BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Declaring a Contract Specific Special * RESOLUTION NO. 2006-093
Procurement for the Provision of Youth Mentoring Services
WHEREAS, ORS 27913.050 generally requires that all public contracts for goods and services be based
on competitive solicitation; and
WHEREAS, ORS 27913.085 nonetheless allows for contract specific special procurement upon the
making of certain findings by the local contract review board of a public agency; and
WHEREAS, The Deschutes County Code, Section 2.37.030 designates the Board of County
Commissioners to act as the local contract review board; and
WHEREAS, County staff has published notice of this proposal and has received no adverse comments;
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, acting in its capacity as the local contract review board as follows:
Section 1. Based upon the information stated in this Resolution and Exhibit A, which is adopted and
incorporated herein, the Board hereby finds that it is unlikely the approval of a contract specific special
procurement for the provision of youth mentoring services will not encourage favoritism in the awarding
of public contracts and will otherwise promote the public interest in a manner that could not practicably
be realized by complying with the requirements of ORS 27913.055, 27913.060, 27913.065 and 27913.070.
Section 2. Based upon the above findings, a contract specific special procurement is hereby granted
for the provision of your mentoring services by Bend Area Habitat for Humanity.
Section 3. This Resolution shall become effective immediately upon its adoption.

SUBJECT: Draft Findings in Support of Class Procurement for the Juvenile Department to
obtain a new provider of Youth Mentorship Services in the Community
A. BACKGROUND
The findings herein support a resolution authorizing the Deschutes County Board of
Commissioners ("Board"), acting as the Local Contract Review Board, to allow a contract -
specific special procurement by the Juvenile Community Justice Department to obtain a Youth
Mentorship Provider.
Since 1999, Habitat for Humanity has been a partner with the Juvenile Community
Justice Department. Together, Habitat and the Juvenile Department serve as mentors to youth
by teaching them the value of hard work while sharing skills and expertise about a particular
issue or vocation. These skills are learned during the construction of residential housing for
low glow -income families. Habitat for Humanity was selected and awarded a contract in
1999 because of its ability to address the following needs of the Department:
Provide Land and Materials to construct new housing including appropriate tools
Develop Mentorship Program for high-risk youth including mandatory training and on-
going support
-44Designed to integrate at -risk youth into the community through a stewardship program
involving the construction/landscaping of new housing. This offers youth a unique
opportunity for successful integration and reentry into the community as productive
citizens with new skills and connections with community members
4. Education credits are earned and credited towards a high school diploma or GED.
B. STATUTORY REQUIREMENTS
ORS 279B.085 provides that the Board may grant a Class Procurement for certain public
contracts upon the following findings:
that it is unlikely that such a procurement will encourage favoritism in the
awarding of public contracts or substantially diminish competition for public
contracts; and
2a. the awarding of a public contract pursuant to this procurement will result in
substantial cost savings to the County, or

2b. substantial promotion of the public interest that could not practicably be realized
by public contracting compliance requirements.
ORS 279B.085(5) requires notice of and an opportunity to comment at a public hearing before
a Class Procurement can occur.
C. FINDINGS
The Board staff makes the following findings in support of the contract -specific special
procurement and in compliance with the statutory requirements described above.
1. No Favoritism or Diminished Competition
The Juvenile Community Justice Department has an interest in developing service -centered
mentoring opportunities in relation to the overall mission and philosophy of the Department. It
is important to instill youth with a sense of responsibility to the community. National research
demonstrates that mentoring relationships are one of the best ways to accomplish this goal.
People from the community help to provide positive connections for youth by teaching them new
skills and/or offering advice from experiences on job seeking and employment opportunities.
Habitat for Humanity seeks to provide affordable housing in partnership with those who lack
adequate housing. Prospective homeowner families are chosen according to their needs and
willingness to work in partnership with Habitat. The result is a more stabilized family and a
strong community connection. Young offenders involved in the program gain fulfillment from
completing the project as well as directly assisting a needy family.
Habitat for Humanity projects collaborate with Juvenile Community Justice to provide the
following:
1. Building a Sense of Community - Being part of a family, community and
working to make life better for others.
2. Uniqueness - Developing a special sense of self and recognizing uniqueness is
important to self-esteem. A young person may be unique in appearance, talents,
vocational interests, hobbies, or other interests.
3. Taking Responsibility - Having resources, opportunities and skills to take
charge of ones life enhances accountability. Young people are empowered
when they learn to make decisions, set personal goals, solve problems and teach
others.
4. Models - Positive role models serve as examples to help young people establish
values, goals, ideals and personal standards and provide guidelines for personal
behavior.
Deschutes County Juvenile Dept. Findings in Support of Exemption from Competive Bidding
Juvenile Department staff considers Habitat's business model of providing low ifleefflelow-
income housing in collaboration with training and mentorship of at -risk youth very unique. No
other organization has such a proven record of success. Contracting with Habitat will have no
adverse affect on competition and is not based upon favoritism.
2. Substantial Promotion of the Public Interest
a. Most Capable Contractor
The Habitat for Humanity model is the only model in the area that meets our goal of pairing
mentoring with tangible, skill -centered learning opportunities, crucial for the at -risk population
we serve. There are three other Habitat for Humanity agencies in the region, however the
Bend Area Habitat for Humanity is the most capable provider of service -centered mentoring
relationships in this fashion because of its infrastructure, building up to five homes per year,
whereas the other agencies build at slower paces, thereby reducing year-round or continual
opportunities, which is preferred. We strongly believe that Bend Area Habitat for Humanity
will continue to have positive impact on our youth and community participating in the
program.
b. Pricing
Currently, the Juvenile Community Justice Department pays $16,000 per year for a minimum
of 2,500 mentored hours annually on Habitat for Humanity project work sites to at -risk youth
of Deschutes County.
C. no practical advantage to traditional procurement methods
A contract which combines proven methods of providing youth mentoring coupled with
facilitating the construction of low income housing, using volunteer labor that can learn from
skilled adults, does not lend itself to traditional competitive bidding. What the County is
seeking and has historically achieved is not a particular product, but rather a series of
intangible goals. The special procurement process, including notice to the public, is designed
to allow for any challenges to this conclusion.
D. RECOMMENDATION
Adopt a resolution granting a contract -specific special procurement authorizing the Juvenile
Community Justice Department to enter into a contract with Bend Area Habitat for Humanity for
youth mentorship services and the development of low income housing.
