MINUTES OF ADMINISTRATIVE WORK SESSION
DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, SEPTEMBER 6, 2006
Commissioners' Conference Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke, Bev Clarno and Michael M. Daly.
Also present were County Administrator Dave Kanner; and, for part of the
meeting, Susan Ross and Anna Johnson, Commissioners' Office; Dan Peddycord,
Claudia Wiseman and Jeanie Young of the Health Department; and Mark Amberg,
Legal Counsel. Also present was media representative Keith Chu of The Bulletin.
No other citizens were present. The meeting began at 1: 30 p. m.
1. Communications Update.
Anna Johnson said that the Citizen Update newspaper insert will come out
beginning on September 25.
2. Project and Property Management Update
No items were submitted.
3. Economic Development Grant Requests.
No items were submitted.
4. Discussion of a Proposed County Smoking Policy.
Dan Peddycord stated that many people would like the rules of the Indoor Clean
Air Act followed when it comes to buildings under construction, and around
entrances to buildings.

A fifty-foot perimeter has been suggested. This problem is complaint driven.
He is working with other jurisdictions to learn what they have in place.
Susan Ross said that it would be hard to enforce; Mr. Peddycord replied that
one alternative is to ban smoking on County-owned properties altogether.
Commissioner Luke asked if cessation classes are offered; Jeanie Young replied
that the help line offers patches, but the cost is not covered by insurance.
Commissioner Clarno said that the policy should be the same as that in local
cities.
Mr. Kanner stated there could be a conflict if sidewalks are closer than fifty
feet. He suggested that signs be placed asking smokers not to smoke within a
certain number of feet of the entrance, as a courtesy to others. Ms. Ross
explained that there are cigarette receptacles next to the doors since if they are
not placed there, smokers tend to throw their cigarettes on the ground. She
added that state law requires designated smoking areas.
Ms. Ross was instructed to distribute the smoking policy draft to department
heads and ask for input regarding the range of distances from the doors, etc.,
and for her to report back with her findings.
5. Other Items.
Mr. Peddycord said that he will be attending a joint meeting with the City of
Bend Council tonight, and will be discussing flu pandemic planning.
The group discussed the affordable housing issue and the fact that three to five
mobile home parks will be closed in the near future, and the city is not going to
allow mobile home parks to be developed in the future. They are focusing on
primarily stick-built housing.
Dave Kanner said that the City Council would like the County to participate in
a land swap with the owners of the mobile home parks, so that the City will end
up with land that is ready for development, and the property owners will have
land that may be developed in the future. The Council felt that mobile home
park occupants will leave by attrition.

Commissioner Luke voiced concern about giving up County ownership of land,
and that this proposal does not benefit the County. He said that the County
should not be responsible for relocating these parks and people, or helping the
City since it was their decision to allow these mobile home park residents to be
evicted. Some had been living in the parks for many years, and relocating them
presented a serious hardship. And if the County and City decides to wait until
they relocate by attrition, it could take a long time.
He pointed out that the County has offered the use of County land located next
to the Road Department for a development that would include housing for these
people. The City has been asked to handle the annexation as needed, and
installation of the infrastructure. Commissioner Clarno agreed, stating that the
City needs to step up. Commissioner Daly added that this location could have a
mix of housing, such as mobile homes, places for fifth-wheels and motor homes
for those workers who follow the trades, duplexes and so on, to help a variety of
citizens. The development would have a community meeting hall, parks and
other amenities, and would be professional managed so that it is always
attractive. This was part of the original proposal to the City.
Mr. Kanner advised the Board that he is working on personnel rules and
policies. The administrative staff would write the policies, which would be
forwarded to the department directors for input. The Board would review the
final draft. He pointed out that these rules are administrative, not legislative,
and deal with the internal practices of the organization.
Commissioner Luke said that he feels the process is a problem, such as the
recent meeting meals policy as proposed, which did not have any review of the
Commissioners prior to being presented to the department directors. Mr.
Kanner asked for clarification as to when the Board might want to get involved
at the beginning. Commissioner Clamo said that Mr. Kanner should just do
what he needs to do. Commissioner Daly stated hat there have been too many
changes too soon for his comfort level. Commissioner Luke said that he would
leave it up to Mr. Kanner's discretion as to what should be run by the Board
first.
There was a brief discussion regarding the Commissioners' attendance at
various events, which events are appropriate, and when the County should pay.
Commissioner Clarno suggested that a policy be developed to clarify this issue.

SMOKING POLICY
STATEMENT OF POLICY
It is the policy of Deschutes County to prohibit smoking in County facilities,
consistent with the Oregon Indoor Clean Air Act.
APPLICABILITY
This policy applies to all County personnel and all other individuals who use
County facilities.
POLICY AND PROCEDURES
Consistent with the Oregon Indoor Clean Air Act (ORS 433.835 et. seq., as it
currently exists or may from time to time be amended), smoking shall be
prohibited in all Deschutes County buildings, facilities, and automobiles, whether
owned, leased or controlled.
Smoking shall be prohibited within 50 feet of any entrance to any building or
facility. Appropriate signage will be posted.
Buildings shall have designated smoking areas to help protect and preserve the
health of both staff and patrons.
In addition, County facilities located within incorporated cities whose governing
bodies adopt ordinances establishing rules and regulations with regard to smoking
shall be subject to the terms and conditions of said ordinances. In those instances
when city ordinances are more restrictive than state law or this policy, the city
ordinance shall apply.
Enforcement of this of this policy will be complaint based. The appropriate
manager, supervisor or department head shall enforce this policy with staff and
shall inform clients and visitors that the policy is in effect.
