WEDNESDAY, FEBRUARY 8, 2006
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St.., Bend
Present were Commissioners Dennis R. Luke, Bev Clarno and Michael M. Daly.
Also present was Mike Maier, County Administrator; Teresa Rozic and Anna
Johnson, Commissioner's Office; Tom Anderson, Community Development
Department; Mark Pilliod, Legal Counsel; and media representatives Chris
Barker of The Bulletin and Barney Lerten of News Channel 21. Present for a
portion of the meeting were Elaine Knobbs and Bob Smit, KIDS Center. Eleven
other citizens were present.
Chair Dennis Luke opened the meeting at 10:00 a.m.
1. CITIZEN INPUT
LUKE:
I received one phone call and now an email from people in the Tumalo area.
Evidentially, from what I gather, there is a private individual who sent out
meeting notices on a proposed destination resort. But we don't have an
application. Have planners worked with anybody out there at all?
TOM ANDERSON:
Tom Anderson, from Community Development. Near as I can gather, it was a
notice that was sent out just the day of or the day before our last Planning
Commission Meeting. It was vague, clearly was not a County notice and it was
a half sheet piece of paper. It made reference to a potential destination resort on
the irrigation district property there. I think the point of the notice was to get

people to come to the Planning Commission Meeting and speak to the
destination resort overlay zone remapping. It was sent out the day before so
most people got it the day of the hearing. We got several calls from people who
were upset, thinking it was a County notice, and angry with the County for not
having enough time to put it on their calendars.
LUKE:
But we don't have an application or pre-application?
ANDERSON:
No.
DALY:
I heard Elmer McDaniels on the radio this morning coming to work.
Apparently, they are requesting that their property be mapped for destination
resort in that process that the Planning Commission is going through now.
That's their only request.
ANDERSON:
That has been an ongoing process that lots of people have attended and spoken
to one way or the other. The Planning Commission, hopefully, will make a
recommendation to this Board at their meeting tomorrow night on a position,
one way or the other.
2. A PRESENTATION of the "Darkness to Light" Child Sexual Abuse
Prevention Program - Elaine Knobbs, KIDS Center
LUKE:
We have a presentation on "Darkness to Light."
ELAINE KNOBBS:
Good morning, I am Elaine Knobbs and I am with the KIDS Center. I am the
Director of Prevention and Regional Services. I thank you for letting me come
this morning and talk to you about a very new vitally important program that
the KIDS Center and a group of Tri-County Partners are implementing
throughout Central Oregon called "Darkness to Light."

Who did you bring with you?
KNOBBS:
The Director of the KIDS Center, Bob Smit. I just brought him for his beautiful
smile, so he can just sit back there.
I put information in front of all of you about the "Darkness to Light" program.
I have additional information for the audience if anyone wants to pick up a
"Darkness to Light" flyer (See attached marked as Exhibit A) and a "Seven
Steps to Protecting Our Children" brochure (See attached marked as Exhibit B.)
They are sitting over here on my right.
This week I had the opportunity to speak to the Local Public Safety
Coordinating Council (LPSCC) and Commissioner Clarno was there. I thank
you for letting me speak and informing all the Commissioners of this program.
To start out with, research shows that one in four girls and one in six boys will
be sexually abused by the time they are eighteen. One in four girls and one in
six boys. That means in any classroom, if it is a classroom of twenty or a
classroom of thirty, there will be several children who will be sexually abused.
We want to step up and protect our children from being sexually abused. This
"Darkness to Light" program is focused on shifting the responsibility of
protecting children, from children, to adults. We all, as adults, look out for the
safety of our children when they cross the street or there is a downed power line
and we have a lens of safety. We want to make sure that we also, as adults, take
on the responsibility for protecting them from child sexual abuse.
This program "Darkness to Light" is focused on adult responsibility and
community interaction. Meaning that we, as a community, step up and actually
say this is a problem, this is an epidemic that we are concerned about and we
are going to protect our children. What we are doing with the "Darkness to
Light" program is actually using an evidence based curriculum which is a three
hour training program that teaches adults, any citizen out there, to prevent,
recognize, and react responsibly to child sexual abuse.
The reason I am emphasizing that this training is evidenced based is because it
has been proven, for every one adult trained, that ten children are better
protected. That is one adult trained and ten children are better protected. We at

