Daly, Dennis R. Luke and Tammy Baney. Also present were Laurie Craghead, Legal Counsel; Dave Peterson, Information Technology; Dan Peddycord, Health Department; Teresa Rozic, Commissioners' Office; media representative Cindy Powers of The Bulletin; and nine other citizens. Chair Michael M. Daly opened the meeting at 10:00 a. m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was Consideration of Signature of Document No. 2007- 070, an Intergovernmental Agreement between Deschutes County and the Deschutes County 9-1-1 Service District regarding Use of District Paging Services. Dave Peterson gave an overview of the agreement. He said in the past private providers' services have not been consistently reliable, and I.T. would like to utilize the services provided by 9-1-1. Before the Board was Consideration of Authorizing County Administrator Signature of Document No. 2007-042, an Amendment to an Intergovernmental Agreement with the State of Oregon regarding Health Services. Dan Peddycord explained that the State has already signed this document but Legal Counsel has indicated it needs Board review and approval. This is a small adjustment in funding and some reimbursements of expenses. BANEY: Move approval. LUKE: Second. VOTE: BANEY: Yes. LUKE: Yes. DALY: Chair votes yes. 4. Before the Board was Consideration of Signature of Order No. 2007-099, Approving and Confirming the Sale of Certain Real Property Previously Acquired by Deschutes County. Teresa Rozic explained that this Order formally accepts the bids on properties from the latest County property auction. The total amount bid was $917,600; most of this funding is passed on to the school districts and other entities. Properties that didn't sell will be available for an offer of the minimum bid. Before the Board was Consideration of Signature of Document No. 2007- 164, Petition for Change of Boundary and Inclusion of Land into Central Oregon Irrigation District. Ms. Rozic stated that in February she briefed the Board on the water rights project, in an attempt to preserve about thirty acres of water rights and to assign some of those rights to the Fair & Expo Center and Knott Landfill. Minutes of Board of Commissioners' Business Meeting Wednesday, April 4, 2007 Page 2 of 6 Pages The document today addresses including Knott Landfill in the Central Oregon Irrigation District; it is currently in the Arnold Irrigation District. Water will be needed to reclaim the land and for dust control. Some test wells need to be drilled and an application with Water Resources has been filed. If the ground water does not fulfill these needs, surface water would be used for backup. Water rights in both Districts will be needed eventually. Some water is currently going into the water bank for the time being; the number of credits are not known until Water Resources reviews the information. Some of the water had been assigned to the old fairgrounds site, and a few other rights are from various locations. Ms. Rozic said that the water rights for some County properties have been temporarily placed in an in-stream lease until it is known what will be needed for the Knott Landfill reclamation proj ect. Before the Board was Consideration of Signature of Resolution No. 2007- 042, Requesting Oregon Economic and Community Development Commissioner Issue State Revenue Bonds to Assist Breedlove Guitar Holdings LLC in Building a Larger Manufacturing Facility within Deschutes County. Laurie Craghead gave a brief overview of the item, which will help Breedlove Guitar expand its facilities. The land they wish to acquire is located near Summit High School. For the State to issue bonds to assist them, the County must provide a resolution in support, as does the City of Bend. Clark Jackson with the State Economic Development Commission and Connie Hensley Jones, controller for Breedlove Guitar, came before the Board. The company is now renting two buildings in Tumalo, but needs more space. They went from five to forty-one employees and now wish to construct their own building of about 20,000 square feet, with room to add another as needed. The County's support is needed for the State to be able to sell the bonds; the State would be enabled to review the project and determine if it is viable. Commissioner Luke confirmed that the application is being forwarded on to the State so the State can determine if it is an eligible project. Mr. Kanner added that this has no effect on the County's finances. The resolution will be amended to reflect that Breedlove is one of the manufacturers of guitars, not the only one. ADDITION TO THE AGENDA Before the Board was Consideration of Chair Signature of Document No. 2007-172, a Memorandum of Understanding Amending the Pelton-Round Butte Hydroelectric Project Relicensing Settlement Agreement. Laurie Craghead said that this document needs Board approval; it amends the July 2004 agreement with the Federal Government to include some issues that have been mitigated since that time. The parties have come to an agreement; none of these specific issues affect Deschutes County but do impact the master agreement, requiring Board approval. Commissioner Baney asked for a little time to read it over, and that it be discussed at the afternoon work session. LUKE: Move that this item be addressed at today's work session. BANEY: Second.
