Present were Commissioners Tom De Wolf, Dennis R. Luke and Michael M. Daly.

Chair De Wolf opened the meeting at 10: 00 a. m.
1. Before the Board was Citizen Input.
Approximately a dozen children and teachers from the County day care center
presented cards to the Commissioners and thanked them for their school.
Alex and Austin Burke introduced themselves; they were attending the meeting
with their mother, Sherry, and are working on their Eagle communications
merit badge, which requires that they attend and take notes at public meeting.
Commissioner Luke said that Governor Kulongoski will be at the County's
offices on Tuesday morning, August 9, to formally sign a bill regarding a thirty-
year look-back at Oregon land use planning. He added that the Governor
specifically wanted this action to occur in Deschutes County.

2. Before the Board was a Presentation of the Deschutes River Mitigation and
Enhancement Program's Annual Report for 2004.
Peter Gutowsky introduced Steve Marks, Oregon Department of Fish and
Wildlife District Biologist and Jack Williamson, Coordinator for Mitigation and
Enhancement. They provided a summary of the progress of various programs
to date. (A copy of their handout is attached as Exhibit A)
Steven Marks gave background information on the work done by the
organization. He said the handling of funding and program guidelines have
been streamlined over the past few years, and a hydro mitigation program has
been added.
Jack Williamson introduced Bob Jackson, who represents the County at the
group's meetings. The 2004 annual report shows that partnerships with other
organizations, including the Watershed Council, Central Oregon Irrigation
District and the U.S. Forest Service, have been developed in order to address
various challenges of the use of the Deschutes River.
Several big projects are planned for 2005, including work to be done just below
Wickiup Dam and at La Pine State Park.
In response to questions from Commissioner Luke, Mr. Marks said that a
portion of the personal services funding is for overhead and staffing, and part of
this expense is charged to COID and other organizations. The account balance
includes reserves and is earmarked for future projects.

Document No. 2005-312, a Six-month Lease for the Sheriffs Office
Substation, La Pine.
Sue Brewster stated that this covers the lease of the existing space until the
County's South County project is completed.

4. Before the Board was Discussion and Consideration of Approval of the Health
Department Developing a Needle Exchange Program in Deschutes County.
Shannon Danes asked for approval to develop the program, which will begin in
a limited manner and will be built up a little at a time. She stated that there has
been very good support from the community; although it is sad that it is
necessary, there is a need.
Commissioner Luke said that the District Attorney and LPSCC (Local Public
Safety Coordinating Council) have provided letters supporting the concept. He
added that he would like for Risk Management, Legal Counsel and the Board to
have an opportunity to review the plan before it is launched.
Dan Peddycord noted that funding is an issue, and state and federal sources will
be contacted in this regard.
The Board indicated a consensus for the development of the program to
proceed.
5. Before the Board was Discussion and Consideration of Signature of
Document No. 2005-311, the 2005-07 Fiscal Signature Authorization Form
for the Oregon Commission on Children & Families.
Commissioner Luke said that this was discussed at length previously at a
meeting of two of the Commissioners, the County Administrator and the
Director of the Commission on Children & Families.

allows this activity to occur electornically. Next year the County will not have
to be involved, as payments will be made direct, although the County will still
review and approve the payments.

Kevin Harrison said this is an applicant-driven text amendment involving the
Inn of the 7 h Mountain and others to clarify the land divisions allowing private
roads in these types of projects. The Planning Commission unanimously
supports this action.
This item will be addressed at the Wednesday, August 10 Board meeting.
10. Before the Board was Discussion and Consideration of Signature of
Document No. 2005-309, a Subordination and Intercreditor Agreement
between Elk Horn Development, LLC, Housing Capital Company, and
Deschutes County regarding Phase II of New Neighborhood Quadrant 2C,
La Pine.
Laurie Craghead stated that the Board has previously approved similar
documents. This allows the developer to obtain funding for development and
construction.

were approved. This claim can be further addressed on Wednesday, August 10.

