Commissioners' Hearing Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Michael M. Daly and Dennis R. Luke;
Commissioner Tom De Wolf was out of the office. Also present were Mike
Maier, County Administrator; Mark Pilliod and Laurie Craghead, Legal
Counsel; Paul Blikstad, Catherine Morrow and Tom Anderson, Community
Development Department; David Givans, Commissioners' Office; Bill Starks,
representing the Sunriver Service District; Tom Blust, George Kolb and Gary
Judd, Road Department; Marv Lang of the Deschutes National Forest; media
representatives Jeff Mullins of KBND Radio, a reporter from The Bulletin, and
Barney Lerten, News Channel 21; and ten other citizens.
Vice Chair Mike Daly opened the meeting at 10: 00 a. m.
1. Before the Board was Citizen Input.
None was offered.
2. Before the Board was Consideration of Signature of Resolution No. 2005-
101, Establishing a "No Parking" Zone on the Cascade Lakes Highway.
Gary Judd submitted photos of the area in question, indicating what the
visibility is along the road and the width of the road. He said that vehicles tend
to park all along the side of the road and it is a hazardous situation.
Marv Lang of the U. S. Forest Service - Deschutes National Forest explained
that a $5 parking permit fee is required for those people parking in the Devil's
Lake campground. About sixty vehicles can be parked in lot at a given time.

Commissioner Daly asked if people park along the road because the lot is full.
Mr. Lang says that could sometimes be a reason if it is a busy weekend.
However, some want to avoid paying the parking fee, and others will park there
because it is closer to where they want to be.
Gary Judd stated that the corner is sharp and the road is fairly narrow. The U.S.
methodology has changed in determining speed on curves, so this stretch of
road will have the posted speed raised.
Commissioner Daly asked if there are any options to alleviate the problem. Mr.
Judd said that some trees could be removed to improve sight distance, but since
it is a scenic highway that may not be possible.
Mike Maier asked if signage can be posted to recommend slowing down due to
congestion. Mr. Judd said that pedestrian signs were installed previously.
Commissioner Luke stated that he understands the reasons for wanting cars not
to park along the road, but obviously this area is heavily used and probably not
enough parking is available.
Tom Blust said that Federal Forest Highway Program dollars may be available
to develop parking areas, pedestrian safety areas and other improvements.
Commissioner Luke suggested that Mr. Lang work with representatives of the
Road Department on some short-term and long-term options to handle this
situation. Commissioner Daly agreed.
Scott Silver, Executive Director of Wild Wilderness in Bend, submitted written
comments to the Board, and read a portion of his statement. He then stated that
the Forest Service has charged for parking even within the County's right of
way. (A copy of his statements is attached at Exhibit B)
3. Before the Board was Consideration of First and Second Readings and
Adoption, by Emergency, of Ordinance No. 2005-006 and Ordinance No.
2005-007, a Plan Amendment and Zone Change from EFU-TRB to MUA-
10 (Applicant: Duffin).

4. Before the Board was Consideration of Whether to Hear an Appeal of the
Hearings Officer's Denial of a Conditional Use Permit for Commercial
Activities in Conjunction with Farm Use (Applicant: Jeffrey Rank).
The time for hearing this issue was waived from August 13 to September 30.
Commissioner Daly said that he knows the applicant personally, and had prior
knowledge of this case since last year. He added that he doesn't feel this
situation will affect his decision.
Commissioner Luke stated that the applicant brought up some interesting points
that should be considered.

5. Before the Board was a Public Hearing (continued from July 13), of Order
No. 2005-043 (Hellmuth), regarding a Claim for Compensation under
Measure 37.
Catherine Morrow stated that Mr. Hellmuth submitted additional information at
the last meeting, and the Board continued the hearing.
The details and criteria of the work to be done were discussed with Mr.
Hellmuth, and a meeting was set up with the Division of State Lands to address
their permitting process.
Mr. Hellmuth is to apply for a verification of a non-conforming use and will
work with the Division of State Lands. He does want to maintain his status on
Measure 37.
Vice Chair Daly opened the public hearing at this time.
Mr. Hellmuth will go forward with the permit, but wishes to keep his options
open in regard to a future Measure 37 claim.
Mark Pilliod suggested that another 160 day extension be granted by the
applicant to get the details of the situation worked out. Mr. Hellmuth agreed.
Mr. Pilliod or Catherine Morrow will write a letter to Mr. Hellmuth stating the
agreed-upon terms.
The hearing was continued; Mr. Pilliod said that notice will be given as to the
specific date.
6. Before the Board was a Public Hearing (continued from July 13) on Order
No. 2005-052 (Malone), regarding a Claim for Compensation under
Measure 37.
Mark Pilliod explained that the County's original recommendation suggested a
different acquisition date for the two parties. Clearly both husband and wife
purchased the property together although the deeds were handled differently. It
is now felt that the County should recognize this ownership was meant to be for
both husband and wife from the original date.
Vice Chair Daly opened the public hearing.
Lumae Malone said that Mr. Pilliod has made their position clear and agrees
that ownership by both husband and wife should go back to 1977.

