MINUTES OF DEPARTMENT UPDATE - COUNTY FORESTER
DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, NOVEMBER 9, 2005
Commissioners' Conference Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Dennis R. Luke and Michael M. Daly. Also present
were Mike Maier, County Administrator; Tom Blust, Dennis Morris and George
Kolb, Road Department; and Joe Studer, County Forester; and three other
citizens. No representatives of the media were present.
A copy of the agenda is attached for reference. The meeting began at 1: 30 p. m.
Discussion took place regarding the most recent version of a proposed vacant lot
and unprotected lands ordinance.
The Commissioners indicated that consideration of the appointment of Mike
Schmidt to the Project Wildfire Steering Committee needs to be on the regular
Board agenda in the near future.
No formal action was taken by the Board.
Being no further items discussed, the meeting ended at 1:40 p.m.

RE: Monthly update
There are three topics for discussion and information sharing:
1. Approximately 225 of 300 acres have been mowed at the New Neighborhood
project in La Pine. Please see attached map/pictures for a visual of the quality of
the work. We are paying $40/acre for this project and the results are outstanding
from a hazardous fuels treatment perspective.
2. In Project Wildfire Ordinance, the BOCC must approve new and/or replacement
memberships to the Steering Committee. We have two vacant slots, one for a
business person and one for an "at large" person. I nominate Mike Schmidt from
Bend Chamber of Commerce who will replace the former Bend Chamber
Director.
3. Based on the public comment we had from the hearing and direction from the
BOCC at an administrative liaison meeting (11/3) the following updates and
timelines are available for consideration;
a. Deschutes County defensible space and vacant lot ordinance will be for
the unprotected lands only
b. The standards will be the same for both defensible space and vacant lots
as is SB-360 (see attachment). The important difference is the 20 foot
fuel break around all vacant lots/properties in the unprotected lands.
There will be no classification of high, extreme or high density extreme. If
it is vacant, there will be a fuel break.
c. The Oregon Department of Forestry (ODF) is working with a state wide
committee to re-define the rules for vacant lots state wide. The target for
a product is January 2006.
d. Deschutes County will reconvene the classification committee for the
county and modify the amount of "high density extreme" vacant lots but
will be guided by the state wide ODF effort (sometime after January, I
suggest after the 3rd reading of the ordinance or about April 1, 2006.)
e. I suggest the 1St reading of the ordinance occur the week of January 16,
2006.
f. There will be a "grace period" that will be essentially the same as ODF's
for SB 360.
g. There will also be exemptions for industrial and agriculture lands.

Vacant Lot and Unprotected Lands
ORDINANCE
September 2005
An ordinance requiring that hazardous/flammable vegetation is removed,
on private lands with structural improvements and vacant properties to
reduce the wildland fire hazard.
(1) It shall be the responsibility of every landowner in Deschutes County
to reduce the wildland fire hazard created by flammable weeds,
grass, brush, trees and other combustible vegetation on their
property by complying with the requirements of the County
ordinance. This will apply to private lands in Deschutes County
which is classified as "Unprotected." For the purpose of this
ordinance, "unprotected lands" are those that neither structural
nor wildland fire protection is provided by any agency.
(2) The purpose of reducing the wildland fire hazard by treating
hazardous fuels shall be to ,protect the property from the spread of
wildland fire from other properties; as well as confining any fire on
the property by preventing its spread to other properties.
(3) Every landowner in the area described in (1) above with structural
improvements will meet the' Default Standards of the Oregon
Forestland-Urban Interface Fire Protection Act of 1997, ORS
477.015 through ORS 477. 061. The Default Standards are as
follows:
a. Step 1: Establish a 30-foot primary fuel break around the
home, and any other structure on the property.
b. Step 2: Determine whether a secondary fuel break is
necessary. There are two determining factors, first what is the
fire risk classification of the home and second is whether the
roofing material is flammable or nonflammable material.
c. Step 3: Determine whether it is necessary to create a fuel
break around the driveway. If the driveway on the property is
shorter than 150 feet, a fuel break does not need to be created.
If the driveway is 150 long or longer, a fuel break must be
established.
d. Steps 4 & 5: Remove any portion of a tree that is within 10 feet
of a chimney, and remove all dead vegetative material
overhanging the roof or collected on the roof.
e. Step 6: Clear flammable material out from beneath decks.
(4) Step 7: Move firewood and lumber piles at least 30 feet from
structures, unless properly protected from adjacent fuels and flying
brands during a fire. Properly protected means to provide a
woodshed (a structure) that has a roof and walls with protected
openings to prevent sparks and brands blowing within. This could
mean that doors, windows, properly screen vents. This must be
done during the months of fire season (May15 thru October 1S)(5) Every landowner in the area described in (1) above, shall treat
vacant lot property in the following manner:
(a) All vacant lots regardless of size will construct a 20 foot wide
fuel break around the perimeter of the property. The following
standards will apply:
• Timber Fuel Types:' Individual and groups of trees shall
be separated by a distance equal to the diameter of the
crowns adjacent to each other, or 15 feet, whichever is
greater. Trees will be pruned to remove ladder fuels up to
3 times the height of the ground vegetation. In all cases
dead fuels shall be removed.
• Grass and Brush Fuel types: Fuel beds will be mowed or
trimmed to a height not greater than 4 inches. Where
sparse fuel loading is present i.e. will not sustain fire
spread, exemptions will be accepted.
• Fuel treatment shall be completed and maintained prior to
the beginning of each fire season (May15 thru October
1 st
(b) A violation of this ordinance by any person, firm or corporation
shall be a Class A violation as defined by Chapter 1.16 of
Deschutes County Code.
(c) There will be a "grace" period of this ordinance until July
2007 to allow sufficient time for compliance.
(d) Industriall and agriculture lands are exempt from this
ordinance.
