MINUTES OF SPECIAL MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, OCTOBER 5, 2005
Commissioners' Conference Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Michael M. Daly and Dennis R. Luke; Commissioner
Tom DeWolf was absent. Also present were Mike Maier, County Administrator;
Mark Pilliod and Mark Amberg, Legal Counsel; and Anna Johnson,
Commissioners' Office. Also present were media representatives Barney Lerten of
News Channel 21, Ryan Cambridge of KBND Radio, and Lily Raff of The Bulletin.
The meeting took place after an executive session that had been called under ORS
192.660(1) (h), pending or threatened litigation; ORS 192.660(1)(b), personnel
disciplinary action; and ORS 192.660(1)0, consideration of information or
records exempt from public records law. Vice Chair Daly opened the meeting at
11:40 a.m.
LUKE: Move that Legal Counsel be authorized to release to Jenny Birnie
and/or her legal counsel prior to Ms. Birnie's follow-up interview
with the County's retained investigators a summary of the allegations
of misconduct by Ms. Birnie that were raised during the Juvenile
Community Justice Department investigation. Also, authorize a
limited waiver of the attorney-client privilege and/or the work product
privilege with respect to the release of the summary to Ms. Birnie
and/or her legal counsel

LUKE: Move that Legal Counsel be authorized to retain outside legal counsel
(Doug Andres, Beth Skillern and Bullivant Houser Bailey) to provide
representation to the County regarding a potential conflict of interest
issue raised by Commissioner DeWolf with respect to Mark Pilliod
and the office of County Legal Counsel; and, if a conflict is
determined to exist, to represent Deschutes County with respect to
claims made against or involving Commissioner DeWolf.

DALY: Vice Chair votes yes.
Being no further discussion or action taken, the meeting adjourned at 11:45 a.m.