Commissioner Luke agreed that the intent was for both to have ownership. Mr.
Pilliod said a motion to direct staff to amend a recommendation of the 1977
acquisition date would be appropriate.
Being no further testimony offered, Vice Chair Daly closed the public hearing.

and revised Order to reflect an acquisition date of 1977.

Thanks for your July 5, 1998 letter. I understand your continued concern about the fee demonstra-
tion program, and I know that behind your concern is a sincere love and appreciation for the land and
national forest resources.
I am sorry for any offensive remark that may have been made during your recent protest again the
Fee Demonstration program. As you know, Officer Pugh immediately apologized to the individual
to which the remark was directed who accepted the apology and indicated it was "...no big deal...".
This was an unfortunate and both Officer Pugh and I regret any harm it may have caused.
I also want to respond to your question about why you and your fellow demonstrators were not is-
sued citations. In your letter, you referenced a restriction which is stated on our trailhead signs
which indicates that a Trailpark Pass is required to park "...within one-quarter mile..." of the trail-
head. This policy was developed to address parking outside our trailheads on roadsides to avoid the
parking permit requirements. This practice could lead to a traffic safety issue, which we certainly
want to avoid.
Many of our trailheads are accessed from county and state right-of-way roads and highways. Even
though these areas are usually located within National Forest land, at this time we have no authority
to impose restrictions within these right-of-way routes. If this Trailpark Pass program becomes per-
manent, we will work with the state and counties to impose the pertinent parking restrictions. In the
meantime, we are using our signs to discourage this practice. Therefore, since you and your support-
ers were parked on Century Drive, you were technically not in violation of our Trailpark Pass regula-
tion.
This leads me to address a separate and related issue that has been brought to my attention. It is my
understanding that during your July 3, 1998, demonstration, some of your participants were delaying
and in some cases stopping traffic flow past your location. I also understand Mr. Pugh cautioned
some of your group about this practice. We later received a complaint from a passer-by that he had
been delayed by your group after Mr. Pugh's caution.

I want you to know that we welcome you and your supporters in expressing your opinions. How-
ever, you should know that impeding or restricting traffic is a violation of state law. But more im-
portant, some could get hurt by this practice. I encourage you to keep this in mid when planning and
implementing any future demonstrations. This public safety issue is a high priority to us, just as
your right to assemble and express your opinions are important to us. It is imperative you exercise
these rights in a safe and lawful mariner.
Enclosed you will find a copy of the Fee Demonstration Law Enforcement Policy and a copy of the
reminder envelope form. I hope this letter and these documents clear up any questions you may
have regarding our enforcements plans.

