WHEREAS, an election was held in Deschutes County, Oregon on May 16, 2006, on the measure set forth in Exhibit A concerning the proposed Rural Law Enforcement District (District 2); and, WHEREAS, the abstract of votes for the Rural Law Enforcement District (District 2), a copy of which is attached as Exhibit B, certifies that the minimum fifty (50%) percent of registered electors of the District did not cast their ballots at the election, as required under Art. XI, Sec. 11 (8) (a); and, WHEREAS, ORS 198.820 (1) requires the Board to canvass the votes and declare the District petition dismissed if the Board determines that the majority of the votes cast opposed formation of the District; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. At the election held in Deschutes County, Oregon on May 16, 2006, as evidenced by the abstract of votes, a copy of which is attached as Exhibit B and incorporated by reference herein, 13,320 electors constituting 44.0 percent of the registered electors in the District cast ballots on the issue of formation of the District and, of those electors, 7,361 electors voted "yes,"5,959 voted "no" on the measure captioned "RURAL LAW ENFORCEMENT DISTRICT and ESTABLISH TAX RATE LIMIT", as set forth in the attached Exhibit A, incorporated by reference herein. (Name of County or Counties) The following shall be the ballot title of the measure to be submitted to the district's voters on this date: CAPTION (10 Words) RURAL LAW ENFORCEMENT DISTRICT with PERMANENT TAX RATE LIMIT QUESTION (20 Words) Shall Rural Sheriff's District be formed with maximum permanent tax limit of $1.55 per $1,000 assessed value beginning July 2007? This measure may cause property taxes to increase more than three percent. SUMMARY (175 Words) This measure may be passed only at an election with at least a fifty percent voter turn out. Currently, the Sheriff's Office is funded by a three-year levy that expires June 30, 2007. This proposed permanent tax rate would provide funding for a rural Sheriffs law enforcement district. It is not in addition to the expiring levy. Upon voter approval of both the countywide and rural Sheriffs law enforcement districts, rural residents would be included in both districts. Passage of the countywide or rural district is not dependent upon the passage of the other. The annual district rate will be approved by the Citizen/Commissioner Budget Committee. The maximum rate is not expected to be reached until 2013.
