Daly, Bev Clarno and Dennis R. Luke. Also present were County Administrator Mike Maier; and, for a portion of the meeting, Susan Ross and Teresa Rozic, Commissioners' Office; Joe Studer, County Forester; Laurie Craghead, Legal Counsel; Scott Johnson, Mental Health Department; Tom Anderson and Catherine Morrow, Community Development; Katy Lighthall, Project Wildfire; and Tom Andrade and Gordon Foster, Oregon Department of Forestry. Also present were media representatives Christopher Stollar of the Bulletin and David Johns of News Channel 21. No other citizens attended. The meeting began at 9:00 a. m. 1. Discussion regarding Rangeland Fire Protection Associations and an Update on Senate Bill 360. Joe Studer, Gordon Foster and Tom Andrade presented information on the progress of local rangeland fire protection associations. They said that several groups are almost done with the process and others are in various stages. Mr. Studer stated that these efforts tie in with the work of Project Wildfire and laws regarding unprotected lands. The associations will have legal standing, a formal plan and can coordinate efforts with various agencies when the need arises. Mr. Andrade gave an overview of Senate Bill 360 and issues regarding vacant lands. At this time Deschutes County has about 8,000 certified homesites, which means the property owners not only did the necessary work, but also have submitted the required forms. Approximately 3,800 Sunriver properties will be certified in one block. Minutes of Administrative Liaison Tuesday, March 14, 2006 Page 1 of 5 Pages Eighty assessors have been trained; these are citizens who understand the law and work with other citizens to decide what to do with their properties. Other considerations during this process are how to handle vacant lands, since SB 360 just involves those with homes; and the impact on wildlife. (Information on these subjects is attached as Exhibit A.) 2. Discussion of an Ordinance Amending Deschutes County's Subdivision/Partition Code regarding Collection of Park-In-Lieu-of Funds. Susan Ross explained that at one point Legal Counsel determined that the funds being collected for parks really should be considered SDC's. Since the County had no legal authority or methodology established to handle SDC's, the Board decided that the funds already collected should be disbursed. A committee was formed, consisting of representatives of the various park districts that do not have their own funding. These groups - from Sisters, Sunriver, Deschutes County in general and La Pine - decided how the dollars should be disbursed. La Pine has already used its portion for a new ballpark. Legal Counsel has now determined that the funds were not actually SDC's after all, and the County can continue to collect them. Commissioner Luke said that if there is a way to distribute the money fairly, he would like to see them continue to be collected. With Measure 37 claims being approved, there will be additional rural developments that are not part of an existing park district. Commissioner Daly stated that he does not support any type of SDC or fee of this type. Commissioner Clarno explained that if the fees can be used in the area where they were collected, she would be supportive of continuing to collect them. Mike Maier said that they could be project specific, and distributed every few years or as appropriate. Tom Anderson stated that the Ordinance needs to be changed to be consistent in that the fee would not be collected where an SDC is already collected by an existing park district. He added that there could be an exemption if a developer dedicates land for park purposes. Commissioners Luke and Clarno directed Mr. Anderson to include this change to the Ordinance when they do a general "clean up" of various Ordinances. A request was submitted by the Central Oregon Chapter of the Oregon Association for the Education of Young Children. After a brief discussion, Commissioner Clarno agreed to provide a grant in the amount of $1,000. 4. Review and Approval of Offers on Lots in Newberry Business Park. Teresa Rozic stated that three offers have been received. Robin and Kaylene Shook have a hardwood flooring business, and have made an offer on two lots. Russell and Tina Roberts of B & R Framers have offered to purchase one lot. Freightlanes International is already in escrow on three lots and wishes to purchase three more; they are moving an existing business from Bend to La Pine. CLARNO: Move approval of the offers. DALY: Second. VOTE: DALY: Yes. CLARNO: Aye. LUKE: Chair votes yes. 5. Update on the Redmond Rod & Gun Club Lease. At the Commissioners' regular meeting with the Redmond City Council on Thursday, March 9, a consensus was reached that the lease would be for ten years, with a one-year buyout clause. However, one party asked for clarification of the buyout issue. This will be addressed again at the Monday, March 20 Administrative Liaison. 