Luke, Bev Clarno and Michael M. Daly. Also present were County Administrator Dave Kanner; Teresa Rozic and Susan Ross, Commissioners' Office; Joe Studer, County Forester; Mark Pilliod, Legal Counsel; and media representatives Ryan Straub of News Channel 21 and Keith Chu of The Bulletin.. No other citizens were present. The meeting began at 1: 30 p. m. 1. Update on Community Fire Plans. Joe Stutler provided an extensive update on the status of community f ire plans. He stated that the Redmond area still needs to be addressed; he anticipates this will happen by this fall, and the rest of the County will be addressed by mid- 2007. The process is going well. He stated that grants in the amount of $175,000 have been received, and require Board approval. These grants will be placed on the next Board agenda. 2. Discussion of a Proposal for a "Federal Summit". Dave Kanner said that Commissioner Clarno has proposed bringing in federal human services representatives to meet with local human services providers, possibly in October. Deschutes County would provide meeting space if appropriate, and would host dinner. Commissioner Daly suggested that Jefferson and Crook counties should be involved as well. Dave Kanner stated that a letter was received from a citizen who maintains there is a problem with the use of all terrain vehicles on County-owned land, which is reportedly causing damage to the land and is disturbing endangered eagles. A lengthy discussion followed. The Board asked Joe Stutler and Teresa Rozic to visit the property and investigate the claim. 4. Discussion regarding Save our Schools & Communities' Fly-In to Washington, D.C. Mr. Kanner indicated that a letter was received from AOC regarding a proposed fly-in to Washington, D.C. to encourage legislators to reauthorize PL 106-393, National Forest Counties and Schools funding. Commissioner Clarno said that she felt this would not be an appropriate expenditure for the County, since the County already has a lobbyist in Washington, D.C. and has connections to the legislators' offices. Commissioner Luke added that he is not interested in this trip, nor was Commissioner Daly. 5. Property and Project Update. Susan Ross said she has been working on the emergency plan for court security, both long- and short-term. In regard to the former law library location, she has been meeting with Ernie Mazorol of the Courts as well as the Sheriff, and minor changes are needed to make the space useable. 6. Lottery Grant Requests. Deschutes Historical Society Funding: discussion took place regarding the proposal to use funds for marketing. Commissioner Clarno said that the Board of the Society needs to be educated on how to solicit funding from a variety of sources. The Board unanimously authorized $10,000 off the top of the fund, but would like regular reports on the success of their marketing plan. Discussion regarding Commissioner Appointment to Audit Committee. Commissioner Daly stated that the reason he brought up this appointment was that he feels committee memberships should be switched around so all Commissioners are familiar with the group, and not just automatically appointed. Commissioner Luke replied that sometimes it would be hard for another person to get up to speed. Commissioner Clarno said that there should be some qualifications required for various committee memberships, and that if a Commissioner is interested in participating, he or she should attend a few meetings to learn more about the group. The Commissioners unanimously agreed to reappoint Commissioner Luke to the committee. 8. Other Items. A discussion took place regarding payment vouchers. Dave Kanner indicated that he would prefer the originator of the voucher and the department head sign, taking responsibility for the payment and that it is budgeted. He has instituted a cover sheet for contracts and similar binding documents; Mark Pilliod is finalizing it. It will require the department head to sign off as well. He added that many documents currently coming before the Board could legally be signed by the County Administrator or the department head. Mark Pilliod stated that he feels intergovernmental agreements should be signed by the Board if they are above a certain dollar amount. Mr. Kanner added that the Board could specifically delegate signature authority as well. Commissioner Luke asked that a memo be drafted explaining to the Board how this change would work. The Commissioners indicated thank you letters should be sent out to those individuals and groups that did crowd control at the Tucker memorial service. A list will be obtained and letters drafted. Minutes of Administrative Liaison Wednesday, July 5, 2006 Page 3 of 4 Pages Dave Kanner said that he received a letter from the Surveyor, Mike Berry, regarding the recent increase in the plat review fee. Mr. Berry indicated that the private surveyors were not aware of the increase, and he would like to waive a month's increase in the fee for them. After a brief discussion, it was decided that it is not appropriate for him to make this decision. In regard to the unpaid day off (July 3), the Commissioners are to be docked eight hours' pay, the same as other employees. Commissioner Luke brought up the question of how things should be handled that need an immediate discussion in emergency situations. He felt it was appropriate for Commissioners to be contacted individually. Mr. Kanner stated that information needs to be consistent in all cases. Dave Kanner said that he would like input from the Board as to the goals and expectations the Board has of him. Commissioner Clarno indicated that she feels Mr. Kanner