BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Initiating Proceedings for the
Harper Road LID to Improve a Certain
Dedicated Road Known as a portion of
Harper Road, Deschutes County, Oregon,
Describing the Road to be Improved;
Designating Where the Improvements Shall
be Made; Defining the Nature of the
Improvements; and Referring this Resolution
to the Engineer for Completion of a
Feasibility Study.
RESOLUTION NO. 2005-098
WHEREAS, the owners of property abutting the proposed improvement of a portion of Harper
Road in Deschutes County, Oregon, have requested the Board of County Commissioners to improve this
road; and
WHEREAS, it appears that such road should be improved; and
WHEREAS, it appears that it is in the public interest that the Road Department of Deschutes
County, Oregon, perform the required feasibility study for this improvement; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, as follows:
Section 1. That proceedings be initiated to improve the road described in Exhibit "A" to Deschutes
County Rural Local Road Standards for the benefit of the area described in Exhibit "B", attached hereto
and by this reference incorporated herein.
Section 2. That the dedicated road to be improved within the district described in Section 1 of this
Resolution is Harper Road shown on the map, Exhibit "C", attached hereto and by this reference
incorporated herein.
Section 3. The road(s) to be improved as a result of this Resolution shall be improved to County
Rural Local Road Standards.

Section 4. Improvements to be made to the roadway within the district include, but are not limited
to, reconstruction of the roadway to a 24 foot wide paved road with 2 foot aggregate shoulders, and
adequate drainage, as well as related engineering, administration, mobilization and traffic control work.
Section 5. This Resolution shall hereby be referred to the Engineer for completion of a feasibility
study in accordance with Chapter 12.48.150 of the Deschutes County Code. The Engineer may engage
the services of any qualified engineer for all or part of the investigation required under Chapter 12.48.150
of the Deschutes County Code.

Proposed Harper Road Local Improvement District:
Legal Description of the Portion of Harper Road to be Improved
A varying width public road easement lying within Section 9 of Township 16
South, Range 12 East, Willamette Meridian, Deschutes County, Oregon being
more particularly described as follows:
All of that portion of the Albert Harper Road as established May 5, 1910 in Crook
County Commissioner's Journal No. 4 on Page 375 (right of way width 40 feet) in
said Section 9 lying between the West line of said Section 9 and the East lines of
the SW 1/4N E % and the NW 1/4S E '/ of said Section 9 together with the east -
west segment of the White Rock Market Road as established on February 4,
1927 in Deschutes County Commissioner's Journal No. 2 on page 155 (right of
way width 60 feet) lying within the SE '/4 NW '/4 and the NW '/4 SW '/a of said
Section 9 and together with those portions of Harper Road right of way as
dedicated on the official Partition Plat No. 1998-52 (also filed as CS13433 in the
Deschutes County Surveyor's Office).

2. The Southeast'/4 of the Northwest'/4 (SE'/ NW'/4) of said Section 9
