MINUTES OF SPECIAL MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
THURSDAY, NOVEMBER 17, 2005
Commissioners' Conference Room - Administration Building - 1300 NW Wall St.., Bend
Present in person were Commissioner Dennis R. Luke; Tom Anderson, and Kevin
Harrison, Community Development; Recording Secretary Bonnie Baker; media
representative Chris Barker of The Bulletin; and Paul Dewey, citizen.
Present via conference call were Commissioner Michael M. Daly; Mark Pilliod
and Laurie Craghead, Legal Counsel; and Catherine Morrow, Community
Development Department.
The meeting took place after an executive session that had been called under ORS
192.660(1) (h), pending or threatened litigation. Vice Chair Daly opened the
meeting at 3:05 p.m.
Commissioner Luke made a motion as follows:
Staff is directed to prepare an Order to be signed by Legal Counsel on behalf of the
Commissioners (as they will be unavailable) for the Board to conduct a public
hearing regarding an appeal of the Hearings Officer's denial of an application
submitted by Thornburgh Destination Resort. Said Order is to be signed and
distributed as appropriate no later than Monday, November 21, 2005.
The hearing will be held on December 20, 2005 and will be de novo. The parties
will have until December 27, 2005 to rebut any new evidence that is submitted at
the hearing and to offer arguments. The applicant will have until January 3, 2006
to furnish final arguments. The Board will issue its decision on this matter no later
than January 10, 2006.

The Board is to issue a written decision no later than 14 days after its decision in
this matter (by January 24, 2006) unless the applicant waives the time restrictions.
The applicant is to forgo filing a writ of mandamus if the County proceeds with the
process as detailed above.
The terms of this matter are to offer a fair opportunity for review of the issue,
considering the conditions offered by staff representatives and the Hearings
Officer's recommendations, so that appropriate findings can be made.
Commissioner Daly seconded the motion.
VOTE: LUKE: A reluctant "yes"
DALY: Vice Chair votes yes.
Being no further discussion or action taken, the meeting adjourned at 3:15 p.m.
