BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Vacating the Plat of Harper, Crook
County Oregon, described by Robert B.
Gould in 1910 as located in Section 8, * ORDER NO. 2005-083
Township 20 South, Range 11 East,
Willamette Meridian, presently located in,
Deschutes County, Oregon.
WHEREAS, the Board of County Commissioners, of Deschutes County, Oregon, initiated the
vacation of the "Plat of Harper", located in Section 8, Township 20 South, Range 11 East, Willamette
Meridian in Deschutes County, Oregon, by Resolution Number 2005-094 dated September 14, 2005;
and
WHEREAS, the Board of County Commissioners requested the County Road Official to
prepare a report relating to the vacation; and
WHEREAS, the Board of County Commissioners accepted and approved the County Road
Official's report and as required by ORS 368.346 set a public hearing on October 26, 2005 at 10:00
a.m. by Order Number 2005-082 dated September 14, 2005; and
WHEREAS, notice of hearing was given in accordance with ORS 368.346(3) and 368.401 to
368.426; and
WHEREAS, the Board of County Commissioners held said hearing to consider matters
presented under ORS 368.346; and
WHEREAS, the Board of County Commissioners finds that it is in the public interest to vacate
the public property so long as the applicants signs an agreement with the County that says, if Spring
River Road is ever extended as an arterial or collector, the applicants shall dedicate to the public for
road and utility purposes sixty (60) feet of right-of-way along the entire northern property line of the
property that is to be the Caldera Springs Destination Resort, approved in Case Nos. SP-05-53, CU
05-7, M-05-1, and TP-05-961, except for the portion that runs from the eastern edge of the Mid-State
Electric substation property to the western edge of the remainder of the subject property where the
right-of-way shall be thirty (30) feet; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDERS as follows:
Section 1. The property, described in Exhibit "A", attached hereto and by this reference
incorporated herein, is hereby vacated effective upon the effective date of the agreement outlined
above.
Section 2. The property, vacated in Section 1, shall vest as described in Exhibit "B" according
to law pursuant to ORS 368.366(1)(c).

Section 3. The parties understand that the following utility easements shall remain in place
and not be affected by this vacation:
Volume 133 Page 08900 (86-18848) for Mid-State Electric Co-op Transmission lines
recorded September 24, 1986
Book 238 Page 1540 for a 10 foot Pacific Northwest Bell Telephone Easement for fiber optic
lines.
Section 4 The Deschutes County Surveyor is directed to mark a copy of the plat, if any, as
provided in ORS 271.230.
Section 5. This Order shall be recorded with the Deschutes County Clerk, and copies shall
be filed with the Deschut s County Surveyor and County Assessor.

Beginning at the initial point, the north quarter section corner of said Section 8, thence West 808.64 feet;
thence S3°22' 15"W, 1,342.34 feet along the easterly boundary of the Oregon Trunk Railroad Station
grounds; thence S89°55'00"East, 879.09 feet; thence S89°40'46"East, 633.19 feet; thence North 1,339.65
feet, thence North 89°31'29" West, 624.68 feet to the place of beginning.

Sunriver Resort Limited Partnership and Midstate Electric Cooperative, Inc. have jointly petitioned
Deschutes County to vacate the official Plat of Harper. The plat of Harper was established in 1910 in
Deschutes County, which was formerly a portion of Crook County Oregon. The following property
descriptions establish the ownership within the plat of Harper, upon vacation by Deschutes County.
OWNERSHIP VESTED IN MIDSTATE ELECTRIC COOPERATIVE INC. TAX LOT
2011080000501:
Lots 1, 2, 3, 4, 5, 6, 21, 22, 235 24, 25, 26 and the north 7.5 feet of Lots 7 and 20 in Block 1, and that
portion of the alley and 30 feet of I" Avenue, 2"d Avenue, and Division Street adjacent to said lots.
OWNERSHIP VESTED IN SUNRIVER RESORT LIMITED PARTNERSHIP TAX

All of the official Plat of Harper Crook County Oregon, located within Section 8, Township 20 South,
Range 1 1 East, Willamette Meridian, Deschutes County (formerly Crook County), excepting Lots 1,
