Luke, Mike Daly and Bev Clarno. Also present were Dave Kanner, County Administrator; Debbie Legg and Ronda Connor, Personnel; Timm Schimke, Solid Waste Department; Commissioner-elect Tammy Baney; Susan Ross, Commissioners' Office; and, for part of the meeting, Mark Amberg, Legal Counsel and Realtor Steve Scott. Also present was media representative Keith Chu of The Bulletin. No other citizens were present. The meeting began at 1: 30 p. m. 1. Consideration of Signature of Resolution No 2006-141, Transferring Appropriations within the Sheriffs Office Fund. This item will be added to the agenda of the December 27 work session. 2. Consideration and Signature of Intergovernmental Agreement No. 2006- 596, between the Sheriffs Office and the Oregon State Police. This item will be added to the agenda of the December 27 work session. 3. Discussion of EBAC Recommendation regarding Accident Benefit. Rhonda Connor stated that the hazardous hobby or activity exclusion has been removed from the benefit package, as it is too hard to determine the incident and definition. DALY: Move approval. Minutes of Administrative Work Session Monday, December 18, 2006 Page 1 of 3 Pages In regard to the supplemental accident charge benefit, a recommendation has been made to waive the deductible for unintended accidents; this would result in a $500 deductible, then an 80/20 split. Previously it was $500 deductible, $500 for the employee to pay, then 80/20. The Employee Benefits Advisory Committee was split on this, with five voting for the change and four against, and two abstaining. There would be no increase in the stop loss rates. Dave Kanner observed that the original plan was ambiguous, and approximately half of visits to the emergency room total less than $500. It could be interpreted either way, though. Mark Amberg expressed concern that the labor agreements may be an issue if the interpretation is so vague. The Board did not take action on the proposed change 4. Update regarding a Proposed Smoking Matrix. Susan Ross explained the proposed matrix, and the distances and costs involved in instituting it. Most of the cost would be for signage. Commissioner Luke felt more than signage is needed, and suggested marking the area around the doors. Dave Kanner said that this would be a complaint-driven process, and more than anything just sets a tone. DALY: Move approval, with County Administrator or his delegate to administer it. The Board discussed the draft list of priorities and which ones they felt should receive the most attention from the lobbyist. A copy of the list as decided is attached. The Board agreed to provide funding to the La Pine Chamber of Commerce in the amount of $6,611 from the overall economic development fund. J Bar J has requested funding for new horse stalls. Commissioner Clarno agreed to furnish $2,400 and Commissioner Daly gave $500 from economic development funds. 7. Update of Commissioners' Schedules; Meeting Details. A decision on which Commissioner will be Chair and which will be Vice Chair for 2007, as well as which Commissioners will participate on various committees, will be decided the first week of January. 8. Other Items. Susan Ross said that the La Pine City Council has asked to use the South County Services Center for their meetings. She advised them to coordinate this with the Justice Court staff. The Board then went into executive session under ORS 192.660(2)(e), real property negotiations. No action was taken by the Board. Being no further discussion, the meeting adjourned at 3: 00 p. m. Please call (541) 388-6571 regarding alternative formats or for further information. off`{ Deschutes County Administrative Policy No. GA-7 Effective Date: SMOKING POLICY STATEMENT OF POLICY It is the policy of Deschutes County to prohibit smoking in County facilities, consistent with the Oregon Indoor Clean Air Act. APPLICABILITY This policy applies to all Deschutes County personnel and all other individuals who use County facilities. POLICY AND PROCEDURES Consistent with the Oregon Indoor Clean Air Act (ORS 433.835 et. Sep., as it currently exists or may from time to time be amended), smoking shall be prohibited in all Deschutes County buildings, facilities, and automobiles, whether owned, leased or controlled. Smoking shall be prohibited within 30 feet of any entrance to any County building or facility. Appropriate signage will be posted. To help protect and preserve the health of both staff and patrons designated smoking areas may be established by the Property & Facilities Department by the department director responsible for a County owned or occupied building. At the Sheriff's Department and Jail, special arrangements regarding designated smoking areas may be made at the discretion of the Sheriff due to security reasons. Enforcement of this policy will be complaint based. The appropriate manager, supervisor or department director shall enforce this policy with staff and shall inform clients and visitors that the policy is in effect. Dave Kanner County Administrator Policy # GA-7 Smoking Policy To: BOCC From: EBAC Date: 12/18/06 Work Session 1:30PM RE: Recommendations from EBAC to BOCC Presented by Timm Schimke & Ronda Connor The Employee Benefits Advisory Committee makes the following recommendations to the Board of County Commissioners: 1. Remove the Hazardous Hobby or Activity Exclusion (#22- see attached page 43 of the Benefit Plan booklet) On advice of the Benefits Coordinator and approval of EBMS and Stop Loss Carrier (HCCB), this exclusion poses no potential additional financial impact to the plan. 2. Officially recognize the Supplementary Accident Charge Benefit as waiving the deductible for services that would be applicable to the deductible. The accident benefit is $500 and the deductible is $500. See attached documentation from plan documents. The potential for increased expenditures is greatly increased. Background: in 2001 when the self funded benefits plan increased the deductible to $500 from $100 an Accident Benefit of $500 was added to offset added burden of the increased deductible. The intention of this benefit was to waive the deductible in cases where medical charges incurred exceeded $500. Our current TPA is administering this benefit as applying the deductible after paying the first $500. Our previous TPA states they were doing the same, although we have anecdotal evidence to the contrary. (15) Eye care. Radial keratotomy or other eye surgery to correct refractive disorders. Also, routine eye examinations, including refractions, lenses for the eyes and exams for their fitting. However, refer to the Schedule of Benefits for Vision Benefits and coverage under the Vision Plan. This exclusion does not apply to aphakic patients and soft lenses or sclera shells intended for use as corneal bandages. (16) Faith healing services, even if a covered provider performs services. (17) Family planning (except sterilization and oral birth control.) (18) Foreign travel. Care, treatment or supplies out of the U.S. if travel is for the sole purpose of obtaining medical services. (19) Genetic counseling or testing for any condition. (20) Government coverage. Care, treatment or supplies furnished by a program or agency funded by any government. This does not apply to Medicaid or when otherwise prohibited by law. (21) Hair loss. Care and treatment for hair loss including wigs, hair transplants or any drug that promises hair growth, whether or not prescribed by a Physician. dFlrctivtty. 