DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, NOVEMBER 30, 2005
Commissioners' Hearing Room - Administration Building
1300 NW Wall St.., Bend
Present were Commissioners Michael M. Daly and Dennis R. Luke. Also present
were Sue Brewster, Sheriff's Office; Tom Blust and George Kolb, Road
Department; Kevin Harrison, Community Development; media representatives
Molli Graham and Barney Lerten of News Channel 21 and Chris Barker of the
Bulletin; and approximately twenty employees and other citizens.
Vice Chair Daly opened the meeting at 10: 00 a.m.
1. Before the Board was Citizen Input.
None was offered.
Commissioner Luke stated that he wanted to comment on two recent Bulletin
editorials.
One relates to a hearing being held on December 7 regarding an exemption to
the bidding process for improvements at the Fairgrounds. He said the notice
had to read as it does. However, unlike the Archives Building and the
Courthouse, this bid is more of a design -build situation for a cover over the
arena. Any contractor will have an opportunity to bid the project and to provide
its own design. This is not a sole contractor type of arrangement.
The other editorial was in regard to a draft report that the Commissioners just
received for the first time relating to the Juvenile Community Justice
Department investigation. Commissioner Luke stressed that this involves a
public employee who has due process rights. Due process is allowed before
judgment is made.

He added that he and Commissioner Daly are on the record that this report will
be made public as soon as possible, but due process has to be considered; the
Bulletin should know this. He said he has thought about asking the Bulletin to
indemnify the County against a judgment if due process rights are violated; if
so, it could be released right away. But the County would need a financial
statement and guarantee from the Bulletin to make sure they could afford to pay
a really big settlement. Care needs to be taken to make sure due process rights
are not violated, and the Bulletin should recognize this.
Commissioner Daly stated that he fully agrees with Commissioner Luke's
statement.
2. Before the Board was Consideration of Signature of Resolution No. 2005-
142, Authorizing a .5 FTE Building Services Position.

4. Before the Board was a Decision on a Candidate to Fulfill the Term of
Commissioner Position #3, through January 1, 2007.
Commissioner Luke said that he wanted to go through the three candidates one
at a time. (He read a statement at this time; a copy is attached as Exhibit A.)
Commissioner Daly then read his statement. (A copy is attached as Exhibit B.)
LUKE: Move that Bev Clarno be appointed to fill the position.
The motion died for lack of a second.

Vice Chair Daly said that this issue needs to be decided by the Board no later
than December 15 or the Governor will have to make the appointment.
This item will be further addressed at the Monday, December 5 Board meeting.

George Kolb gave a brief overview of the issue. He said that 100% of the
residents support the District.
Vice Chair Daly opened the hearing. Being no testimony offered, he then
closed the hearing.
B. Before the Board was Consideration of Signature of Resolution No. 2005-
143, Directing the Improvement of Harper Road by Contract and
Establishing Notice of Intent to Assess Benefited Properties.

Scott Waters,
I really like Scott's eagerness and willingness to serve as a County
Commissioner. I was impressed by his down loading our budget and his
understanding of some of its parts. Scott is an engineer with some very
good credentials and work experience. Some of that work experience
would be useful in the Commissioner's job. I have met with Scott
personally before the interview process and enjoyed our conversations.
Although Scott bought a home here in 1992, it would seem that because
of the nature of his job, he had to spend a lot of time outside the area.
Recently he has been able to spend more time here and involving
himself more and more into the community.
Scott, while I believe you are a good candidate for this position and
would make a strong candidate if you chose to run in the May primary, I
find myself leaning towards someone who has spent a little more time in
the community.
Tammy Baney,
I met with Tammy some time in July as she was putting together her
campaign to run for County Commissioner. I asked her some very hard

questions that I would ask any candidate for public office no matter who
they were or what party they belonged to. From her answers, she had
clearly been thinking about this run for office for awhile.
Tammy has been in the community for a long time. Recently she was
selected Vol. Of the Year for her public service. She has served on the
Commission on Children and Family for a number of years including
serving as chairperson of the Commission. She clearly involves herself
in the Community and approaches her involvement with enthusiasm,
dedication, and passion.
Tammy has already filed to run in the May primary. I have no doubt that
if the voters select her in the primary and general election that Tammy
Baney will be an excellent County Commissioner and represent the
interest of Deschutes County and its citizens with the same enthusiasm,
dedication and passion she has brought to her other endeavors.
Bev Clarno,
I first met Bev Clarno in 1988 when she ran in the primary for the
legislative seat vacated by Bill Belmany, It was a hotly contested race
and Bev won the primary. She then had a hotly contested general
election race which she also won. Bev has an extensive public service at

the local, state, and national level. In her years of public service, she has
made extensive contact that can and have been a great value to
Deschutes County. She has shown that Deschutes County voters support
her actions by continuing to win many elections since the 1988 primary.
Bev is known for her fairness and in 1995 was elected on a unanimous
first ballot for Speaker of the House.
This is a difficult decision because of the qualification of the three
candidates before us. I know it was a tough job for the Central
Committee, who has been called on three times in recent memory to
place candidates before the County Commission, to narrow the list of
candidates down from an even larger list of qualified candidates. I
appreciate their efforts and commend them on the slate of candidates
before us.
There is something about running for office, if you open yourself up to
it, that helps you learn more about yourself. Yes, it is an opportunity to
let the voters know who you are and what your views are, but very often
that is filtered by the ads and the stories that make it to the press. But for
me the part that really sharpens your views and helps you learn about
yourself is the one on one contact with the voters in the door to door

