Luke and Michael M. Daly; also present were Mike Maier, County Administrator; Mike Dugan, District Attorney; Mike Viegas, Risk Management; Dave Peterson, Information Technology; Timm Schimke, Solid Waste Department; Robin. Marshall, Commission on Families & Children; George Read, Catharine White and Tom Anderson, Community Development; Mark Pilliod, Mark Amberg and Laurie Craghead, Legal Counsel; Suzanne Donovan, Mental Health Department; Shannon Dames and Dan Peddycord, Health Department; media representatives Barney Lerten of News Channel 21 and Chris Barker of The Bulletin; and three other citizens. Chair De Wolf opened the meeting at 10: 00 a. m. 1. Before the Board was Citizen Input. Mike Dugan introduced Jim Brazelton of American Corrective Counseling Services, Inc. and the former District Attorney for Stanislaus County, and his Chief Financial Officer, Zanley Galton. Mr. Dugan said he is working with ACCS to establish a victims' assistance plan in regard to restitution of bad checks. Mr. Brazelton, who was prosecutor on Scott Peterson case, will be speaking at Summit High School tonight. No other input was offered. Before the Board was a Discussion and Consideration of Approval of a Needle Exchange Program for Deschutes County. Shannon Dames gave an overview of the program, which works within Prochaska and DiClemente's "model of change". She consulted with Risk Management and Legal Counsel to write this very detailed plan so that it would work well for Deschutes County. Chair DeWolf said that the plan is supported by the District Attorney, LPSCC (the Local Public Safety Coordinating Council), the Health Advisory Board and other groups. There has not been a lot of opposition from the public, and the same type of program is being used around the country very successfully. This item will be addressed further at the Wednesday, October 12 Board meeting. 3. Before the Board was a Discussion and Consideration of Signature of Document No. 2005-298, a Services Agreement with Redhawk Network Solutions regarding Computer Network Security. Mike Viegas stated that HIPAA requires annual reviews, and some HIPAA language had to be added under the review of services. These services will enhance computer network security for the County, including when individuals attempt to hack into the system and encryption to be used for security purposes. Before the Board was a Discussion of a Public to Consider the Appeal of the Hearings Officer's Decision Denying a Proposal to Establish a 2,000 - Seat Amphitheater on EFU-zoned Property (Highway 20 East; Applicant: Christian Life Center). Cathy White gave a brief overview of the upcoming hearing. The Hearings Officer had denied the application based on site plan criteria, and there were also issues related to constitutional law. She submitted a summary to the Board a week ago, and later an oversized set of revised plans that the applicant turned in for the Board to review. Laurie Craghead said that although the changes are in response to deficiencies pointed out by the Hearings Officer, the Board will need to decide if the changes in the revised plan are significant enough to require a modification of the application, under County Code. (The Board discussed the site plan maps and the setbacks shown.) This hearing is scheduled for Tuesday, October 11, at 3: 00 p.m. 9. Before the Board was a Discussion of Measure 37 Hearings: . ADDITIONS TO THE AGENDA Before the Board was a Public Hearing and Consideration of Signature of a Resolution Declaring an Exemption from Competitive Bidding, Declaring a Sole Source, and Approving Document No. 2005-391, an Agreement with Trillium Family Services for Treatment Foster Care Services. Suzanne Donovan stated that there is no other provider that can handle these services locally. A bid process was held and no other provider responded. Due to questions Commissioner Luke had, this item will be addressed further at the Wednesday, October 12 Board meeting.