the KIDS Center and our Tri-County Partners have a goal within two years to
train 5% of the adult population. In Deschutes County that is about 5,000
adults in a two year time period. The reason we have chosen 5% or 5,000
adults in Deschutes County is, if you times that by 10, that is approximately all
the children we have in Deschutes County. We want to say we as a community
have stepped up and are protecting all of our children in our community. Our
Tri-County Partners, I want to highlight, we have nine Tri-County Partners, all
of the Health Departments in the three counties, all of the Juvenile
Departments, the DA's Office in Jefferson County and also COBRA and the
KIDS Center.
LUKE:
We know what COBRA is but you might let the audience know.
KNOBBS:
The Central Oregon Battering and Rape Alliance (COBRA) which is actually in
all three counties. In Deschutes County COBRA has a facilitator trained, in
Crook County and also in Jefferson County. In Deschutes County we have two
facilitators of this training program from the Health Department, two from the
Juvenile Department, four from the KIDS Center, and one again from COBRA.
I am saying all this to show you that it is really a Tri-County Partnership that is
implementing this program.
The flyer that you all have in front of you and people can pick up over on my
right, has all these open trainings that anyone can come to listed on the back.
We are also doing it for specific groups. We have also trained twenty CASA
volunteers, eighteen FAN advocates, many child care providers, Health
Department staff, and Park & Rec staff. We are already talking to law
enforcement agencies, churches and other specific agencies that we partner with
in the child abuse and social service arena. People are stepping up and saying
no matter what field we work on and in, it is all our responsibility as adults to
protect children.
In order to get involved in "Darkness to Light", any citizen can sign up for one
of these open trainings or can contact us to train a specific group. We look
forward to holding some training, maybe even in this room, for County
employees. We are doing them specifically for the Health Department and the
Juvenile Department but we would like to open them up for any County
employees to come in and attend the training.

For more information people can look at our Web site; KIDS Center.info or
they can call 383-5958 and ask for me, Elaine Knobbs, or just talk to anyone
about the "Darkness to Light" program. You can call the Juvenile Department,
you can call the Health Department, you can call COBRA, but we are the main
coordinators of this.
LUKE:
Don't you have an open house or something coming up out at the KIDS Center
on this?
KNOBBS:
We did actually, last Tuesday. We partnered with the Deschutes Public Library
to have, really, a kick off event. That was that snowy night on Tuesday night,
where the Library actually wanted to shut down at 6:00 and our even was at
6:00. We had 70 people show up for the event, even on the snowy night.
CLARNO:
Elaine, I just want to say you did a wonderful presentation the other day. She
had a video as well, which time does not allow today but it is an excellent
presentation. I looked on the back and I am going to sign up Monday, April
23rd for the training. I can't imagine as an adult that I can protect any children
but if I can I will give it a try.
LUKE:
Commissioner Daly can attest that there are groups of contractors who actually
stop and have coffee in the morning before they go out and work hard. There
were ten or eleven people who would show up and one of them said he heard
something that was very hard to believe. He said that one out of ten adults'
abuses a child and he felt that very hard to believe. He said that would mean
that one person here, sitting here at this table, abuses a child. About two weeks
later they indicted Leonard Gray who was abusing his step daughters and he
was sitting at that table. So, sometimes it comes home.
KNOBBS:
Yes, and an important part that I didn't mention, as you said 90% of the cases
of children being abused, they are being abused by someone they know, over
90%. We actually only catch about 3% so that's why it is even more important
for us to talk about it and being informed about this problem.

LUKE:
The County does help the KIDS Center. How do you get your money?
KNOBBS:
We definitely appreciate the Board of County Commissioners contributing
money to the KIDS Center every year.
LUKE:
The majority of your budget comes from something else.
KNOBBS:
The majority comes from donations, about a third. A third comes from grants
and a third comes from local public agencies, such as yours, contributing. We
also appreciate the Board contributing some money for us to coordinate a child
abuse systems study last year which turned up gaps in our system. A major gap
was any training around child sexual abuse was not going on in our community.
LUKE:
A lot of people have forgotten how your campus was built by the Rotary Club
here in Bend. I think it was $700,000.00. Rotary raised all the money and
community people got together and build those buildings. That was amazing to
watch.
KNOBBS:
Right, that was around eleven years ago and we still have some of the founding
board members that actually nailed all the nails in the KIDS Center. That is
why they are still with us because they know how many kids they are helping
by having raised that money and built the building. They always say that when
they started that helping fifty kids would be enough and this year we will
probably see about 700. All of the contributions go a long way.
LUKE:

