2005-1054-Ordinance No. 2005-037 Recorded 9/13/2005REVIEWED LE AL COUNSEL REVIEWED CODE REVIEW COMMITTEE DESCHUTESFICIAL CLERKS 1►d (.Q0V-1054 COMMISSIONERS' JOURNAL , IIIIIIIII IIIIIIIIIIIIIIIIII IN 1111111 2005-1054 09/13/200511.10.58 AM BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Ordinance Amending Title 23, the Deschutes County Comprehensive Plan Map, to Take Exceptions to the Statewide Planning Goals to Amend the Sisters Urban Growth Boundary and Change the Designation of 13.8 Acres of Land from Forest to Public Facility, and Declaring an Emergency. * ORDINANCE NO. 2005-037 WHEREAS, the City of Sisters (City) completed a Post Acknowledgement Plan Amendment of the Sisters Urban Area Comprehensive Plan and UGB; and WHEREAS, the City completed a Public Facilities Future Land Needs Analysis and the UGB Expansion findings demonstrate a need for additional public facilities land to meet its public facilities lands needs now and in the future; and WHEREAS, to meet that need, the City proposed amending its urban growth boundary (UGB) to include 13.8 acres of property for public facilitities purposes; and WHEREAS, the City demonstrated that the proposed amendment meets all applicable state laws and rules; and WHEREAS, the Sisters and Deschutes County Planning Commissions considered the proposed amendment through joint public hearings on May 26, 2005; and WHEREAS, on July 28, 2005, the Sisters City Council voted to approve the proposed amendment and forward it to the Board of County Commissioners ("Board") for consideration; and WHEREAS, the Board concurs with the City's findings and concludes that the public will benefit from the amendment to the City's UGB to add land for public facility; and WHEREAS, Deschutes County Ordinance 2000-017 ordained the Plan Map to be a component of Title 23 and, therefore, any amendment to the Plan Map is an amendment to Title 23; and WHEREAS, the Board considered the proposed amendment to the Comprehensive Plan map after a public hearing on September 8, 2005; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Document Reproduces Poorly (Archived) PAGE 1 OF 2 - ORDINANCE NO. 2005-37 (09/08/05) Section 1. AMENDMENT. The Deschutes County Comprehensive Plan is amended to change the plan designation of the property shown on Exhibit "A" and described in Exhibit `B," from Forest to Public Facility. Section 2. AMENDMENT. DCC Chapter 23.120, Exceptions Statement, of the Deschutes County Comprehensive Plan is hereby amended as shown in Exhibit "C," with new language shown in underline. Section 3. FINDINGS. The Board of County Commissioners adopts as its findings in support of the amendment the Burden of Proof attached hereto as Exhibit "D" to Ordinance 2005-035, and by this reference incorporated herein. Section 4. EMERGENCY. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. In conjunction with approval of PA05-3, an exception to Statewide Planning Goal 4, Forests Lands, was taken to include a portion of a certain property zoned Forest 1 (F 1). Reasons justifying why the state policy embodied in Goal 4 should not apply in this situation are set forth in Exhibit "C" to Ordinance 2005-037, which findings are incorporated herein by reference.