River Rim Project

The project leader was contacted by Newland Properties regarding fish habitat and river
enhancement through the proposed River Rim development. Drawings were developed
j with the objective to place approximately 20 whole trees for the purpose of erosion
control and fish habitat restoration.
Project plans were submitted to Newland Properties, City of Bend, Stosh Thompson,
Oregon Division of State Lands (ODSL), U.S. Army Corps of Engineers (COE), Oregon
Department of Parks and Recreation and Jack Robinson Construction for review. Scale
drawings were completed for the City of Bend depicting ingress/egress with additional
information on restoration of disturbed sites, plant species and size, erosion and sediment
control, construction timeline, and access approval from affected property owners. A
final proposal was mailed to the City of Bend (and all parties) along with the $100
application fee. The City of Bend required a 60-day period for internal review and public
notice.

Permits were acquired through the Division of State Lands and notice was given to
adjacent property owners. One letter was received expressing concerns for the project. A
condition of the DSL fill and removal permit was to conduct a spawning ground survey
from the project area downstream approximately 0.5 river miles prior to construction.
Materials for the project were obtained through the developer, Newland Communities,
and Jack Robinson Construction as houses were built within the development and from
offsite locations. Hauling was provided by Jack Robinson Construction. The original
trees obtained for the project were lost to theft when an unidentified party cut them up,
presumably for firewood. Newland Communities, Hayden Homes, Tamarack Homes,
and Jack Robinson Construction assisted with locating additional trees to replace those
lost. Project construction was completed in April 2003 by Jack Robinson Construction
and resulted in the placement of approximately 20 whole trees with crowns and roots on.
Approximately 5 days were spent on project construction and securing trees with cable.
M&E contribution to the project included planning (10 days) and labor (5 days). All
materials, construction equipment, and operator were provided by the developer and
through donations.
The project area was documented with pre-project photos and video. Ted Wise and I
attempted to snorkel the project reach and shoot underwater video but the water was too
turbid for decent fihning. Jennifer Bock, ODFW STEP Biologist assisted the project
leader with a spawning survey from the Old Millpond to the project pool and found no
concentration of spawning habitat or trout redds. Any silt entrained by the project should
not affect fish reproduction activities.
Rotz Proiect, M&E Proiect # 02-03-01 R&E Proiect # 01-025
Project Objective: restore fish habitat by stopping erosive process, collecting sediment
with whole trees and re-vegetating captured soil
Location: Deschutes River, Rotz home site, RM 202
Status: Material placement and anchoring completed October 2002
ODFW was contacted by Mr. and Mrs. Rotz regarding severe erosion occurring on their
property. The Project Leader conducted a site visit to assess the situation. Project plans
were developed to arrest erosion and enhance fish habitat through the placement of
approximately 30 whole trees.
Fill and removal applications were submitted to ODSL and COE for the project. The
COE had previously reviewed projects through the Joint Application and the Section 7a
analysis however the Rotz project required a COE specific application due to its location
within the Wild & Scenic River boundary. A cultural resources assessment was also
completed for the project. The COE determined they did not regulate placement of large
wood and provided a letter indicating a permit was not required through the agency.
Materials for the project were donated by the landowner and from an adjacent property
owner. The landowner provided 30 whole trees with crowns and roots on and an
additional 12 trees were donated by an adjacent property owner. Anchors were set in late
winter to take advantage of low flow conditions. Ten arrowhead anchors with extra long
cable were installed. Trees were felled and skidded to the placement site using a backhoe
and operator provided by the Central Oregon Irrigation District (COID). Felling was
assisted by a climber contracted to set chokers on 8 trees. A 35-ton rough terrain crane
was used to place trees in the river. Construction using heavy equipment was completed
in 4 days with an additional day spent cabling and securing material. Post project site
visits indicate project objectives were met, erosion within back eddy has been arrested
and soil is collecting.
Funding for the Rotz Project was through the M&E Program, ODFW's Restoration &
Enhancement Program (R&E), and through contributions by the Central Oregon
Irrigation District and the landowner. The R&E board voted to fund the project in the
amount of $3,792 for crane and operator rental. COID provided a voluntary contribution
of approximately 3 days of backhoe and operator time. Cost of the climber was $373.75
and was paid by the Rotz. Cabling and anchoring supplies and equipment were provided
by the M&E Program. M&E personnel spent approximately 15 days on project planning
and construction.