3. A HEARING on File No. M37-05-64, Order No. 2006-011 (Applicant:
Mitchell) - Tom Anderson, Community Development; Mark Pilliod, Legal
Counsel
Commissioner Luke read the Measure 37 opening statement (See Attached
marked as Exhibit C.).
LUKE:
We are hearing two claims today; we are hearing Mitchell and Shaw. Does
anyone wish to challenge the Commissioners ability to hear either one of these
matters? If so, please do so now. Hearing no challenges, we will proceed.
No Commissioners expressed bias, personal interest or prejudgment on this
issue, and there were no challenges as to bias, personal interest or prejudgment
from the public.
TOM ANDERSON:
Tom Anderson, from Community Development. Both claims before you this
morning are in the Terrebonne area. The first one was filed by Chester and
June Mitchell on a piece of property located at 1784 Ice Avenue, which is near
the intersection of Ice and 18th. The property is approximately 10 acres in size,
it is zoned EFU, and the claimant would like to partition the property into two 5
acre parcels. The actual size then, of the property, would be important in that
particular claim to allow that partition and I will come back to that in a minute.
The property was acquired outright by Mr. and Mrs. Mitchell in March of 1973.
The amount of the claim is $200,000.00. In 1973 PL2 and 5 were in effect.
Depending on the zoning there, there was likely a 5 acre minimum lot size at
that time. So they would have to have a full 10 acres in order to achieve that
partition to have two parcels with a minimum of 5 acres. This is similar to the
Mealin claim that you heard last year.
LUKE:
We have two maps, is the property the piece surrounded by the really dark
dotted line, is that what we are looking at?
ANDERSON:
It is actually in the upper left had corner; it's that rectangular piece of property.

Where it says 20 acres, lot 400?
ANDERSON:
It is lot 600. The 6 acres that you see down below, those are the irrigated acres.
The total property is 10 acres in size. It is that upper left hand long rectangle.
LUKE:
Oh, okay, the upper left hand corner. Okay, go ahead.
ANDERSON:
The only thing I will add is this order before you would establish a review date
from Community Development of March of 1973 to review a land use
application that would be necessary to achieve this partition under the rules that
existed at that time.
DANIELLE STROM:
Danielle Strom for the applicant, submitting the GIS report as well as an area
photo gleaned from the County Lava System.
LUKE:
You are representing the applicant? Are you an attorney?
STROM:
I am an attorney, yes.
LUKE:
What firm are you with and did you give an address.
STROM:
Land use consulting. Address is 1382 NW 18th Street, Bend, OR, 97701.
LUKE:
You have a problem with the report? Typically, the attorney either has a
problem with the report or they say we like the report and wish you would pass
it.
STROM:
To be honest, I did not receive a copy of it.

Did you disagree with anything today, he read most of it.
STROM:
No, not so far sir.
LUKE:
The biggest part of the report is 1973 and that they have owned it continuously
since 1973. That is pretty much what the report is.
STROM:
Right, which is fine because we are not asking for anything that requires
anything before that, the A 1 zoning was fine.
DALY:
The property is this piece here. Is that just 6 acres?
STROM:
It is about 9 and a half acres and I think County Counsel alluded to the fact that
it would have to be the fall 5 acres. What we would rely upon is County
practice to use gross acreage in deciding whether or not there is adequate
acreage for a partition. So one would take, basically, to the center line of the
roads that abut and that would add our additional acreage to make up the full 10
acres.
DALY:
So, you want to split that in two, right.
STROM:
Correct.
LUKE:
I am going recess this one for a little bit. Why don't you take a look at this and
then we will open this one back up. Is there anyone who would like to testify in
opposition to this claim? Okay, then we will recess this one for a little bit and
give her the opportunity to read that and we will go on to the Shaw one.

