services on State Lands Using ATV's. Sue Brewster, Sgt. Swearingen. He said the life of the machines is determined to be five years. At that time they are released to the Sheriff's Office. DALY: Move approval. DEWOLF: Second. Before the Board was Discussion and Consideration of Chair Signature of Document No. 2005-181, an Intergovernmental Agreement with the State Building Codes Division for Deschutes County to Perform Certain Electrical, Plumbing, Structural and Mechanical Inspections for the State. Before the Board was Discussion and Consideration of the First Reading of Ordinance No. 2005-028 and Findings relating to Adding the Agnes and Henry I Sottong House and Barn (60550 Tekampe Road, Bend - Owner, Ladkin) to Historic and Cultural Resources. Laurie Craghead said this item will be a public hearing. This item will be addressed at the Wednesday, May 25 Board meeting. 12. Before the Board was Discussion and Consideration of Signature of a Letter Reappointing Scott McCaulou to the Deschutes River Mitigation and Enhancement Committee, through May 28, 2008. Before the Board was Discussion of a Public Hearing regarding a Text Amendment regarding the La Pine Neighborhood Planning Area. Chris Schmoyer gave a brief overview of the item. Changes are proposed to the new neighborhood planning area in the residential center district to allow flexibility in the types of dwellings; there are no conditional use criteria to help address this situation. The proposal is for an outright permitted use. A lengthy discussion took place regarding setbacks and the use of firewalls. The public hearing will be held at the Wednesday, May 25 Board meeting. 14. Before the Board was Discussion and Consideration of Second Reading and Adoption of Ordinance No. 2005-019, Establishing an Exception to Statewide Planning Goal 3, Agricultural Lands, to Include a portion of a Certain Property Zoned EFU-TRB, NE 9th Street, Redmond. Paul Blikstad said a hearing and first reading has already been done by the Board. This item will be addressed at the Wednesday, May 25 Board meeting. 15. Before the Board was Discussion and Consideration of Second Reading and Adoption of Ordinance No. 2005-015, Establishing an exception to Statewide Planning Goal 3, Agricultural Lands, to Include a portion of a Certain Property Zoned EFU-TRB, SW 35th Street, Redmond. Tom Anderson said that the revised document will be ready before Wednesday. 17. Luke, Commissioner Commissioners: My name is Linda Sullivan and I am here today with some members of a group that has been formed to oppose the Oregon Division of State Lands acquiring 640 BLM owned acres known as the Deschutes Market Road Parcel. I would like those in the audience who are members of the "Friends of the BLM Huntington Section" to stand at this time. Many more friends would have been present if this meeting was not being held during their regular work hours. First of all, I want to thank all three of you for being very responsive, returning our many phone calls, and listening to our concerns regarding this parcel. I want to also thank you for the letter of support you wrote last week to Secretary of State Bradbury on our behalf, asking that he "take our concerns into account as he looks at the feasibility of this trade." As concerned and involved tax-paying citizens of Deschutes County, we have been appalled by the insensitivity to local input exhibited by many of our state officials. This started with the Division of State Lands ignoring the BLM Upper Deschutes Resource Management Plan which designates the Deschutes Market Road parcel as a Z 1 land, or land identified for retention based on having high public resource values. This parcel is know for its historic Huntington Wagon Trail, which bisects this parcel, and is listed by BLM as an area of critical environmental concern. It has a primary management designation for wildlife and recreation, and is zoned EFUAL, far from the Urban Growth Boundary. Development of this parcel to the extent intended would conflict with the Deschutes County General Plan. It is a slap in the face to local input when the state comes to Deschutes County, selects a parcel against all good planning Exhibit lq Page l of z principles and common sense, and then continues to ignore and stonewall local citizens who contact them to question this decision, saying it is a "done deal". All of the citizens of this county who volunteered endless hours working on the BLM Upper Deschutes Resource Management Plan have been essentially told that the state doesn't care about their commitment or input. This same attitude prevails with these officials when they respond the way they do every time one of us calls or sends a letter. It is even more frustrating when we realize that they have selected about 1000 acres more than they are entitled to and could easily delete this parcel in response to the issues raised by concerned Deschutes County residents. Again, we want to thank you for respecting and supporting us, as well as Senator Westlund, who is working on our behalf. We look forward to working with you over the next few months or years on this matter... however long it takes for the state to realize that the taxpayers pay their salaries and they need to listen to our concerns, respect what we have to say, and start to work with us and not against us to protect our historical roots, environmental areas, and quality of life in Central Oregon.