6. Discussion of Elected Officials Compensation Committee. Mike Maier explained that State law requires this committee. IN the past the three lay members of the Budget Committee have worked with an outside consultant to make these salary recommendations. Mr. Maier suggested that a salary survey be done in-house to save the cost of a consultant. The counties to be surveyed have already been established and are consistent with Deschutes County in terms of growth, responsibilities, population and so on. The Commissioners agreed this would be appropriate. Minutes of Administrative Liaison Tuesday, March 14, 2006 Page 3 of 5 Pages 7. Discussion of Office Hours - FY 2006-07. Mr. Maier attended a recent LPSCC (Local Public Safety Coordinating Council) meeting at which there was a lengthy discussion regarding the lack of State funding for a Parole Officer to oversee misdemeanor sex offenders. The group was very concerned about this lack of oversight and the real possibility of continued offenses that could escalate. The State has discontinued. funding for Parole Officers to handle misdemeanor offenders altogether. At the same meeting, it was decided because July 3 is a Monday and July 4 is a holiday, and many people will be taking a four-day weekend, there would be no July LPSCC meeting. Mr. Maier investigated the financial impact of having the County officially closed on July 3, with the exception of the Sheriff s Office, landfill and other operations that would remain operational. He said having the County closed that day would equal a savings of at least $100,000. He informally spoke with department heads and other employees, who supported the idea of the County being closed for that day if the funds would be directed to hiring a Parole Officer to oversee misdemeanor sex offenders. It is understood that this would be a short-term fix while the County pursues stable funding for the position from the State and other sources. He also spoke with the union representative who was generally supportive. The Commissioners supported this recommendation; Mr. Maier will draft a memo to be distributed to employees so they can plan accordingly. 8. Other Items. None were offered. The committee met twice, reviewed the rules, discussed vacant lands, an viewed vacant lands, crafted options. Options considered: 1. Abolish the HDE classification and make all Extreme vacant lots subject to the HDE standards. 2. Abolish HDE and make High and Extreme vacant lots subject to HDE standards. 3. Amend current classification criteria to require that more vacant lots be included. 4. Amend HDE classification to give classification committees more flexibility to address local concerns. 5. Maintain status quo. Committee decision: "Amend the classification process to give committees more flexibility to address local concerns and situations." "Develop a process to allow homeowner associations, local government, Fire Protection Districts to petition or request that HDE classification standards be applied to a specific area." Standards: "Amend the standards to require wider fuel breaks along roads." The Oregon Department of Forestry presented the findings and recommendations to the Board of Forestry on March 8t' 2006, the Board has taken the recommendations under consideration and will provide direction the ODF within a month. Exhibit Page o2 of 67 If the B of F concludes that amendments to the standards are appropriate the ODF will: 1. Reconvene the vacant lot committee. 2. Draft the amended standards. 3. Develop recommendations on how and when the amended standards are implemented. Exhibit A Page 3 of February 14, 2006 Rangeland Fire rotection Associations. Briefing Background of the Rangeland Fire Protection Associations: The concept of Rangeland Protection Associations starts with the formation of the Ironside Rangeland Fire Protection Association in the early 1960's in southern Baker and northern Malheur Counties. The objective of the associations is to protect rangeland, or undeveloped land that contains sagebrush or juniper (ORS 477.315) In 1998 there was an interest in eastern Harney County to provide fire protection to private rangelands. Five areas considered formation of Rangeland Fire Protection Associations (RFPA). They later consolidated into three Rangeland Fire Protection Associations, Pine Creek / Drewsey RFPA, Crane RFPA, Fields / Andrews RFPA. In 1999 the three areas went through the process and formed Rangeland Fire Protection Associations. In 