An Order Amending Order 2006-019 for the Sale
of Certain Real Property Acquired by Deschutes
County
ORDER NO. 2006-037
WHEREAS, on January 27, 2006, the Board of County Commissioners ("Board") signed order 2006-
019, incorporated by reference herein, ordering the sale of certain County property acquired through tax
foreclosure proceedings as authorized by ORS 275.110, and
WHEREAS, Property Management staff, in discussion with Sheriffs Office staff, learned of certain
logistical issues that will require a delay in the auction date and a revision to the auction notice; and
WHEREAS, ORS 275.190, as amended by Senate Bill 281, Oregon Session Law 243, Section 3 (2005),
requires successful bidders to pay with cash at the time of the sale, and
WHEREAS, ORS 275.150 requires the Sheriff to issue a certificate of sale to the highest bidder, if this
were a foreclosure execution sale, however, pursuant to Senate Bill 920, Oregon Session Laws, Chapter 542,
Section 29 (2005), a successful bidder may pay with a cashier's check and the Sheriff would issue a receipt at
the sale and not issue that certificate until the Sheriff receives verification within fifteen (15) days from the date
of the sale from the financial institution that all accounts are settled, and
WHEREAS, the Board finds it in the best interest of the public to allow successful bidders at the March
2006 auction to pay by cashier's check; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section 1. That, Order 2006-019 is amended in order that the Deschutes County Sheriff hereby is
authorized and directed, pursuant to ORS 275.120, to offer for sale the property described in the revised Exhibit
"A", attached hereto and by this reference incorporated herein, to the highest and best bidders, for cash, but not
less than the minimum bid hereby fixed.
Section 2. That said sale is to be made at the Board of County Commissioners Hearing Room, 1300
NW Wall Street, Bend, Oregon, at 10:00 a.m. on Thursday, March 30, 2006.
Section 3. That the Sheriff is authorized to accept certified cashier's checks from successful bidders,
issue a receipt at the time of sale to those successful bidders submitting certified cashier's checks and issue the
certificate of sale in the same manner provided in Senate Bill 920, Oregon Session Laws, Chapter 542, Section
29, paragraphs (1) through (6) and paragraph (10) (2005).
Section 4. All sales shall be deemed conditional until such time as the board of County Commissioners
formally accepts or rejects said sale and thereafter closes the auction.

Section 4. That the Deschutes County Property Specialist is authorized to take those actions reasonably
calculated to efficiently and successfully conduct the aforementioned land sale auction, including deviation from
or modification of sale procedures, when, in the opinion of the Property Specialist, said deviations or
modifications are justified.

All prospective bidders shall register at the auction and provide an acceptable picture I.D. prior to
bidding. Payment of the bid price will be cash or cashier's check, at the time that the high bid is determined.
Cash is defined as all legal U.S. currency. Cashier's checks will be payable to Deschutes County. Cashier's
checks must be drawn on a financial institution that is authorized to do business under the laws of Oregon or the
United States. If any part of the purchase price is paid with a cashier's check, the purchaser will be given a
receipt in lieu of a certificate of sale until verification from the financial instution that final settlement has been
made on the cashier's check. Upon receiving such verification, the purchase will receive a certificate of sale.
The highest offer for any parcel which is equal to or exceeds the minimum bid price shall be
conditionally accepted. Upon acceptance of an offer at the time of the sale, the sale as to that parcel shall be
deemed closed.
ALL PARCELS ARE SOLD AS IS. Potential bidders should thoroughly investigate all aspects of a
property prior to bidding. Deschutes County has not surveyed the aforementioned real properties and makes no
representation as to boundaries, encroachments or encumbrances. Deschutes County does not guarantee or
warrant that any parcel is buildable, suitable for septic system, has legal access, is vacant or is usable for any
particular purpose. The County shall not warrant or defend the fee simple title of real property offered for sale to
be free of defects or encumbrances, but will only sell and convey such interest as the County acquired by
foreclosure or other means and holds at the time of sale. Furthermore, conveyance is subject to all valid,
recorded easements, road right of way dedications and the right of any municipal corporation to purchase such
property pursuant to State law and subject to the right of the Board of County Commissioners to reject any and
all bids.
EACH AND EVERY PROPERTY WILL BE SOLD SUBJECT TO THE BUYER ACCEPTING
TITLE ENCUMBERED WITH A COVENANT THAT RESTRICTS DEVELOPMENT PURSUANT TO
THE DESCHUTES COUNTY TRANSFERABLE DEVELOPMENT CREDIT PROGRAM,
DESCHUTES COUNTY CODE CHAPTER 11.12.
ADDITIONALLY, PRIOR TO TRANSFER OF TITLE, THE SUCCESSFUL BIDDER MUST
SIGN AN AGREEMENT TO ELIMINATE THE WILDFIRE FUELS.
Example copies of the Fuels Management Agreement and the Transferable Development Credit
Program restrictive covenant document are available for review on the Deschutes County website
(www.co.deschutes.or.us) and at the office of Deschutes County Property Management, 1300 NW Wall Street,
Suite 200, Bend, Oregon. Packets of tax lot maps may be viewed through the website address above or
purchased from the Deschutes County Property Management Department at the above address. For information
