Daly and Dennis R. Luke; Commissioner Tom DeWolf was out of the office. Also present were Timm Schimke, Solid Waste; Tom Blust, Road Department; Tom Anderson, Cathy White and Doreen Blome ' Community Development; Anna Johnson, Commissioners' Office; and media representatives Barney Lerten of News Channel 21 and Eric Flowers of The Bulletin. No other citizens were present. Vice Chair Daly opened the meeting at 10:00 a. m. 1. Before the Board was Citizen Input. None were offered. 2. Before the Board was Consideration of Signature of Document No. 2005- 301, an Intergovernmental Agreement with the U.S. Department of Agriculture for Wildlife Services. Timm Schimke gave a brief overview of the agreement. Funding has been approved by the Department of Agriculture; however, a portion of the funds needed will be provided by the County. Commissioners Luke asked that the provider of the services keep track of the time he spends working on city issues so that it can be determined if this and other jurisdictions should be paying more for the work he is providing to those entities. The Solid Waste Department should not have to pay for work not related to the landfill. Commissioner Daly added that this will be a consideration when next fiscal year's budget is being drafted. Before the Board was a Discussion and Consideration of a Public Hearing and the First Reading of Ordinance No. 2005-014, Outlining the Duties and Responsibilities of the County's Internal Auditor. David Givans stated that this item is recommended by most local governmental entities. It has been refined over the past few months. This item will be addressed on Wednesday, August 3. 4. Before the Board was a Discussion and Consideration of Chair Signature of a Notice of Intent to Award Letter for the Overlaying of Butler Market Road, Hamehook Road and Rickard Road. George Kolb gave an overview of the item. Hap Taylor and Sons is the apparent low bidder. LUKE: Move approval. DALY: Second. VOTE: LUKE: Yes. DALY: Vice Chair votes yes. 5. Before the Board was a Discussion and Consideration of Signature of Resolution No. 2005-100, Initiating the Vacation of a Portion of a Right-of- Way of an Unnamed Street off Cattle Drive (Indian Ford Ranch Homes Subdivision). George Kolb explained that a property owner approached him regarding vacating a right of way previously used by a water company. Both property owners have signed off on the vacation, and the water company would like to retain an easement. Before the Board was a Discussion and Consideration of Signature of Order No. 2005-035, Vacating a Portion of a Right-of-Way of an Unnamed Street off Cattle Drive (Indian Ford Ranch Homes Subdivision). Before the Board was a Discussion and Consideration of Signature of Order No. 2005-070, Accepting a Petition for the Designation of Territory as "Second Addition to Whispering Pines No Shooting District", and Setting a Hearing Date. Doreen Blome' gave a brief overview of the item. Commissioner Luke stated that he would like to see the County's land included in the petition. Ms. Blome' said that it would take a separate annexation request for this in order to avoid having to recirculate the petition. Ms. Blome' will check with Legal Counsel to see if the County annexation can be heard on the same date as the other petition. LUKE: Move approval. DALY: Second. VOTE: LUKE: Yes. Before the Board was a Discussion of a Public Hearing regarding the Adoption of Ordinances No. 2005-031 and No. 2005-032, on a Goal 3 Exception - a Plan Amendment and Zone Change from Surface Mining to MUA (off Tumalo Reservoir Road; Applicant: Coats). Minutes of Board of Commissioners' Work Session Monday, August 1, 2005 Page 3 of 5 Pages Cathy White said that the public hearing was continued to Wednesday, August 3; the documents have been reviewed by Legal Counsel. A request has been made to have the ordinances be adopted by emergency. No public comment has been received as of this date. This item will be addressed on Wednesday, August 3. 9. Before the Board was a Discussion of Hearings on Measure 37 Claims for Compensation: Order No. 2005-062 - Claim #M37-05-23 (Johnson) Order No. 2005-063 - Claim #M37-05-24 (Miles) Order No. 2005-064 - Claim #M37-05-26 (Stills) Order No. 2005-065 - Claim #M37-05-30 (Tumalo Farms LLC) Tom Anderson stated that the attorney representing the Tumalo Farms item has asked that the hearing be delayed for sixty days. Commissioner Luke had questions about the claim that involves a lease option (Stills). The other three claims will be addressed on Wednesday, August 3. 10. ADDITIONS TO THE AGENDA None were offered.