Cooper Project, M&E Project Number not assigned
Project Objective: restore fish habitat by stopping erosive process with woody material,
collecting sediment, re-vegetating captured soil, shoring up undercut tree and providing
protection to plantings during growth stage
Location: Deschutes River, Jack Cooper home site in Water Wonderland, RM 195
Status: Material placement and anchoring completed October 2002
Jack Cooper contacted ODFW requesting assistance with an eroding streambank on their
property. Project personnel elected to assist Mr. Cooper by providing technical support
on the project.
Fill and Removal permits were issued by ODSL and COE. The USFS submitted the
Wild & Scenic Section 7a analysis to the US Army Corps of Engineers to assist with the
permit applications.
Project construction was originally scheduled for late winter 2002 however permit delays
made it necessary to postpone work until fall when the project area would be dewatered.
Material placement and anchoring was completed in early November 2002 with the
placement of 9 rootwads and 18 boulders in "Rosgen vane" configuration. Smaller wood
material was used to add complexity to the structure. The vane points upstream at a 20-
30° angle and 5-10° slope downward from the bank. The purpose is to direct flow away
from the bank by using the theory that water will turn 90° when hitting an angled object
in the water. The upstream pointing vane directs water toward the center of the channel
and a downstream pointing vane directs water toward the bank, in theory. All work was
completed outside of the wetted perimeter of the river when flows were reduced for
reservoir storage.
Rootwads and boulders were collected on USFS land using flatbed and crane trucks
belonging to ODFW. The crane truck used to place the stumps was borrowed from the
Trout Creek BPA Project in Madras office. Boulders were selected with the Cooper's
assistance at a USFS pit near Paulina Creek. Small wood material was collected at a
construction site within Water Wonderland. Collection and placement of rootwads and
boulders placement (with anchoring) required 3 days.
The Cooper's also asked that we assist with shoring a section of undercut bank beneath a
lodgepole pine tree. We assisted by driving poles into the bank with a sledge hammer
and layered river bottom dirt in-between. The poles were held in place with t-posts
supplied by Cooper.
Willows were planted through the project area and along the Cooper property with the
assistance of a work crew provided by the Central Oregon Intergovernmental Council
(COIC). Approximately 2 days were spent planting and include one day with the COIC
crew consisting of 6 students and an advisor.
Scherrer Proiect, M&E Proiect number not assigned
Project Objective: large wood placement and revegetation to restore fish habitat and
erosion control
Location: Deschutes River, Bill Scherrer home site, RM 197
Status: Material placement and anchoring completed October 2002
Bill Scherrer contacted ODFW regarding his eroding streambank. M&E personnel
conducted a site visit and elected to assist by providing technical assistance. Mr. Scherrer
agreed to provide material and equipment necessary to complete the project. Structure
placement and anchoring was completed in October 2002.
A fill and removal permit was issued by ODSL for the project. As with the Rotz project,
COE indicated a permit was not necessary.
Project construction resulted in the readjustment of a number of trees placed along the
streambank in the mid 1980's for erosion control. Most of the repositioned material had
decomposed by exposure and from wetting and drying from being placed high on the
streambank. An additional 20 new trees were pulled over and a large downed ponderosa
were collected and placed along the streambank. A walking excavator and backhoe were
used during project construction.
The backhoe was owned and. operated by Bill Scheirer and used to pull over live trees
and skid them to the project site. Mr. Scherrer contracted a walking excavator with
operator to accomplish instream work. Project construction was completed in Placement
took two days and included anchoring material. M&E personnel spent approximately 12
days on the project including planning, permitting, and construction.
Vandevert Ranch M&E Proiect number not assigned
Project Objective: assist homeowners with restoring fish habitat and erosion control
through woody material placement and revegetation
Location: Little Deschutes River, Vandevert Ranch development, RM 24
Status: material placement and anchoring complete
This project was implemented as directed by conditions placed in the County Conditional
Use Permit for the development. M&E personnel provided technical assistance to the
Vandevert Ranch Manager with respect to project design and field techniques for
restoring fish habitat and streambank stabilization in early October 2002. One day was
spent placing trees and cabling at 7 sites. Vandevert Ranch contracted a walking
excavator with operator to place materials.
Wickiup Phase VI, M&E Proiect number not assigned
Project Objective: Construct 50 log and rock structures to provide cover and feeding
areas within Wickiup Reservoir. Location: Deschutes River Channel of Wickiup
Reservoir
Status: Complete
Wickiup Phase VI is a continuation of similar projects designed to enhance spawning and
rearing areas for redband trout and brown trout in Wickiup Reservoir. The project area is
located within the transition zone between spawning areas in the Deschutes River and
Browns Creek and Wickiup Reservoir.
Fifty-three structures were constructed in August 2002 however low water levels
inhibited the ability to float structures to placement locations and the reservoir bottom
remained too muddy to bring in a skidder to move structures. Consequently, placement
was delayed. In 2003, the USFS utilized a new piece of equipment designed to bundle
small trees to create 37 additional structures bringing the total number of structures to 90.
Structures were placed in fall 2003 using an excavator and operator provided by COID in
coordination with USFS personnel.
The Deschutes National Forest provided materials (rock and trees) for the project, labor,
and coordinated environmental planning and structure placement. The M&E Program
participated by contracting an excavator rental ($2000) and provided approximately 4
days of labor drilling rock and constructing habitat structures. COID donated the use of
their excavator with operator for 2.5 days and provided a flatbed truck with operator for 1
day to assist with structure placement.
Bud Miller Project, M&E Proiect number not assigned
Project Objective: restore fish habitat by stopping erosive process with woody material,
collecting sediment, shoring up undercut tree and re-vegetating captured soil
Location: Deschutes River, Bud Miller home site in Water Wonderland, RM 196
Status: material placement and anchoring complete
Bud Miller contacted ODFW regarding streambank erosion on his property along the
Deschutes River within Oregon Water Wonderland and requested technical assistance..
Program personnel assisted Mr. Miller by constructing a "Rosgen vane" from small trees,
securing a large ponderosa, and planting sedge and willow at this project. The vane was
constructed to redirect energy away from the eroding bank. A fill and removal permit
was not required for the project as it was outside of the Wild and Scenic Boundary and
less than 50 cubic yards. Wood material was provided by the landowner and from offsite
within the development through a second landowner. Miller had a large ponderosa that
