WHEREAS, ORS 271.310 and Deschutes County Code Chapter 11.08 provide that Deschutes County may exchange real property, and WHEREAS, on August 9, 2006, the Board of County Commissioners ('Board") declared its intent to exchange real property with County Road Trade LLC, and WHEREAS, a duly noticed hearing before the Board was held on September 13, 2006 and no objections were filed, and WHEREAS, the Board finds that the exchange of the real property generally described herein in Exchibits "A" and "B", attached hereto and incorporated herein by reference, is in the best interest of Deschutes County; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. That the real property generally described in Exhibit "B" be available to be exchanged by Deschutes County with County Road Trade LLC. Section 2. That upon review and approval of title by the Deschutes County Legal Counsel, the exchange of real properties referenced is hereby authorized in accordance with this Order. Section 3. That the Deschutes County Property & Facilities Director is authorized to take those actions reasonably necessary to implement this Order and shall prepare for Board signature the Deeds in accordance with this Order.