campaigning, the public meetings and the town halls. It is though this
process that the voters get more comfortable with you or at least you
hope more comfortable with you then your opponent.
We face some major decisions in the next year many of them dealing
with land use issues. We face a vote on forming two taxing districts for
Sheriff's office funding. We will face decisions on how to handle the
issues that will be brought up by the Juv. Department report that has
been prepared. We face some tough decisions on budget priories in the
coming year with a general fund that at the present rate of spending
faces a possibility of going upside down. We also face the re-
authorization of the forestry title 2 title 3 bill that has contributed a lot of
funding for roads, forest cleanup, and Search and Rescue operations.
In speaking with Congressman Walden, he suggests that Bev Clarno
would be a help in the re -authorization process because of her
relationship with congressional leaders in four western states and the
current Bush administration during her service as Region 10 Director of
the US Department of Health and Human Services.
I have worked closely with Bev Clarno since 1992 when I first ran for
the Oregon Legislature. I know how she works under pressure, how she
treats people and the decision making process she uses. While the voters

are getting to know Scott and Tamey, they already know Bev and that I
believe will help bring back some of what the County has lost over the
last few month in the eyes of our citizens. The resignation of a County
Commissioner not only effects the BOCC and our staff. It effects all our
departments and staff. Uncertainty in your job and uncertainty in your
management team is disruptive and a distraction that our employees do
not need on top of everything else they have to deal with. Many of our
employees know Bev and many have worked with her on various
legislative and department issues. I believe having Bev on board for the
next years will help bring needed stability to the Deschutes County
Government structure.
There is not a guarantee that if either Scott or Tamey were selected to
fill this vacancy, that the person selected would make it through the
primary or the general election. That is a chance I do not believe we
should take.
With all due respect to the qualified candidates we have before us today,
I would vote to have Bev Clarno fill the vacancy created by
Commissioner DeWolf's resignation.

CANDIDATE SELECTION

NOVEMBER 30, 2005
Picking a new person to serve out the remaining term of
Commissioner Tom DeWolf is one of the most important decisions
I have been called upon to make in my 5 years as a Deschutes
County Commissioner. I have to say, my decision has occupied
most of my thinking during the past few weeks. I have wrestled
with the idea of filling DeWolf s position with someone who is
only going to serve for the remainder of the term OR someone who
is willing to go for it and make being a Deschutes County
Commissioner a career. All three Candidates have good
qualifications, the most important I believe is the desire to serve.
The Bend Bulletin in their editorial page has never missed an
opportunity to bash our current form of County Government every
time there is an issue with a Commissioner. This latest issue with
Commissioner DeWolf really got their editorial juices running
again just because one Commissioner stepped out of line. They
fail to recognize that the other two Commissioners still have their
Credibility and County Government still continues on without a
hitch.
In making my decision today, I weighed the idea of picking Bev
Clarno to fill out the remaining term of Commissioner DeWolf. I
listened to the arguments that the remaining candidates would have
an equal chance in the up coming election and would not have to
worry about being a Commissioner and Campaigning at the same
time. There was even the idea that important decisions that have to
be made in the next year could be used against them in the
upcoming election. I do not believe nor do I support any of these
arguments.

I have contacted a number of Deschutes County Department heads
and other staff to get their input on who I should pick for the job.
Those who have worked with and know Tammy Baney are over
whelmingly in favor of choosing her for the position. There are
others who do not know Tammy feel Bev Clarno would be more
qualified. I think the biggest issue with Deschutes County
Employees is they need stability. With all that has happened the
past few months, there is a sense of uncertainty out there and our
employees need that sense of stability, of knowing who they will
be dealing with in the future. We can not give them a feeling of
stability by appointing a temporary Commissioner.
I have met with Scott Waters and feel very comfortable that he has
the intelligence and ability to become a very good County
Commissioner in the future, However he is not well known, and
does not have the name recognition that Bev and Tammy have.
I believe this vacant seat must be filled with someone who is
willing to make those tough decisions in the next year in full view
of the voters of Deschutes County. How better to judge the
candidate in the next election than to look at a voting record. I am
sure the voters would like to have that information before making
their decision. I also believe the person most qualified to fill that
position is Tammy Baney. She has been working with Deschutes
County as a volunteer for over four years and has worked her way
up to be elected as chair of the Deschutes County Commission on
Children and families a very large responsibility on its own. In a
recent interview of the Candidates, the issue of an incumbent
making decisions that may affect the upcoming election, she was
the first to say that we would be picking the wrong candidate if
they were worried about their decisions affecting a future election.
I very much respect that way of thinking.

Although I respect Bev Clarno for what she has accomplished in
her lifetime and consider her and her husband Ray friends, the
position of Deschutes County Commissioner is very complex and
requires a very large learning curve. Why waste a year training
someone who is not going to continue on and then take another
year or more to train another Commissioner after that. We need to
fill this position with someone who has a good chance of winning
the next election and I believe Tammy Baney is that person.
