DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, JULY 269 2006
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke and Michael M. Daly; Commissioner
Bev Clarno was out of the office. Also present were Dave Kanner, County
Administrator; Scott Johnson, Mental Health Department; Tom Anderson and
Terry Payne, Community Development Department; Legal Counsel Mark Pilliod;
media representative Keith Chu of The Bulletin; and two other citizens.
Chair Luke opened the meeting at 10:00 a.m.
1. Before the Board were Adjustments to the Agenda.
Commissioner Luke stated that the Board has been asked to sign two letters;
one thanking Alan Jones for his service on the Deschutes County Planning
Commission, and the other appointing Robert Otteni to complete Mr. Jones'
term through June 30, 2008.
2. Before the Board was Citizen Input.
None was offered.
3. Before the Board was Consideration of Signature of Documents No. 2006-
372 and No. 2006-373, Agreements relating to the Establishment and
Operation of the Deschutes County Family Drug Court.
Dave Kanner explained that the Board expressed concerns at the Monday work
session regarding requirements stated in the grants, so the item was carried over
to this meeting.

One clause required the return of all grant funds, including those already
expended, in the event the grant was not handled as instructed. The other
concern was whether pass-through funds coming from the Federal government
to the State and then to Deschutes County could be used for matching funds.
The agreement is being redrafted to address these concerns. He asked Legal
Counsel to prepare an order that would allow County Administrator signature of
all documents relating to the establishment and operation of the Drug Court
program.
Mark Pilliod pointed out that these are fairly routine agreements and well
within the signing authority of the County Administrator.
Scott Johnson stated that there is an additional half FTE not included in the
budget; the cost would be covered by the Byrne grant. Court will begin on
August 7, and all should be in place by then.

4. Before the Board was a Public Hearing and Consideration of First and
Second Readings and Adoption, by Emergency, of Ordinance No. 2006-024,
Amending Title 14 to Allow for a Fee Increase for Private Property Claims.
Tom Anderson explained that Community Development is fee supported, and it
has been determined that the fee being collected for Measure 37 cases is not
adequate to pay for associated costs, especially since most of the expenses are
incurred at the beginning of the claim. He is asking that the fee be raised so
these claims are not subsidized by other long-range planning fees. There have
been 81 claims, and 71 claimants have paid the fee. Also, other government
entities are charging more for their Measure 37 claim processing.
Chair Luke opened the public hearing at this time. Being no testimony offered,
he closed the hearing.

8. ADDITION TO THE AGENDA
Terri Payne said that interviews were conducted yesterday regarding the
recently vacated Planning Commission position, and the group unanimously
selected Robert Otteni. It took two attempts to get someone from South County
to apply. Both candidates were very qualified, but Mr. Otteni has lived in the
area much longer.
DALY: Move approval of the appointment of Mr. Otteni to the Deschutes
County Planning Commission, through June 30, 2008.
LUKE: Second.
VOTE: DALY: Yes.

Being no further items to come before the Board, Chair Luke adjourned the
meeting at 10:25 a. m.