We are going to reopen, go back to the Mitchell claim, if council will let us
know how they feel about the reports.
STROM:
Again, Danielle Strom for the applicant. The applicant agrees with the staff
report and the applicant wanted me to mention that the titled acreage actually
does exceed the 10 acres.
PILLIOD:
The Board is not in a position right now, nor is the staff, to provide a precise
calculation of the acreage. That will be decided through the development
process. I just want to make clear that by approving the claim at this point, you
are not assuring the development of an additional lot.
LUKE:
Again, is there anyone who is opposed to this? (No response)

4. A HEARING on File No. M37-05-66, Order No. 2006-012 (Applicant: Shaw)
- Tom Anderson, Community Development; Mark Pilliod, Legal Counsel
ANDERSON:
Commissioners, again, this property is also in the Terrebonne area. This claim
was filed by Nathan and Mavis Shaw. The property is located at 8330 NE First
Street. It is just east of the central part of Terrebonne at First and Smith Rock
Way. It is a 27 acre piece of EFU property. The claimant would like to
subdivide the property into 4 parcels, approximately three at 5 acres and one at
10. The property was acquired by Mr. and Mrs. Shaw outright in July of 1978
and the amount of the claim is $291,000.00.

This is, basically, one of those claims that falls in between the adoption of the
Statewide Planning System and the recognition of Deschutes County's
Ordinance reflecting that system. So at that time, in 1978, this application may
or may not have been approved. The key in this claim will be the claimant
receiving a State waiver that will allow them to proceed.
LUKE:
That does not affect our decision?
ANDERSON:
That does not affect your decision. The order before you basically establishes a
review date for CDD staff for the County of July of 1978. However, as part of
the land use application that would come with this, a waiver from the State
would be part of the review materials that would go into that application.
LUKE:
Okay, anything else? Does anyone want to speak in favor of this?
DENNIS CLARK:
I am Dennis Clark, 16090 South Alfalfa Road, Powell Butte.
LUKE:
It says you are a representative.
CLARK:
Representing the Shaw's, yes.
LUKE:
Have you read the report, do you have a problem with the report?
CLARK:
We could not get a copy of the report from the County yesterday.
LUKE:
Why are they not getting the reports?
ANDERSON:
We typically do not send the report; we send notice of this hearing. The reports
are available on our Web site for anybody to access and look out.

For the record, the Board has approved the Shaw application and the Mitchell

I understand that Laurie assisted in preparing this petition, frankly, I have not
read it.
MIKE MAIER:
This is the law enforcement district?
LUKE:
No, it is the fire.
MAIER:
Okay, it is not the Service District, it is the fire district.
LUKE:
No, it is actually the Black Butte Ranch County Service District annexed
property to the Black Butte.
MAIER:
I thought that the Public Safety District included the entire ranch.
LUKE:
It says the territory for this petition for annexation is primarily uninhabited and
Black Butte owns the property. So, Black Butte is annexing some of their own
property into the Service District. A few years ago we had that old cinder pit
and we closed that. That belonged to Black Butte and they may be bringing
that in.
MAIER:
I don't have a problem with that. Is there any value to it?
LUKE:
They want their cops to be able to go in there and protect it, I guess. It is their
property. They are actually asking to annex property that belongs to the Black
Butte Homeowners Association.
DALY:
It is just a little chunk up here in the upper corner, apparently.

I believe you closed the hearing and we issued a final argument and that was it.
LUKE:
Tom, work with him and take care of it. The only thing I asked for was a copy
of the Forest Plan for how to manage the trees and the brush. I have gotten that
and I am not sure we set a date. Tom will work with you; let us know too if you
find out.
Being no further items coming before the Board, Chair Luke adjourned the

