2006-99-Order No. 2006-019 Recorded 1/31/2006REVIEWED DESCHUTES COUNTY OFFICIAL RECORDS 406.99 NANCY BLANKENSHIP, COUNTY CLERK COMMISSIONERS' JOURNAL 01/31/2006 03;38;25 PM LEGAL COUNSEL 111iiii111111111111111111111 20 !9 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order for the Sale of Certain Real Property Acquired by Deschutes County * ORDER NO. 2006-019 WHEREAS, Deschutes County has acquired title to certain real property, described in Exhibit "A," attached and incorporated by this reference, pursuant to real property tax foreclosure proceedings on file in the Circuit Court of the State of Oregon for Deschutes County, and WHEREAS, foreclosure proceedings are completed, and tax deeds in the regular form have been executed by the Deschutes County Tax Collector and recorded in the Deed Records of Deschutes County pursuant to ORS 312.200 with respect to real properties acquired by tax foreclosure, and WHEREAS. ORS 271.310 authorizes the sale by the Board of County Commissioners of the real property acquired through real property tax foreclosure, and WHEREAS, the real property described in Exhibit "A," attached is not needed for County purposes and, thus, surplus, and WHEREAS, the sale of the real property described in Exhibit "A" will aid with the development of the Newberry Neighborhood by allowing the County to sell the properties and place restrictive covenants/conservation easements on the properties in furtherance of the Transfer Development Program in Deschutes County Code ("DCC") Chapter 11. 12, and WHEREAS, the sale of the real property will aid in the reduction of fire fuel in that all purchasers will be required to sign an agreement to eliminate wildfire fuels, and WHEREAS, it appears that it is in the best interests of the County to sell the real property described in Exhibit "A", and that the minimum price set forth after the description of each parcel, be the minimum price for any said sale; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. That the Deschutes County Sheriff hereby is authorized and directed to offer for sale the property described in Exhibit "A", attached hereto and by this reference incorporated herein, to the highest and best bidders, for cash, but not less than the minimum bid hereby fixed. Section 2. That said sale is to be made at the Board of County Commissioners Hearing Room, 1300 NW Wall Street, Bend, Oregon, at 10:00 a.m. on Friday, March 17, 2006. Section 3. All sales shall be deemed conditional until such time as the board of County Commissioners formally accepts or rejects said sale and thereafter closes the auction. That the Deschutes County Property Specialist is authorized to take those actions reasonably calculated to efficiently and successfully conduct the aforementioned land sale auction, including deviation from or modification of sale procedures, when, in the opinion of the Property Specialist, said deviations or modifications are justified. DALY, C MISSIONER PAGE 2 of 2- ORDER No. 2006-019 (1/3 0/06) Exhibit "A" NOTICE OF SALE Pursuant to Order No. 2006-019 adopted by the Board of County Commissioners of Deschutes County, Oregon, on January 30, 2006, I shall, at 10:00 a.m. on March 17, 2006, proceed to sell at public auction in the Board of County Commissioners Hearing Room, 1300 NW Wall Street, Bend, Oregon, to the highest and best bidder, for cash, all of the right: and title to and interest of Deschutes County in the real property listed below. All prospective bidders shall register at the auction and provide an acceptable picture I.D. prior to bidding. Payment of the bid price will be cash, to the Sheriffs deputy conducting the sale, at the time that the high bid is determined. "Cash" is defined as all legal U.S. currency; a certified bank check; negotiable traveler's checks; negotiable bank time certificates with not more than thirty days unit expiration; postal money orders; or a personal check, providing that a cashier's check is delivered to the county to replace the personal check within one business day following the sale. Checks will be payable to Deschutes County. Returned or dishonored checks will be prosecuted to the full extent of the law. The highest offer for any parcel that is equal to or exceeds the minimum bid price shall be conditionally accepted. Upon acceptance of an offer at the time of the sale, the sale as to that parcel shall be deemed closed. This auction shall be continuous from and after the above sale date until closed by the Board of County Commissioners. ALL PARCELS ARE. SOLD AS IS. Potential bidders should thoroughly investigate all aspects of a property prior to bidding. Deschutes County has not surveyed the aforementioned real properties and makes no representation as to boundaries, encroachments or encumbrances. Deschutes County does not guarantee or warrant that any parcel is buildable, suitable for septic system, has legal access, is vacant or is usable for any particular purpose. The County shall not warrant or defend the fee simple title of real property offered for sale to be free of defects or encumbrances, but will only sell and convey such interest as the County acquired by foreclosure or other means acid holds at the time of sale. Furthermore, conveyance is subject to all valid, recorded easements, road right: of way dedications and the right of any municipal corporation to purchase such property pursuant to State law and subject to the right of the Board of County Commissioners to reject any and all bids. EACH AND EVERY PROPERTY WILL BE SOLD SUBJECT TO THE BUYER ACCEPTING TITLE ENCUMBERED WITH A COVENANT THAT RESTRICTS DEVELOPMENT PURSUANT TO THE DESCHUTES COUNTY TRANSFERABLE DEVELOPMENT CREDIT PROGRAM, DESCHUTES COUNTY CODE CHAPTER 11.12. ADDITIONALLY, PRIOR TO TRANSFER OF TITLE, THE SUCCESSFUL BIDDER MUST SIGN AN AGREEMENT TO ELIMINATE THE WILDFIRE FUELS.
