2006-806-Order No. 2006-129 Recorded 8/9/2006DESCHUTES COUNTY OFFICIAL RECORDS C, 7046'846 NANCY BLANKENSHIP, COUNTY CLERK COMMISSIONERS' REVIEWED LE AL COUNSEL 08,09,2006 01:30:40 PM For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Approving Ballot Title and Requiring County Clerk to Include on Ballot the Proposed Boundaries for City of La Pine * ORDER NO. 2006-129 WHEREAS, on August 7, 2006, the Deschutes County Board of Commissioners ("Board") approved Order 2006-128 which approved the petition for the incorporation of the City of La Pine and set the election date relating to the incorporation of the proposed city, and WHEREAS, ORS 221.040(3)(b) requires the County Clerk to include on the ballot a description of the boundaries of the proposed city using streets and other generally recognized features, and WHEREAS, an order is necessary to state that the Board intended such a requirement when the Board, in Section 8 of Order 2006-128, required Legal Counsel to draft that description and, in Section 10 of Order 2006-128 required the County Clerk to place the approved ballot title on the November 7, 2006 general election ballot, and WHEREAS, the Board must also approve the ballot title for the County measure; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. No later than August 9, 2006, the Notice of County Measure Election, in substantially the form in Exhibit A and the area Map in Exhibit B, attached and incorporated by reference, shall be submitted to the Deschutes County Clerk who shall cause the Map in Exhibit "B" to be included with the ballot for the election. Section 2. The County Clerk shall include on the November 7, 2006 general election ballot relating to the incorporation of the proposed City of La Pine the description of the boundaries of the proposed City of La Pine using streets and other generally recognized features as prepared by County Legal Counsel. (Name of County) The following shall be the ballot title of the measure to be submitted to the district's vo ters on this date: CAPTION (10 Words) Incorporate City of La Pine and Establish Permanent Rate Limit QUESTION (20 Words) Shall City of La Pine incorporate with permanent tax rate limited to $1.98 per $1000 assessed value beginning 2007-2008? SUMMARY (175 Words) Creates new City of La Pine. City will initially operate under state statutes and Deschutes County land use regulations and be governed by a five-member council elected at this election. City council will adopt a City budget and may subsequently adopt home rule charter. City may levy property taxes up to $1.98 per $1000 assessed valuation beginning in 2007-2008. Petitioners' economic feasibility study concluded that this rate would generate operating tax revenues sufficient to support an adequate level of municipal services. County does not decide adequacy. The existing sewer and the water special districts located almost entirely within the boundary are likely to be dissolved with the City taking over those services. All other special districts will initially continue to exist and provide services to the City. City council may withdraw from any or all of these districts and provide the services. Most road maintenance, building code administration, a portion of land use planning and zoning and sewer and water would be paid for by other sources, such as user fees or state-shared revenues. Signature of authorized county official (not required to be notarized) Date signed Printed name of authorized county official Title Exhibit A - ORDER 2006-129(08/09/06) Page 1 of 2 INCORPORATE CITY OF LA PINE AND ESTABLISH PERMANENT RATE LIMIT General Description of Boundary: A tract of land in southern Deschutes County, Oregon generally located between the north end of Wickiup Junction and the south end of the La Pine Urban Unincorporated Community south of Finley Butte, and east of Pengrast and Huntington roads, but west of the eastern property line of the Pioneer Cemetery on Reed Road, as more particularly described below: Northern Boundary: A straight line extending from the northeast section corner of Tax Lot 21103 60000 100 that lies east of Drafter Road, then traveling west to west side of the right-of- way ("ROW") of Huntington Road. Western Boundary: From the northwest corner at Huntington Road, follow Huntington Road southwest to the northern property line of Tax Lot 21103513000200, then following the north and west property lines of that tax lot to the east ROW of Burgess Road. Follow Burgess Road west, across the Little Deschutes River to the west property line of Roslyn Park, Tax Lot 2210000001002, then south to the southern property line of Tax Lot 2210000001002, which aligns with Willow Lane. Follow east along the. property line and Willow Lane until the west edge of the Huntington Road ROW. Then, follow Huntington Road until approximately one-half of the distance of the Crescent Creek neighborhood, then follow southwest in a stair step fashion along the newly created property lines of property formerly owned by the USA. At a point approximately even with Victory Way and approximately one-half mile west of Huntington Road. Then follow Jackpine Road to the beginning of Pengrast Road. Then south along Pengrast Road until 6"' Street. Then west on 6`" Street until the northeast corner of Tax Lot 221015DAO1100. Then south, across Highway 97 to the southwest corner of Tax Lot 2210000002802. Southern Boundary: From the southwest corner of Tax Lot 2210000002802, follow a straight line east along the southern boundary of the La Pine Urban Unincorporated to the southeast corner of Tax Lot 2210130001100 at Darlene Way. Then follow the section line north, just east of Russell Road until Reed Road, then east in a straight line to the southeast corner of the old pioneer cemetery. Eastern Boundary: From the southeast corner of the old pioneer cemetery, follow the property line to the northeast corner then turn west to the northwest corner of the old pioneer cemetery. From there, through the federal land, follow a straight line north for approximately a mile, then a straightline west for approximately one-half mile, then follow a straightline north along the section line to the northeast corner of the boundary.
