MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, NOVEMBER 6, 2006
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke and Michael M. Daly; Commissioner
Bev Clarno was out of the office. Also present were Dave Kanner, County
Administrator; Muriel Delaverge-Brown, Health Department; Tom Anderson and
Catherine Morrow, Community Development Department; Mark Pilliod, Legal
Counsel; Keith Chu of The Bulletin; and eight other citizens.
Chair Luke opened the meeting at 10: 00 a.m.
1. Before the Board was Citizen Input.
None was offered.
2. Before the Board was Consideration of Signature of Document No. 2006-
556, an Intergovernmental Grant Agreement with Oregon State Parks
providing All-Terrain Vehicles for Sheriff Patrol Services.
Sue Brewster said that this is the second year the Sheriff's Office has been
handling the patrol of State lands, and the State provides the ATV's used for
this service.
3. Before the Board was Consideration of a Request for Approval of Comp
Time Bank Limit Exception.
Becky Wanless explained the item, which would allow compensatory time for a
P & P Officer to exceed the allowed amount of 80 hours. This person came
from the District Attorney's Office with a lot of hours and due to weeks of
required training, is now up to 112 hours of comp time.

Dave Kanner stated that department heads should more carefully monitor
employee comp time.

4. Before the Board was Consideration of Signature of Document No. 2006-
557, an Intergovernmental Agreement with the State of Oregon regarding
Breast and Cervical Cancer Screening Exams.
Muriel Delaverge-Brown gave an overview of the item. The County used to
oversee the program for seven counties, but the State has taken over
administration of the program.

5. Before the Board was a Hearing and Consideration of Signature of Order
No. 2006-156, a Measure 37 Claim (Claimant: Abbey).
Tom Anderson said the property is located near Ice and 43rd in Terrebonne, and
consists of 69 acres zoned EFU. The claimant wants to partition to allow a
farm dwelling on a parcel. Ownership history is complicated. The claimants
originally acquired 160 acres in 1987; there were three previous partitions of
the 160 acres. One was divided into three pieces. The desire is to reformulate
the 69-acre parcel and the 4-acre parcel to allow a farm dwelling on one of the
new pieces. The partitions are already technically done. The order establishes
a review date of July 1987 for future land use applications.
Steve Abbey stated that they are okay with the order, but that the address on the
order is incorrect. He added that he doesn't understand some of the
terminology.

Commissioner Luke pointed out that it is not a land use hearing, but a hearing
to establish when Mr. Abbey first had a property right. He went on to explain
the basics of the process.
Ms. Abbey asked if they have to wait for the State to answer their application
before applying for a land use change. Mr. Anderson replied that from a
practical standpoint, the State decision is needed first.

6. Before the Board was a Hearing and Consideration of Signature of Order
No. 2006-157, a Measure 37 Claim (Claimant: Bolken).
Tom Anderson said that the property is located at 9721 N Highway 97, just
north of Terrebonne, off the west side of the highway. It is approximately 32
acres zoned EFU. The owner wishes to subdivide it into six lots of five or more
acres each. The claimed value is $1,180,607. The original appliation shows an
acquisition date of 1977; supplemental information shows a purchase contract
in June 1971. The date for review would be considered June 1971.
Olaf and Janice Bolken testified that they are okay with the order, but had a
question as to whether they would need to wait for the State to make its
decision before proceeding.
No other testimony, for or against, was offered.
Commissioner Daly disclosed that he has known Mr. Bolken as a friend for
years.

No. 2006-158, a Measure 37 Claim (Claimant: Nulton).

Mark Pilliod said that the attorney representing the Nultons has indicated a
waiver may not been needed. He asked that this item be delayed until
November 20.

8. Before the Board were Deliberations and Consideration of First Reading of
Ordinance No. 2006-033, Amending and Adding Bicycle Parking and Bike
Commuter Requirements.
Commissioner Luke stated that a work session will be held on this item at a
future date.

Deschutes County Health Department Fund.
Dave Kanner explained that this is a new position to handle accounts payable for
the Health Department. If the outstanding collectibles could be cut even in half, it
is cost-effective.
11. Signature of Resolution No. 2006-136, Appropriating New Grand Funds
within the Deschutes County Health Department Fund.