Adults Resolving Child Sexual Abuse in Community
A child's safety is an adult's job. Children are often taught how to keep
themselves safe from sexual abuse-and that's important for them to
learn-but that's no substitute for adult responsibility.
We make sure our children wear seat belts. We walk them across busy
streets. We store toxic household cleaners out of reach. Why, then, would
we leave the job of preventing child sexual abuse solely on children?
Darkness to Light Training for Adults
KIDS Center, in conjunction with a coalition of tri-county partners,
is spearheading a revolutionary sexual abuse prevention training and
outreach program in Central Oregon. This national research-based
program, called Darkness to Light, educates adults to prevent, recognize,
and react responsibly to child sexual abuse.
Sixteen trained facilitators from across Central Oregon are available to
conduct 3-hour Darkness to Light trainings throughout Crook, Deschutes
and Jefferson counties.
18th birthdays. The greatest risk to our
children doesn't come from strangers
but from our friends and family-93%
of all victims know their abusers.
The 3-hour interactive training program is motivational and compelling.
It calls participants into personal responsibility for the safety of children,
while at the same time appreciates their fears and concerns.
The training program is appropriate not only to systems that serve children
directly, but also to individuals and businesses that want to respond to the
epidemic nature of the problem and its impact at all levels of society.

to preventing, recognizing
and reacting responsibly to
child sexual abuse
Step 1. Learn the facts. Understand the risks.
Realities-not trust-should influence your decisions regarding your child.
Step 2. Minimize opportunity.
If you eliminate or reduce one-adult/one-child situations, you'll
dramatically lower the risk of sexual abuse for your child.
Step 3. Talk about it.
Children often keep abuse a secret, but barriers can be broken down
by talking openly about it.
Step 4. Stay alert.
Don't expect obvious signs when a child is being sexually abused.
Step 5. Make a plan.
Learn where to go, who to call and how to react.
Step 6. Act on suspicions.
The future well-being of a child is at stake.
Step 7. Get involved.
Volunteer and financially support organizations that
fight the tragedy of child sexual abuse.

Measure 37 Hearing Process
The Board of County Commissioners is now ready to open the hearing on a Claim
brought against the County pursuant to Ballot Measure 37.
The hearing before the Board is quasi-judicial, but not a land use decision. This
proceeding is the only hearing provided by the County under the County code
provisions which implement Ballot Measure 37. The Board's decision will be based
upon the material submitted to county staff and furnished to the Board. The County
code provides that the claimant and those persons who have previously submitted
written material to the County on this matter will be given an opportunity to offer
testimony bearing on the claim. This hearing is not open for comments from
members of the general public.
The decision by the County on this matter will be memorialized in a Final Order.
The Final Order will be mailed to all those participating in this proceeding. The
Final Order will also be recorded in the Clerk's Office.
The criteria for this decision involving a claim under Ballot Measure 37 is contained
within Chapter 14.10 of the Code.
The applicable criteria are as follows:
1. The Claimant is the owner of the subject property; and
2. . The Claimant or a family member has owned the subject
property continuously since before adoption or the effective date of a
county land use regulation;
3. The County's land use regulation is not exempt from challenge
under Ballot Measure 37; and
4. The County's land use regulation has caused a reduction in the
value of Claimant's property.
If the Board determines that the criteria for compensation payment pursuant to
Ballot Measure 37 has been established, and the claim is eligible, it may by written
order decide that the county's land use regulation be modified, not applied to the
claimant's property, or it may elect to pay compensation based upon the reduction
in value attributed to the subject regulation.

The County's decision will not result in the issuance of a building permit, but will
only allow the Claimant to apply for a permit without first complying with the
challenged land use regulation. A Claimant must also comply with County
regulations which were not challenged under Measure 37. Furthermore, the
County's decision is not intended as having any effect on land use or other
regulations adopted by other government entities, such as the State of Oregon or
LCDC.
Testimony, arguments and evidence must be directed toward the criteria described
above, or other criteria, which the person believes to apply to the decision. Failure
to raise an issue accompanied by statements or evidence sufficient to afford the
Board and the parties an opportunity to respond to the issue, may preclude judicial
review based on that issue.
The order of presentation is as follows:
1. The County Administrator's report and recommendation.
2. Claimant's presentation.
3. Witnesses who oppose the Claimant's position.
4. Rebuttal by the Claimant.
5. If new information is presented by the Claimant, then rebuttal by the
witness in opposition.
Any person that is interested in this matter may challenge the qualification of any
Commissioner to participate in the hearing and decision. Such challenge must state
facts relied upon by the party to a Commissioner's bias, prejudgment, personal
interest, or other facts from which the party has concluded that the Commissioner
should not participate as they are not impartial. Such challenge must be made prior
to the commencement of the public hearing, and will be incorporated into the record
of this hearing.