was shored up by constructing a log crib around its base to prevent further erosion. All
work was completed using hand labor. COIC assisted with labor and provided 6 students
plus an advisor for one day. M&E personnel contributed 2 days of labor during
construction and provided tools, anchors, and cabling supplies.
This project was somewhat experimental to see how if small materials could be utilized
to stabilize an eroding bank. The advantage is that it is very inexpensive, avoids permit
delays, can be done with hand crews and uses material on-site. This project technique is
not meant to replace a full restoration project.
Kelsey Fish Habitat Restoration Proiect M&E Project # 03-02-01
Project Objective: restore fish habitat and river processes through large wood placement
in the Deschutes River
Location: Deschutes River, selected areas from Sunriver to Benham Falls, RM 181-186
Status: material placement and anchoring completed spring 2003
Project objectives for the Kelsey Project were primarily to enhance feeding, cover and
resting areas for redband and brown trout and improve water quality by reducing
turbidity and sedimentation. Objectives were met through placement of approximately
150 whole trees at a density of 43 trees per mile into the Deschutes River between
Sunriver and Benham Falls (RM 182.3 to 185.6).
The Project Leader conducted a site visit along with USFS representatives Tom Walker
and Kevin Keown (USFS wildlife biologist) to discuss construction methods and identify
project materials. The USFS and M&E Program cooperatively contracted a walking
excavator with operator to place the material. During construction, sections of the tree
trunks and roots were buried at the toe of the sedge beds. This technique is very natural
in appearance and eliminated the need for anchoring on most structures. This design
should also trap sediment better than the standard method of perching the root on top of
the sedge beds because there is no gap under the roots.
The M&E committee approved funding the project and contributed $5,000. Rental of the
walking excavator totaled $8560 and was split between the USFS and M&E Program.
Z-~cisey rroject
Arrangements were made for the contractor to send the bill directly to COID for payment
of $4280 from the M&E account to avoid overhead charges. Project personnel spent 3
days assisting with project planning and material anchoring.
Riverfest 2002 and 2003, M&E Project #02-04-01 and 03-03-02
Project Objective: Promote community awareness, support, and involvement with regard
to watershed processes and issues in the Deschutes Basin
Location: Activities and Events throughout the watershed
Status: completed in spring 2002 and 2003
The M&E Program contributed $5,000 in both 2002 and 2003 to the Upper Deschutes
Watershed Council in support of Riverfest activities. Riverfest is a series of educational
events that explore natural history and resource stewardship in the upper Deschutes River
watershed. Watershed information was shared at over 20 events during the month of
May, including bird watching, river clean-ups, hikes, a river art show, weed pulls, river
tours, canoe trips, lectures and other events. Trips utilize volunteer leaders that are local
experts in their field. Events included information about the river ecosystem, healthy
watersheds and restoration efforts in the basin. The Upper Deschutes Watershed Council
and its partners sponsored events throughout the Upper Deschutes River basin, with most
events focused in Bend, along the Deschutes River.
Project Maintenance Activities
Charlie Beith Proiect, M&E Proiect number not assigned
Project Objective: enhance fish habitat and stabilizing an eroding streambank on the
landowners property
Location: Deschutes River near Water Wonderland
Status: material placement completed August 2001 and planting in May 2002
Charlie Beith Construction contacted us in the summer of 2000 about restoring the river
in front of a private home he was building (Speikerman's). The owner was interested if
the 25 trees being removed from the footprint of the house could be used to create fish
habitat. Program personnel assisted Mr. Beith with project construction in August 2001
(see 2001 Annual Report) and followed up in May 2002 by planting approximately 50
willow sticks and 25 sedge plugs. Survival of the willow planting was approximately
80% for the first year growth. Additional willow and sedge plantings are needed.
Diversion Reach Project Cable Replacement
Project Objectives: Improve fish habitat through the COID Siphon Power Project
Diversion Reach
Location: Deschutes River RM 171-172
Status: Ongoing as necessary
Project maintenance consisted of replacing rusted and frayed cables used to secure trees
within the diversion reach. The project was constructed in 1989. The need for
replacement was primarily related to the degree of wood movement from wave and river
action and from de-watering. Some of the 3/16" cable was in good condition and not
replaced while some of the 1/2" cable was rusted and replaced. Replacement cable was
7/16" in most areas and 5116" in low velocity areas. Cable diameter was increased to see
if cable life would increase and to ensure wood material was secure. It appeared that
approximately 85% original wood was retained over the past 15 years. Estimated cost of
replacement cable was $697. Program personnel spent approximately 5 days replacing
and securing new cable during March 2002.
Gary Austin Proiect M&E Proiect # not assigned
Project Objective: restore fish habitat and erosion control through woody material
placement Location: Squaw Creek, Peter Selby home site (Gary Austin builder) in
Creekside development, RM 20
Status: needs riparian planting
Peter Selby purchased the home constructed by Gary Austin and was concerned about a
large undercut beneath his concrete deck and a large pine overhanging the water. The
project leader conducted a site visit, attended by Austin and Selby's equipment operator,
to discuss options with all parties. The parties agreed that structures created in the 2001
bank stabilization project had not achieved the desired result and the undercut should be
filled to expedite recovery. A large ponderosa pine was taken down and used to provide
additional protection and direct current away from the undercut and the undercut was
filled with gravel from the streambed. This activity was cleared through ODSL. Project
personnel spent approximately 2 days on the project.
Oldham Proiect M&E Proiect # 96-04-01 first M&E Proiect on private land
Project Objective: restore fish habitat and erosion control through placement of large
wood material and riparian plantings to provide feeding, resting, and hiding habitat for
fish and to restore the eroding streambank.
Location: Deschutes River, four home sites in Water Wonderland, RM 196
Status: Complete
Program personnel worked with Jon Moreland to repair his easement violation. Mr.
Moreland had cut cables and sawed up habitat trees in front of his house to make it easier
to dock.his boat. This project was originally constructed through the M&E Program as
part of the George Oldham Project. The riparian easement tied to the property states that
ODFW and the homeowner must mutually agree to changes in the project.
Materials for project restoration were donated by George Oldham. Mr. Moreland
contracted with Progressive Excavations in Redmond (walking excavator) to assist with
tree placement and cabling. Trees were placed to form 2 triangles, one upstream of each
dock. Moreland and Oldham will fill voids in the structures with slash and dirt layers and
plant willows and sedge.

