BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Abandoning Donner Place
Local Improvement District within ORDER NO. 2007-042
Deschutes County, Oregon.
WHEREAS, on August 25, 2004, the Board of County Commissioners of
Deschutes County, Oregon, initiated by Resolution 2004-099, the improvement of a
certain dedicated road known as Donner Place; and
WHEREAS, the resolution was referred to the Engineer for a feasibility report to
investigate the maximum cost of improvement. The maximum cost of improvement has
been prepared in accordance with Chapter 12.48.150 of the Deschutes County Code;
and
WHEREAS, during the course of the feasibility report, the Engineer and the
property owners felt the cost was too high to justify proceeding with the Donner Place
LID; and
WHEREAS, since the Road Department did not complete the feasibility study,
determination of specially benefited properties and method of assessment or a financial
feasibility, the residents requested the refund of the initial filing fee; and,
WHEREAS, the Road Department agreed with the property owners that the
amount of work put into the Donner Place LID did not justify the retention of the deposit;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That, in accordance with 12.48.165(A) of the Deschutes County Code,
the local improvement known as the Donner Place Local Improvement District is hereby
declared abandoned and no new petition may be filed until the current moratorium is
lifted or within a period of one year after the date of this order.

Section 2. That Deschutes County shall refund the $800 filing fee back to the two
chief petitioners.
Section 3. That the Road Department pursuant to Chapter 12.48.165 of the
Deschutes County Code shall give written notice of the abandonment to all petitioners
mailed to the addresses provided in the petition.
