Daly, and via conference call Commissioner Dennis R. Luke. Also present were Michael A. Maier, County Administrator; Mark Pilliod, County Counsel; Dan Despotopolus and Kathy Herringer, Fair & Expo Center. Also present were media representative Lily Raff of the Bend Bulletin; and two other citizens. Commissioner Daly opened the meeting at 10:00 a.m. Commissioner Daly stated that for the record, Commissioner Luke was attending the meeting via conference call from Congressman Walden's Office in Washington, DC. He also stated that the meeting today was for one item only. L Before the Board was Citizen Input. None was offered. Before the Board was a Discussion of a Public Hearing and Consideration of Signature of Resolution No. 2005-145, Request for Exemption from Competitive Bid Process for the Sagebrush Arena at the Fairgrounds. Commissioner Daly asked staff to give their staff report. He asked Staff to explain exactly what was being proposed. Mark Pilliod said the purpose of this meeting is to hold a public hearing, as for the Board acting in its capacity as the Contract Review Board, to conduct a public hearing and determine whether or not to grant an exemption from the traditional public contracting requirements for a future public project at the Fair & Expo Center. That project generally consists of the design and construction of a roof for one of the outdoor arenas at the Fairgrounds. The actual contract would be one entered into by the Fair Board as it is located on Fairgrounds property. The County Commission is the Contract Review Board for this proceeding and it is necessary for the Board to determine, pursuant to state law, that an exemption is justified. My office and the office of the Director of the Fair & Expo Center have prepared a staff report. The proposed resolution that had been previously presented to the Board, I believe those are in front of you today. That staff report goes into an explanation as to the basis for granting the exemption if the Board agrees with that justification. Following the public hearing the Board will be asked to decide whether or not to grant the exemption. Commissioner Luke stated to Mr. Pilliod that on the last option, he would be uncomfortable moving forward on this until perhaps Monday when everyone was in the same room together. He agreed to call in today because the public hearing was posted for today and he wanted to hear what the public had to say. He asked Mr. Pilliod if that created a problem. Mr. Pilliod said that it did not create a problem. He said that whatever time savings are involved in approving the resolution aren't going to be undermined or jeopardized by waiting a few days. Commissioner Daly said that Commissioner Luke has indicated that he is not prepared to go forward with this today, so the hearing will be postponed to the next regular meeting. board of Uommissioners' Meeting Agenda Wednesday, December 7, 2005 Page 2 of 3 Pages Mr. Pilliod stated that the public hearing could be held today. Commissioner Luke said that he had 30 minutes and if the public wanted to testify, he could stay on the phone for that amount time. Commissioner Daly said that his understanding is that Commissioner Luke is not prepared to make any kind of a decision today. Commissioner Luke stated yes, but if the public wanted to testify, he would not want them to have to come back. Commissioner Daly said that we have two people here to testify today. From the audience the gentlemen who came to testify said they would be more than happy to come back Monday to testify as that would give them time to read the resolution. Commissioner Daly said that that is probably the best idea as the documents were not ready for the public when they came in and they have not had time to really read and evaluate them. Commissioner Daly postponed the hearing to a time certain, which would be Monday, December 12th at 10:00 a.m., at the regular Board Work Session.