Riparian Planting: Sunriver LaPine State Recreation Area, and Pringle Project
Six days were spent planting willow and sedge through the Sunriver, Pringle Fire, and La
Pine State Park projects. Labor was contracted through COIC and the Oregon National
Guard through their Youth Challenge Program. Funding for the effort was provided
through a cash donation from a private party wishing to contribute to river and fish
habitat conservation.
Approximately 800 willows were cut and planted through the Pringle and LaPine State
Recreation Areas Projects. Survival and growth of the original willow planting at Pringle
was poor and estimated at less than 1% success. Most loss was attributed to beaver
activity. The National Guard and COIC each provided 6 youth and an advisor for two
days to assist with willow planting. Two days were spent planting sedge through the
Sunriver Project. Labor utilized 10 youth along with an advisor provided through
National Guard program. Project personnel spent approximately 8 days organizing and
implementing the planting effort.
Project Planning
Timber Creek Development
The project leader met with Bruce Forbes, Timber Creek development, and discussed the
need for bank stabilization and erosion control through the development. We offered
technical assistance in directing placement of the material and anchoring. Mr. Forbes
will arrange permits, machinery and purchase materials and planning to use
bioengineering materials to stem his erosion. No recent contacts or progress have been
made on this project.
John Hamer, Creekside Development
Project Objective: restore fish habitat and control erosion through woody material
placement to provide structure and collect sediment to allow natural revegetation to take
place
Location: Squaw Creek, John Hamer home site in Creekside, RM 20
Status: negotiation stage
Estimated completion date: unknown at this point, hopefully within a year (2003?)
This is a new project on Squaw Creek within the same development (Creekside) as the
Austin Project done last year. The City of Sisters informed Mr. Hamer of the need to
repair the creek and asked him to contact ODFW. We met with Hamer twice on-site to
discuss methods, mark trees for the project, and discussed a source of boulders. The best
source of boulders is Timber Creek's excess boulders on the other side of the creek.
The project plan was to collect trees from within the footprint of the house, place them
instream, and anchor them with boulders. Riparian planting was not necessary and
anticipated to occur through to natural recovery. ODFW conducted a spawning survey
beginning at the project site and extending downstream for approximately 1 mile. The
survey did not identify any existing redds or spawning fish activity. Completion of