12arc and treatment of an Injury or Sickness that results from engaging in a Hazardous Hobby or Activity. A hobby or activity is hazardous if it is an activity which is characterized by a constant threat of danger or risk of bodily harm. Examples of hazardous hobbies or activities are skydiving, auto racing, hang gliding, jet ski operating or bungee jumping. (23) Hearing aids and exams. Charges for services or supplies in connection with hearing aids or exams for their fitting. (24) Home birth and related expenses. (25) Homeopathic or naturopathic treatment, except as stated as a specific benefit of this Plan. (26) Hospital employees. Professional services billed by a Physician or nurse who is an employee of a Hospital or Skilled Nursing Facility and paid by the Hospital or facility for the service. (27) Hospitalization ordered solely due to the patient's age, apprehension, or emotional state; or for the convenience of the patient, family, or Physician. (28) Hypnosis or hypnotherapy. (29) Illegal acts. Charges for services received as a result of Injury or Sickness occurring directly or indirectly, as a result of a Serious Illegal Act, or a riot or public disturbance. For purposes of this exclusion, the term "Serious Illegal Act" shall mean any act or series of acts that, if prosecuted as a criminal offense, a sentence to a term of imprisonment in excess of one year could be imposed. It is not necessary that criminal charges be filed, or, if filed, that a conviction result, or that a sentence of imprisonment for a term in excess of one year be imposed for this exclusion to apply. Proof beyond a reasonable doubt is not required. This exclusion does not apply if the Injury or Sickness resulted from an act of domestic violence or a medical (including both physical and mental health) condition. (30) Illegal drugs or medications. Services, supplies, care or treatment to a Covered Person for injury or Sickness resulting from that Covered Person's voluntary taking of or being under the influence of any controlled substance, drug, hallucinogen or narcotic not administered on the advice of a Physician. Expenses will be covered for Injured Covered Persons other than the person using controlled substances and expenses will be covered for Substance Abuse treatment as specified in this Plan. This exclusion does not apply if the Injury resulted from an act of domestic violence or a medical (including both physical and mental health) condition. Deschutes County 43 January 1, 2006 SUPPLEMENTARY ACCIDENT CHARGE BENEFITS This benefit applies when an accident charge is incurred for care and treatment of a Covered Person's Injury and: (1) The Injury is sustained while the person is covered for these benefits; and (2) The charge is for a service delivered within 90 of the date of the accident; and (3) To the extent that the charge is not payable under any other benefits under the Plan (other than Medical Benefits). BENEFIT PAYMENT Benefits will be paid as described in the Schedule of Benefits. ACCIDENT CHARGE An accident charge is a Usual and Reasonable Charge incurred for the following: (1) Physician services. (2) Hospital care and treatment. (3) Diagnostic x-rays and lab tests. (4) Local professional ambulance service. ent (5) Surgical dressings, splints and casts and other devices used in the reduction of fractures and dislocations. (6) Nursing service. ent (7) Anesthesia. (8) Covered Prescription Drugs. ,nt (9) Use of a Physician's office or clinic operating room. EMERGENCY MEDICAL CONDITION If the Employee or covered Dependent should experience an emergency medical condition, he or she should seek medical attention from the nearest appropriate facility (Physician's office, clinic, urgent care center, Hospital emergency room) or call 9-1-1. Benefits for an emergency medical condition are provided as covered services at the higher preferred provider benefit level from any Hospital emergency room. tent An emergency medical condition is one that manifests itself by symptoms of sufficient severity, including severe pain, that a prudent layperson possessing an average knowledge of health and medicine would reasonably expect that lent failure to receive immediate medical attention would place the health of a person, or a fetus in the case of a pregnant woman, in serious jeopardy. ent Covered services for an emergency medical condition include the emergency medical screening exam consisting of the medical history, examination, ancillary tests and medical determinations required to ascertain the nature and extent of an emergency medical condition, admissions on the day of, or within two days after, the onset of treatment, and stabilization of an emergency medical condition. Fund community mental health services in a manner that is consistent with planned changes at the Oregon State Hospital. 4. Amend statutes to provide the Board of County Commissioners authority to establish the date, time and place of auctions of foreclosed properties and also authority to designate which properties are included in the auction. 5. Oppose changes to collective bargaining statutes for law enforcement personnel. PRIORITY 2 1. Achieve equity for Central Oregon to meet local needs especially in mental health services and substance abuse services for low income people who do not qualify for the Oregon Health Plan. 2. Sustain and Expand treatment court capacity in Deschutes County. 3. Amend statutes to provide that revenue from the sale of property due to delinquent taxes is not local revenue for purposes of calculation of State School Fund grant for school districts and education service districts. Also prohibit the use if revenue from these property sales in calculating Community College Support Fund grant for community colleges and community college service districts. 4.