should have control of most aspects of his position by the end of the year. Being no further discussion, the meeting adjourned at 3: 30 p. m. Upper Deschutes Coalition 2. Sunriver 3. Greater Sisters 4. Greater La Pine 5. Greater Bend In addition we have successfully updated the Greater Sisters CWPP (May 2006) and began the process for completing the CWPP for Greater Redmond with a target date of November 2006 (Additionally we met with the Upper Deschutes Coalition and will begin the process of updating that CWPP which will be an ongoing effort for the next few months, particularly since there is new leadership directing the Coalition's efforts. Of particular note is we are now spending National Fire Plan dollars due to a $75,000 grant we received and will utilize those dollars to complete the above identified tasks and complete the overall CWPP for Deschutes County. I have agreements for signature today for those grants. I believe it is important to identify vacant lots issues in the CWPP as most others have, it was the language used directing the County and State to accomplish some things that is of some concern to us. I'm certain we can work this out with a meeting that we can have facilitated by Katie Lighthall from Project Wildfire, and as I mentioned we can have the CWPP updated, signed off by the appropriate signatory agencies and distributed to folks at no expense (monetary) from the Coalition. We received two grants that will address those fiscal issues. Look forward to hearing from you and toward the end of next week and most of the following week are good time for me to meet. Katie can coordinate dates, times, attendees etc. for our next step. I would recommend that we seriously consider proceeding with an e-mail with wording similar to this "DRAFT". It would appear that Joe Stutter is willing to move forward and work with us. We can discuss this subject further on Friday at Carl's office. Joe - In my opinion, the vacant lot information should be left in our CWPP based on the obvious problem with vacant lots in our neighborhoods. If not in our UDRNR Coalition CWPP, wouldn't it be prudent for Deschutes County in their CWPP to take an assertive and highly visible position on this sensitive subject? We could wait until the forthcoming changes to SB-360 are completed and approved or we could take the position that we need to do something now. With the 2006 fire season on us now, unless the revised SB-360 is approved within the next 30- days, we remain status quo with nothing in place that specifically addresses the fuel reduction problem on vacant lots. The intent of the UDRNR Coalition to include this in our CWPP was not to circumvent the County's CWPP or pre-empt the forthcoming revised SB-360 but to give our fifteen Coalition neighborhoods, representing over 5,000 property owners, something to work with to strengthen our position with the vacant lot owners. Our intent is not to appear impatient, but we are! Now that new officers preside over the Coalition I know that those of us that are signatory as per the Healthy Forest Restoration Act (Fire Department, State Forestry and Deschutes County) want very much to work in a collaborative fashion (as per the legislation) to keep the CWPP updated and monitor success and assist with the efforts of the neighborhoods. file://CADocuments and Settings\Joest.ADMfN\My Documents\Community Fire Plans\Upp... 7/5/2006 Page 4 of 6 I have closely reviewed the "last draft" (September 2005) prepared by Jim King and although much improved from the "officially approved" CWPP (July 2004) there are issues that remain in that "draft" we must discuss and reach common ground in order to update and have plan approval both by the agencies and of course the neighborhoods. There are two specific areas of concern for Deschutes County: 1. The County is directed by the "draft" to accomplish specific tasks for a County wide ordinance for vacant lots and we can not accept that direction nor do we feel it is appropriate for the entire county to be driven by one CWPP, or which may be in conflict with SB-360, specifically the new language forthcoming. 2. The "danger" for the neighborhoods within the coalition is way over stated. The neighborhoods are referred to as being in a "crisis" situation several times in the document and from the perspective of fire behavior, fuels management and threat to life, property and public safety, we will not accept that description. Yes, there are WUI issues and yes there are some areas that, need treatment both on public lands and private lands and collectively there has been much progress by private landowners and agencies that has gone unrecognized in this context of risk. The reality is this, there are four agencies (La Pine Fire, ODF, FS and BLM) with wildland and structural responsibility for the Coalition neighborhoods and that protection capability is "world class" and connected to a state and federal mutual aid response that is second to none. We must recognize the work people are currently doing, plan to do and our collective protection capability by the fire departments and other 1st responders (law enforcement) and dispense with the "scare tactic rhetoric" in the CWPP. I offer up Project Wildfire (Katie Lighthall) as the facilitator of this process and will even produce the next draft and final product including maps of the revised CWPP, at no cost to the Coalition. So yes we are ready to move forward with the revision of the CWPP and will gladly work with the new leadership to do so. Katie can coordinate/facilitate the meeting time and date and people who need to be involved with the revision. My home and