BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Vacating "E" Avenue between 2nd
Street and 3~d Street located in Terrebonne,
Deschutes County, Oregon.
ORDER NO. 2006-001
WHEREAS, the Board of County Commissioners, of Deschutes County, Oregon, initiated the vacation
of "E" Avenue between 2"d Street and 3rd Street located in Terrebonne by Resolution Number 2005-137 dated
December 14, 2005; and
WHEREAS, the Board of County Commissioners requested the County Road Official to prepare a
report relating to the vacation; and
WHEREAS, the Board of County Commissioners accepted and approved the County Road Official's
report and as required by ORS 368.346 set a public hearing on January 25, 2006 at 10:00 a.m. by Order
Number 2005-140 dated December 14, 2005; and
WHEREAS, notice of hearing was given in accordance with ORS 368.346(3) and 368.401 to 368.426;
and
WHEREAS, the Board of County Commissioners held said hearing to consider matters presented
under ORS 368.346; and
WHEREAS, the Board of County Commissioners finds that it is in the public interest to vacate the
public property; now, therefore,
THE' BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as
follows:
Section 1. That the property, described in Exhibit "A", attached hereto and by this reference
incorporated herein, is hereby vacated.
1 - ORDER NO. 2006 - 001
Section .2. That the property, vacated in Section 1, shall vest in the rightful owner holding title
according to law pursuant to ORS 368.366(1)(c).
Section 3. That the Deschutes County Surveyor is directed to mark a copy of the plat, if any, as
provided in ORS 271.230.
Section 4. That this Order shall be recorded with the Deschutes County Clerk, and copies shall be
filed with the Deschutes County Surveyor and County Assessor.

Description of the vacation of a 30-foot wide parcel of land
adjacent to an existing roadway vacation by County Ordinance
No. 1998-85, situate in that portion of "E Avenue" lying
between the East line of 2nd Street and the East line of 3rd
Street, Townsite of Hillman (Terrebonne, Oregon), a
subdivision of the Northwest Quarter of the Southwest
Quarter (NW1/4 SW1/4) of Section 16, Township 14 South,
Range 13 East of the Willamette Meridian, Deschutes County,
Oregon, more particularly described as follows:
Commencing at the SW corner of Block 24, Townsite of
Hillman, the Initial Point;
thence South along the East line of "2nd Street" - 15 feet
to the true POINT OF BEGINNING;
thence East along the South line of the North 15 feet of "E
Avenue" - 230 feet to the centerline of 113rd Street";
thence East along the South line of the North 15 feet of "E
Avenue" - 30 feet to the East line of 113rd Street";
thence South along the East line of 113nd Street" - 30 feet;
thence West along the North line of the South 15 feet of "E
Avenue" - 30 feet to the centerline of 113rd Street";
thence West along the North line of the South 15 feet of "E
Avenue" - 230 feet to the East line of 112nd Street";