Forest Service.
(5) FEDERAL RECREATIONAL LANDS AND WA-
TERS.- The tern "Federal recreational lands
and waters" means lands or waters managed by
a Federal land management agency.
(6) NATIONAL PARKS AND FEDERAL REC-
REATIONAL LANDS PASS.- The term "National
Parks and Federal Recreational Lands Pass"
means the Interagency national pass authorized
by section 5.
(7) PASSHOLDER.- The term ' passholder"
means the person who is issued a recreation
pass.
(8) RECREATION FEE.- The term "recreation
fee" means an entrance fee, standard amenity
recreation fee, expanded amenity recreation fee,
or special recreation permit fee.
(9) RECREATION PASS.- The tern "recreation
pass" [Weans the National Parks and Federal
Recreational Lands Pass or one of the other
recreation passes available as authorized by sec-
tion 5.
(10) SECRETARY.- The term "Secretary"
means-
(A) the Secretary of the Interior, with respect
to a Federal land management agency (other
than the Forest Service); and
(B) the Secretary of Agriculture, with respect
to the Forest Service.
(11) SECRETARIES.- The term "Secretaries"
means the Secretary of the Interior and the Sec-
retary of Agriculture acting Jointly.
(12) SPECIAL ACCOUNT.- The term "special ac-
count" means the special account established in
the Treasury under section 7 for a Federal land
management agency.
(13) SPECIAL RECREATION PERMIT FEE.- The
term "special recreation permit fee" means the
fee authorized by section 3(h).
SEC. 3. RECREATION FEE A UTHORITY.
(a) AUTHORITY OF SECRETARY.- Beginning in
fiscal year 2005 and thereafter, the Secretary
may establish, modify, charge, and collect recre-
ation fees at Federal recreational lands and wa-
ters as provided for In this section.
(b) BASIS FOR RECREATION FEES.- Recreation
fees shall be established in a manner consistent
with the following criteria:
(1) The amount of the recreation fee shall be
commensurate with the benefits and services
provided to the visitor.
(2) The Secretary shall consider the aggregate
effect of recreation fees on recreation users and
recreation service providers.
(3) The Secretary shall consider comparable
fees charged elsewhere and by other public
agencies and by nearby private sector operators.
(4) The Secretary shall consider the public
policy or management objectives served by the
recreation fee.
(5) The Secretary shall obtain input from the
appropriate Recreation Resource Advisory Com-
mittee, as provided in section 4(d).
(6) The Secretary shall consider such other
factors or criteria as determined appropriate by
the Secretary.
(c) SPECIAL CONSIDERATIONS.- The Secretary
shall establish the minimum number of recre-
ation fees and shall avoid the collection ofmul-
tiple or layered recreation fees for similar uses,
activities, or programs.
(d) LIMITATIONS ON RECREATION FEES.-
(1) PROHIBITION ON FEES FOR CERTAIN ACTIVI-
TIES OR SERVICES.- The Secretary shall not
charge any standard amenity recreation fee or
expanded amenity recreation fee for Federal rec-
reational lands and waters administered by the
Bureau of Land Management, the Forest Serv-
ice, or the Bureau of Reclamation under this
Act for any of the following:
(A) Solely for parking, undesignated parking,
or picnicking along roads or tralisides.
(B) For general access unless specifically au-
thorized under this section.
(C) For dispersed areas with low or no invest-
ment unless specifically authorized under this
section.
(D) For persons who are driving through,
walking through, boating through, horseback
riding through, or hiking through Federal rec-
reational lands and waters without using the
facilities and services.
(E) For camping at undeveloped sites that do
not provide a minimum number of facilities and
services as described In subsection (g)(2)(A).
(F) For use of overlooks or scenic pullouts.
(G) For travel by private, noncommercial vehi-
cle over any national parkway or any road or
highway established as a part of the Federal-aid
System, as deflned in section 101 of title 23,
United States Code, which Is commonly used by
the public as a means of travel between two
places either or both of which are outside any
unit or area at which recreation fees are
charged under this Act.
(H) For travel by private, noncommercial vehi-
cle, boat, or aircraft over any road or highway,
waterway, or airway to any land in which such
person has any property right if such land is
within any unit or area at which recreation fees
are charged under this Act.
(I) For any person who has a right of access
for hunting or fishing privileges under a specific
provision oflaw or treaty.
(J) For any person who is engaged in the con-
duct of official Federal, State, Tribal, or local
government business.
(K) For special attention or extra services nec-
essary to meet the needs of the disabled.
(2) RELATION TO FEES FOR USE OF HIGHWAYS
OR ROADS.- An entity that pays a special recre-
ation permit fee or similar permit fee shall not be
subject to a road cost-sharing fee or a fee for the
use of highways or roads that are open to pri-
vate, noncommercial use within the boundaries
of any Federal recreational lands or waters, as
authorized under section 6 of Public Law 88- 657
(16 U.S.C. 537; commonly known as the Forest
Roads and Trails Act).
(3) PROHIBITION ON FEES FOR CERTAIN PERSONS
OR PLACES.- The Secretary shall not charge an
entrance fee or standard amenity recreation fee
for the following:
(A) Any person under 16 years of age.
(B) Outings conducted for noncommercial
educational purposes by schools or bona fide
academic Institutions.
(C) The U.S.S. Arizona Memorial, Independ-
ence National Historical Park, any unit of the
National Park System within the District of Co-
lumbia, or Arlington House-Robert E. Lee Na-
tional Memorial.
(D) The Flight 93 National Memorial.
(E) Entrance on other routes into the Great
Smoky Mountains National Park or any part
thereof unless fees are charged for entrance into
that park on main highways and thoroughfares.
(F) Entrance on units of the National Park
System containing deed restrictions on charging
fees.
(C) An area or unit covered under section 203
of the Alaska National Interest Lands Con-
servation Act (Public Law 96-487; 16 U.S.C.
410hh- 2), with the exception of Denali National
Park and Preserve.
(H) A unit of the National Wildlife Refuge
System created, expanded, or modifled by the
Alaska National Interest Lands Conservation
Act (Public Law 96- 487).
(I) Any person who visits a unit or area under
the jurisdiction of the United States Fish and
Wildlife Service and who has been issued a valid
migratory bird hunting and conservation stamp
issued under section 2 of the Act of March 16,
1934 06 U.S.C. 718b; commonly known as the
Duck Stamp Act).
(J) Any person engaged in a nonrecreational
activity authorized under a valid permit issued
under any other Act, Including a valid grazing
permit.
(4) NO RESTRICTION ON RECREATION OPPORTU-
NITIES.- Nothing In this Act shall limit the use