property are in Crestridge Estates subdivision between Cline Falls and Tetherow Crossing on the west side of the Deschutes River (Block 4, Lot 17). The county owned land provides a nice and necessary buffer between residential use and the Deschutes .River. Since we built our house adjacent to the county property in 2001 (moving from our previous house in the interior of Crestridge) there has been frequent ATV use and vehicle use on the county land. The majority of use comes from no more than a half dozen houses within and outside of Crestridge Estates. The Crestridge Homeowners Association has encouraged me to seek support in closing the area for vehicles due to concerns about fire and firearms. First of all I applaud the county for acquiring about nine parcels of land along the Deschutes River. This was done in 1996 by Order No. 96-071 which designates the purpose of the land for County Parks, for the enhancement of wildlife habitat and public access." Over 90% of wildlife species in the Great Basin depend on riparian areas for either feeding, nesting or hiding cover. There is an active golden eagle nest on the west rim of the canyon along this stretch of the river. You do not have to look far to find houses and businesses built over the canyon rim and or adjacent to the riverbank. I believe the Deschutes River is a public resource and should be accessible to the general public and land use laws should protect it's resource values. As associate planner for Deschutes County in the 1970's, my support for recognition of and protection of these resource values was not politically supported. I am very please that these concerns are shared by a larger and more diverse local population today. Recreational ATV use is destructive to native plants, soils and often results in wildlife harassment. The disturbed soil is conducive to invasive plants such as cheat grass, knapweed and Russian thistle. The ruts themselves stay visible for years in this desert environment. I do not understand how people can tear up someone else's property but they do. I believe this distracts from other, less intrusive uses of the property for public enjoyment. I contacted the county property manager about closing the area to ATVs (Tammy Credicott) on two occasions a couple of years ago. While she was sympathetic to the nature of my concern, she said she was too busy to prepare and present a resolution to you that would close the area to ATV's. While I believe you should adopt such a resolution for all of the county owned lands, I sincerely request you take such an action tT ~ Z c~ I ~v U v7~o ~~i ~l LO 00 /O V 12 F, Y14- on the property shown on the attached map that borders Crestridge Estates subdivision. This property will grow in importance to the general public as growth continues in the Redmond area and as flows in the Middle Deschutes are enhanced and the fishery improves. The Bureau of Land Management adjoins the county property on the north (and they just acquired the riverfront property adjacent to and north of Cline Falls State Park property). This winter I met with Greg Currie of the BLM Prineville office and Chris Carrie of ODFW to walk the county and BLM property. As a result, Greg plans to construct a fence along the north edge of their property to restrict vehicles from entering the area. In addition, a sign will be placed explaining the resource reasons for closing this area to vehicle use. I am asking that you support closure of the county land in support of the BLM closure for the reasons noted above. There are, at this moment, two properties within Crestridge who's owners drive directly onto the county property without having to traverse the BLM land. If you decide to take this action, a letter notifying residents of the closure to the properties adjacent to your lands would be appropriate. I regret that it is necessary to have to tell people they can't tear up your land vs. telling them that an area is available for this type of use but it appears necessary. Lastly, I believe your support for the interpretive sign (by agreeing to review the text and allowing Deschutes County to be added as a supporter of the closure) would show solidarity for the protection of this small area for wildlife and recreational values. Many people access the area from both Tetherow Crossing and Cline Falls for hiking, geo- caching and fishing. If you take action to close the area to ATV use, I will be asking ODFW to endorse the closure by agreeing to allow their department's name to appear on the interpretive sign also. The National Forest Counties and Schools Coalition will host the Save our Schools and Communities Washington, D.C., Fl yIn on September 13th & 14th. They have called for at least 150 participants. Given the stake we in Oregon have in reauthorization, we will need to have at least 30 Oregonians there. Registration is free, but participants must pay for lodging, travel, and meals. After years of work and commitment to gain reauthorization of this critical program, this will be our final 2006 hands-on, shoe-leather show of force and urgency. Congress must not walk away from their century- long obligation to rural schools and counties in our federal forest communities. The Secure Rural Schools and Community Self- Determination Act has been enormously successful in all respects. Without it, rural communities will be devastated. Oregon counties must make this critical investment in full reauthorization by participation in the Fly-In. The Coalition has reserved blocks of rooms for participants at a Holiday Inn. (until 7-14) and a Marriott (until 8-24). Costs are paid by participants or sponsors.
