DESCHUTES COUNTY BOARD OF COMMISSIONERS
TUESDAY, SEPTEMBER 6, 2005
Commissioners' Conference Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Tom De Wolf, Michael M. Daly and Dennis R. Luke.
Also present were Mike Maier, County Administrator; Laurie Craghead and Mark
Pilliod, Legal Counsel; and Susan Ross, Commissioners' Office. Also present was
Bill Carson, President of the Black Butte Ranch Managing Board. No media
representatives were present.
The meeting began at 1: 30 p.m.
1. Overview of Scheduling Measure 37 Hearings.
Mark Pilliod provided information on pending Measure 37 claims, and said he
is concerned about the deadlines, especially with one particular claim. The
Board agreed to hold the hearing on that claim (Gardner) on September 21
just prior to a hearing on a defensible space ordinance.
Regarding a claim involving Aspen Lakes/Cyrus, Mr. Pilliod advised the
Board that he would like to waive a potential conflict of interest. Attorney
Bruce White filed an opinion on this property when he worked for the County
years ago.
2. Project Update.
Susan Ross stated that the County holds a reversionary clause on the Seventh
Day Adventist Church property in Redmond, as a result of foreclosure in 1934.
The Church would like to sell the property as they are losing part of the street to
road widening.

Commissioner Luke said that the County property where the burned. -out house
stood in Terrebonne should be donated to Habitat for Humanity.
LUKE: Move that the Terrebonne property be donated to Redmond Habitat
for Humanity.

DEWOLF: Chair votes yes.
In response to Commissioner Luke's questions about the building where State
Farm Insurance Company was located along with the Oregon State Police, Ms.
Ross stated that the Sheriff's Office would like to acquire it for the CODE
group and the Detective Division. It is about 5,000 square feet on .6 acres, and
is now empty. It borders County and State Police property. Debt service could
be covered by CODE and perhaps the project development fund or the landfill
reserve fund. Commissioner Daly indicated he would like to tour the property.
LUKE: Move that an offer of $1 million be made on the property, subject to
an appraisal, with $10,000 non-refundable earnest money. The County will pay
for the appraisal.

Susan Ross explained that a woman had willed property to St. Vincent de Paul
years ago, and they subsequently sold it to an individual. However, it has been
foreclosed on by the County due to nonpayment of taxes as the tax statements
had been going to the former owner, who is now deceased. The new owner
would like to redeem it for taxes plus interest.
Commissioner Daly asked that due diligence be taken regarding ownership of
the property. He would like to know its value and whether it is buildable.
Regarding a newspaper article about the County -owned properties in South
County, there is no list available at this time and no date for a sale has been set.
The first properties to be sold will be the transfer development properties,
which are for the most part unbuildable. The other properties will be made
available later in the spring.
Ms. Ross explained that the old Bill's Electric property on Greenwood is very
bad shape, and it would take a lot of money to improve it. Compass
Commercial would like to make an offer on it, but it cannot be sold until 2008
due to conditions of a trade with ODOT. Mike Maier asked if perhaps some
kind of exchange could be made in this regard.
In regard to Susie Penhollow's contention that the Historical Society is
supposed to receive 1% of land sale funds, this action was for a limited period
of time only.
Concerning insurance on the Historical Society, the County coves liability;
however, it does not offer errors and omissions insurance. Commissioner Luke
asked if Mr. Maier could find out if those people working at the Historical
Society are considered employees.
Economic Development Grant Requests:
• Grandma's House, capital purchases - $4,000 ($2,000 each,
Commissioners Luke and Daly)
• Bend Film Festival - $5,000 (Commissioner DeWolf)
• Fair & Expo Center, Fair transportation - $5,000 (Commissioner Luke)
• Fair & Expo Center, facilities - $10,000 (Commissioner Daly)
• OSU/4-H Program, educational material - $5,000 (Commissioner Daly)

Central Oregon Community College, Diversity Conference - $5,000

Arts Central/Van Go Program - $3,000 (Commissioner DeWolf)
American Red Cross, Hurricane Katrina Relief - $10,000
Requests from the Deschutes Basin Land Trust, COCOA and the Sisters Chamber
of Commerce were declined.
3. Other Items.
LUKE: Move approval of a letter of support to the Oregon Historical Society
regarding the change of geographical names from "Squaw' to other,
more appropriate, names.
DALY: Second.
VOTE: LUKE: Yes.

DEWOLF: Chair votes yes.
Bill Carson of the Black Butte Ranch Managing Board advised that they are
going out for a five-year tax levy to fund law enforcement services. They have
had a deficit since the 3% property tax limitation went into effect, and patrol
services are union and have received an increase in compensation. Also, the
Homeowners' Association has installed a new building, resulting in an increase
in rent. $.40 per thousand is being requested. Only residents living in the
district can vote; these are 320 lots out of the total of 1,251 owned.
Mark Pilliod stated that in regard to one of the Cyrus Measure 37 claims, there
are exhibits that need to be replaced.
LUKE: Move that Legal Counsel work with the Cyrus' attorney to obtain the
proper exhibits.