of recreation opportunities only to areas des-
ignated for collection of recreation fees.
(e) ENTRANCE FEE. -
(1) AUTHORIZED SITES FOR ENTRANCE FEES.-
The Secretary of the Interior may charge an en-
trance fee for a unit of the National Park Sys-
tem, including a national monument adminis-
tered by the National Park Service, or for a unit
of the National Wildlife Refuge System.
(2) PROHIBITED SITES.- The Secretary shall
not charge an entrance fee for Federal rec-
reational lands and waters managed by the Bu-
reau of Land Management, the Bureau of Rec-
lamation, or the Forest Service.
(1) STANDARD AMENITY RECREATION FEE.- Ex-
cept as limited by subsection (d), the Secretary
may charge a standard amenity recreation fee
for Federal recreational lands and waters under
the Jurlsdiction of the Bureau of Land Manage-
ment, the Bureau of Reclamation, or the Forest
Service, but only at the following-
A National Conservation Area.
(2) A National Volcanic Monument.
(3) A destination visitor or interpretive center
that provides a broad range of interpretive serv-
ices, programs, and media.
(4) An area-
(A) that provides significant opportunities for
outdoor recreation;
(B) that has substantial Federal investments;
(C) where fees can be efficiently collected; and
(D) that contains all of the following amen-
ities:
(1) Designated developed parking.
(II) A permanent toilet facility.
(ill) A permanent trash receptacle.
(Iv) Interpretive sign, exhibit, or kiosk.
(v) Picnic tables.
(vi) Security services.
(g) EXPANDED AMENITY RECREATION FEE. -
(1) NPS AND USFWS AUTHORITY.- Except as
limited by subsection (d), the Secretary of the
Interior may charge an expanded amenity recre-
ation fee, either in addition to an entrance fee
or by itself, at Federal recreational lands and
waters under the jurisdiction of the National
Park Service or the United States Fish and
Wildlife Service when the Secretary of the Inte-
rior determines that the visitor uses a specific or
specialized facility, equipment, or service.
(2) OTHER FEDERAL LAND MANAGEMENT AGEN-
CIES.- Except as limited by subsection (d), the
Secretary may charge an expanded amenity
recreation fee, either In addition to a standard
amenity fee or by itself, at Federal recreational
lands and waters under the jurisdiction of the
Forest Service, the Bureau of Land Manage-
ment, or the Bureau of Reclamation, but only
for the following facilities or services:
(A) Use of developed campgrounds that pro-
vide at least a majority of the following:
(1) Tent or trailer spaces.
(11) Picnic tables.
(111) Drinking water.
(iv) Access roads.
(v) The collection of the fee by an employee or
agent of the Federal land management agency.
(vl) Reasonable visitor protection.
(vii) Refuse containers.
(vlll) Toilet facilities.
((x) Simple devices for containing a campfire.
(B) Use of highly developed boat launches
with specialized facilities or services such as me-
chanical or hydraulic boat lifts or facilities,
multi-lane paved ramps, paved parking, rest-
rooms and other Improvements such as boarding
floats, loading ramps, or fish cleaning stations.
(C) Rental of cabins, boats, stock animals,
lookouts, historic structures, group day-use or
overnight sites, audio tour devices, portable
sanitation devices, binoculars or other equip-
ment.
(D) Use of hookups for electricity, cable, or
sewer.
(E) Use of sanitary dump stations.
(F) Participation in an enhanced interpretive
program or special tour.
(G) Use of reservation services.