spawning ground surveys were a mitigation requirement to allow project implementation
to proceed outside the recommended in-water work period. Scheduling of project
construction was designed to coincide with construction of the Mr. Harners residence.
Mr. Hamer has decided against implementing the project for reasons of aesthetics. The
City of Sisters planner indicated that property within the creek channel may be deeded to
the city. There is currently no movement on the project.
Log Deck Park Project
The Project Leader spent time investigating and developing plans for fish habitat
enhancement through the Old Mill District and within the Farewell Bend Park area.
Project plans anticipated placement of approximately 70 ponderosa and lodgepole pine
trees. Preliminary review of the project plans resulted in the assessment that the
proposed treatment was too intense with respect to the number of trees and did consider
other values. This effort was deferred to other planning interests working to address
multiple use through the project area.
Haner Park
ODFW was contacted by Dick Patterson a homeowner within the Haner Park subdivision
below Wickiup Reservoir. Mr. Patterson is concerned with development of a logjam in
the river within the Haner Park reach of the river and its potential to effect and possibly
block the river channel. The Project Leader conducted two site visits to assess the
situation. Further investigation is necessary to determine management objectives of the
Haner Park Homeowners Association, assess fish habitat needs, and develop stream
channel pattern and profile objectives for the project. A hydrologic assessment is
necessary and should be incorporated into project development if this project moves
forward.
