Daly and Dennis R. Luke; Commissioner Bev Clarno was out of the office. Also present were County Administrator Mike Maier; and, for a portion of the meeting, Susan Ross, Commissioners' Office; Brad Chalfant, Deschutes Basin Land Trust; and Sara Dice, Byron Maas and Leslie Lynch of SNIP House and the Bend Spay & Neuter Project. Also present was media representative Chris Barker of the Bulletin. No other citizens attended. The meeting began at 1: 30 p. m. 1. Discussion of Continuing Issue with a Fence on a Public Right-of-Way, Redmond. Commissioner Daly explained that there has been an ongoing issue regarding a fencing that is in a County right-of-way. Because livestock are going where they shouldn't be, this is affecting the delivery of irrigation water. One of the recipients of the irrigation water has decided to pipe the water. A property owner, Mr. Suchy, has threatened to sue because of the work going on. Evidently, a permit to work in the right-of-way is necessary. After a brief discussion, it was decided that the contractor should be advised to obtain a permit, and there should be no further problems with the situation. 2. Project Update. Minutes of Administrative Liaison Monday, March 20, 2006 Page 1 of 4 Pages Susan Ross explained that the County owns two small, unbuildable parcels near Avion Water off Highway 97. A developer who is developing the adjacent land has asked about purchasing the property, which is of no use to the County. The Commissioners felt that the property should be appraised, and also that a letter should be received from the Oregon Department of Transportation, indicating their support and stating that they don't have plans for the future use of the property. The Sentry/Erickson's market in La Pine is closed until October for remodeling, leaving only one major grocery store in La Pine, the Ray's Foods store that is located next to the South County Services Center. The manager has asked if the employees can park in the County's parking lot until the other store opens. There is adequate parking at this time. After a discussion, it was decided that a temporary license should be issued. In regard to the recent $1,000 fine levied by the Department of Environmental Quality, the County has the option of either paying the fine to DEQ or donating it to a non-profit that works to improve the environment. Commute Options did the research and contacted the County about his provision. The Commissioners made a few other suggestions as to who might receive the funds, but most are not directly involved in environmental issues. To begin the Justice Court program, a loan was taken out from the business loan fund. At this point, enough funds have come in to pay off the loan. It was written that any funds from the Justice Court that are more than the loan payoff and the cost of operations should go to traffic safety (Patrol). A lengthy discussion took place regarding how the funds should be handled. The Commissioners eventually decided to have the funds put back into the business loan fund for the time being, and a decision will be made later as to how to distribute future revenue and close out the fund. 3. Discussion regarding Proposed Use of County-owned Rickard Road Property by SNIP House and Bend Spay & Neuter Project. Representatives of the two organizations presented a request to lease the Rickard Road property, which the County had purchased some years ago to be a buffer property since it is located near Knott Landfill. The group is forming a single entity whose mission is the treatment and rehabilitation of cats and kittens, most of which are animals the local Humane Society shelters are not able or willing to house and treat. After treatment, the animals would be fostered by volunteers or adopted out from the various facilities. The group would not have the general public coming to the property; only the staff veterinarian and volunteers would be present. A full-time resident would live at the property to monitor the condition of the animals and to provide security for the animals and the property in general. No animals would be located outside of the dwelling, which is in need of general cleanup and some minor remodeling. The group would be responsible for maintaining the dwelling, the outbuildings and the acreage. The Commissioners indicated support for the group's proposal to lease the property because they would fulfill a needed community service, and asked that the details, to be addressed under a standard County lease agreement, be worked out with the County Administrator and Legal Counsel. They are also to meet with Community Development to obtain the proper permits to use the property as stated. The County Administrator asked that this be handled in a prompt fashion as he has concerns about the property, which is fairly isolated, remaining vacant. The representatives of the group will contact Community Development and Legal Counsel to get the process going. 5. Other Items. None were offered. Being no further items brought before the group, the meeting adjourned at 2: 40 p. m.
