MINUTES OF ADMINISTRATIVE LIAISON
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, MAY 8, 2006
Commissioners' Conference Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke, Bev Clarno and Michael M. Daly.
Also present were Mike Maier, County Administrator; and, for a portion of the
meeting, Susan Ross, Teresa Rozic and Anna Johnson, Commissioners' Office;
Tom Blust and George Kolb, Road Department; and three other citizens. No
representatives of the media were present.
The meeting began at 2: 00 p. m.
1. Discussion of 94th St. Road Encroachment Issue.
A lengthy discussion took place regarding a complaint regarding a berm and
rocks that are located in a road right-of-way. An order was issued for the
property owner to remove the rocks by May 10.
The complainant feels that the rocks and trees create a hazard. The property
owners stated that they are in the process of moving the rocks; however, that the
road is just an access road, not a County road, and were told that the trees could
remain.
George Kolb indicated that the Road Department feels there is no hazard, and
that this is merely a neighbor dispute. The trees have been in place since 1999,
and the lawn was established years before.
Commissioner Clarno said that moving the rocks to eight feet back is okay, and
suggested that the two parties take advantage of the County dispute resolution
program. Commissioner Luke agreed. Commissioner Daly stated that he feels
nothing should be in the right-of-way.

2. Project and Property Management Update.
Susan Ross said that the La Pine Center grand opening had about 150 attendees,
and the comments made were positive.
3. Economic Development Grant Requests.
Redmond Downtown Festival - $1,000 each, Commissioners Clarno and Luke.
4. Citizen Update.
Anna Johnson advised that the Budget Newsletter draft is out for review. She
also said that the Home Rule Charter Committee is hosting a public hearing on
Thursday, May 11 from 7 to 9 p.m.
5. Other Items.
Mike Maier said that Scott Johnson has asked that the Board authorize Oregon
Security Transport Company to transport mental health patients. The State
requires a letter of support from the Board for this company to be a provider.
Scott Johnson is to do a background check and bring the information to the
Board for consideration.
In regard to the affordable housing issue in the County and especially in Bend,
Mike Maier stated that the County owns acreage west of Juniper Ridge at
Cooley Road, and also acreage east of the Road Department that could possibly
be brought into the City and developed into affordable housing. He would like
to challenge the City in this regard, with development and management
possibly handled by Central Oregon Regional Housing Authority.
The Commissioners indicated he could proceed to learn what the City is willing
to do in this regard.
A dog bite incident has occurred involving a Mental Health client. Evidently,
Mental Health workers and their clients have routinely been bringing dogs into
the County buildings and have been transporting the dogs in County-owned
vehicles, under the guise of the dogs being therapy animals. This presents a
liability issue to the County.

Susan Ross is to develop a policy concerning animals in County buildings and
vehicles that will limit these animals to K-9, guide dogs and certified service
dogs. In the meantime, Risk Management will inform County employees that
no dogs other than the ones listed are to be allowed in County-owned vehicles.
6. Executive Session, called under ORS 192.660(1)(e) - real estate
negotiations; and ORS 192.660(1)(h), pending or threatened litigation.
The Board then went into executive session.
At the conclusion of executive session, the Board took the following action.
DALY: Move ratification of the offer to purchase the State Farm property,
with close of escrow to occur when the property has been vacated.
CLARNO: Second.
VOTE: DALY: Yes.
CLARNO: Aye.
LUKE: Chair votes yes.
Being no further items discussed, the meeting adjourned at 3:50 p.m.

To Whom It May Concern:
We are writing in support of our neighbors, Phil and Pam Clark and their
beautiful trees and landscaping. We have lived in the neighborhood since
1998. We have enjoyed their rockwork with the flowerbeds and were sad to
see them taken apart and moved back causing the loss of the flowerbed
circles incorporated into the rockery. Now we understand one neighbor's
complaint may also cause them to lose some trees and shrubbery. We do
not feel they should have to give these up. Their yard is one of the best kept
and best landscaped yards on the entire street. No one in the neighborhood
has objected to the trees or rockery in the past so why should a new member
of the neighborhood rob us of such beauty? There is ample road space for
large vehicles, horse trailers, trucks, etc to pass by each other with ease.
Our street is privately owned and not county maintained. Many of us
bought here because we like the cinder road with the natural speed bumps
(also known as potholes) which deter heavy traffic looking for a shortcut
from Tumalo Rd to the Old Bend/Redmond Hwy. We urge you to allow Phil
and Pam to keep their landscape intact. Please protect the trees.