2001 three more areas in the state requested consideration of formations of associations, Burnt River RFPA in Baker County, Silver Creek RFPA in northwestern Harney County, and Twickenham RFPA in Wheeler County. Crane RFPA and Pine Creek / Drewsey RFPA sent a request to merge to the Board of Forestry in 2003 and it was approved. Formation Process: Rangeland owners gather to explore ways to protect their property and rangeland from fire. They have two choices, form a Rural Fire Protection District or a Rangeland Fire Protection Association. If they chose to fora Rural Fire Protection District, they would work with the county and State Fire Marshal's office with input from the Department of Forestry and would form under ORS 478. If they chose to form a Rangeland Fire Protection Association, they would work with the Department of Forestry under ORS 477. The first step is to send a request to the Board of Forestry to form a Rangeland Fire Protection Association. The next step involves a public hearing by the Board of Forestry, the hearing records are filed and the Board of Forestry authorizes the formation of the RFPA. The By-Laws are developed, a Cooperative Agreement between the Board of Forestry and RFPA is developed to define the extent and type of protection to be conducted by the RFPA. There is a Mutual Aid agreement signed between the local Department of Forestry District and the RFPA. The ODF District facilitates the acquisition of training, FEPP equipment, and support for VFA and RFA grant funding. The RFPA is formed as a non-profit organization of rangeland owners pursuant to ORS 477.315 to 477.325. Annually the RFPA sends in their budget, operating plan, and organization to be approved by the Board of Forestry. (The Board of Forestry is seven member board appointed by the Governor to set policy for the Oregon Department of Forestry. The State Forester functions as Secretary to the Board.) Jurisdictional Responsibility: The jurisdictional responsibility defined in the agreement with the Board of Forestry is to "promptly, diligently and to the best of their ability proceed to suppress any uncontrolled fire burning on or threatening lands protected by the Association". The boundaries of the RFPA are defined in a legal description filed with the Board of Forestry. Exhibit A Page ___q of a Required Training & PPE for Rangeland Fire Protection Associations: From a technical standpoint the RFPA is not required to meet any training or PPE standard. Rangeland Associations are formed as non-profit organizations and do not have any employees, therefore they technically do not fall under the scrutiny of OR-OSHA and any of it's requirements. The Cooperative Agreement with the Board of Forestry section 2.02 states that "The Association agrees to properly train, equip and deploy the resources identified pursuant to paragraph 2.01". That level of training is taken to be the minimum level for incidental firefighters. ODF encourages the RFPA to utilize the training opportunities available and train to a level where they can fight rangeland fires safely and efficiently. Threaten Lands: The Cooperative Agreement between the Board of Forestry and RFPAs, in Article III, 3.01 states that "Association personnel shall promptly, diligently and to the best of their ability proceed to suppress any uncontrolled fire burning on or threatening lands protected by the Association and shall use all the resources identified pursuant to paragraph 2.01, or so much thereof as may be necessary". The decision on what constitutes a threat is determined by the Association personnel through the authority given by the Board of Forestry. Funding/Grants/Resources: Opportunities for grant funding are available through the VFA and RFA grant process. Applications are sent to each RFPA in March with a due date to Salem by April 15. Communications/Radios/Inter-operability: All radios procured need to be "Narrowband" capable and within the 150 to 172 mhz band width. Radios can be procured from the federal radio contract. Example, both Bendix King and Motorola radios can be purchased from Day Wireless in Bend on the GSA contract. Federal Excess Personal Property (FEPP): The RFPAs have an agreement with the Oregon Department of Forestry for FEPP equipment. 16 USC Chapter 41, section 2100 gives the responsibility to the State Forester for managing this program with state and local fire agencies. The Federal FEPP agreement is between the Secretary of Agriculture, Forest Service, State & Private and the State Forester. The State Forester has the same screening authority as a Forest Service Unit and can acquire FEPP directly from any federal agency to pass on to the Rangeland Associations.
