Daly, Dennis R. Luke and Tammy Baney. Also present were Mark Pilliod and Laurie Craghead, Legal Counsel; Tom Anderson, Catherine Morrow and Paul Blikstad, Community Development; media representative Kayley Mendenhall of The Bulletin; and fourteen other citizens. Chair Michael M. Daly opened the meeting at 10: 00 a. m. 1. Before the Board was Citizen Input. William Kuhn, 65575 Sisemore Road, Tumalo, said he had questions about the generalities of Measure 37, and suggested additional criteria for the County to consider when reviewing and making decisions on Measure 37 issues. He said it is very simple; why aren't claimants subject to the same kind of false swearing penalty as they would have to provide otherwise. Other citizens of the County are being subjected to people who are asking for hundreds of thousands if not millions of dollars of special benefits from the County. As such, he would like to encourage people to be honest in their requests. (A copy of his letter is attached.) Commissioner Daly said this he is a bit confused about this statement. Most Measure 37 claims deal with a waiver of land use restrictions that occurred after the person purchased the property. There are many. Without a specific instance, he is not sure what is being requested. Mr. Kuhn stated that if Commissioner Daly waits until the end of the day, he'll understand what he means. Before the Board was a Hearing and Consideration of Signature of Order No. 2007-075, a Measure 37 Claim (Claimant: Big Falls Ranch). Mark Pilliod stated that this needs to be continued at the claimant's request, per Bob Lovlien, the attorney for the claimant. Mark Pilliod stated that the claimant has asked for a continuance. DALY: Chair votes yes. 4. Before the Board was a Hearing and Consideration of Signature of Order No. 2007-077, a Measure 37 Claim (Claimant: Neumann). Tom Anderson stated that this claim is in regard to a single parcel located on Delicious Street. He referred to an oversized map showing all Measure 37 claims. The property is located between Bend and Sisters near Sisemore Road. It consists of 129 acres zoned F-2 with a wildlife overlay, and is owned by the Neumann family trust. Minutes of Board of Commissioners' Meeting Monday, April 23, 2007 Page 2 of 8 Pages The claimants wish to partition the property into two parcels of approximately 87 and 40 acres, to allow single family homes. The amount of damage claimed is $147,555. The Neumanns acquired half-interest in a larger parcel in August 1989. Full title to the parcel was conveyed the following year, and it was conveyed to the trust in 1994. The Board has found a revocable trust does not break the ownership history. The date of acquisition per the staff report and Order would be August 17, 1989. In 1989 the land was governed by PL-15, which would probably allow this use, subject to land use review and decision. At that time the minimum lot size was forty acres. No letters of opposition have been received. Commissioner Daly opened the meeting for public testimony. Bruce White, attorney for the claimant, and claimant Susan Neumann came before the Board and indicated they support the Order. There is a slight correction to the legal description needed, per the title report. Mr. Anderson stated that the precise borders of the property should be listed, and will be corrected. Before the Board was a Hearing and Consideration of Signature of Order No. 2007-078, a Measure 37 Claim (Claimant: Barnes). Tom Anderson said that this claim involves a single parcel located east of Highway 20 and south of Rickard Road, at 24185 East Highway 20. It consists of sixty acres zoned EFU-Alfalfa subzone, with a landscape overlay. The claimants wish to subdivide the property into three twenty-acre parcels for non- farm dwellings. The amount of damage claimed is $189,000. Minutes of Board of Commissioners' Meeting Monday, April 23, 2007 Page 3 of 8 Pages The property was acquired by the Barnes' at County auction on May 12, 1997. The County may have expressed to them at that time that it would be possible to subdivide, but the rules have changed somewhat for the County since then. Commissioner Luke asked whether if the Court says it is illegal but the County approved it, is it still okay. Mr. Anderson replied that a State waiver is also required for a ruling on land use applications. The staff report and Order indicate this could have been the County's practice and laws at the time. He said he is not making a statement of the situation; the State could decide something different. The hearing was opened, and Judith and Darrell Barnes came before the Board. Mr. Barnes said he is not aware of the proposed Order being on line and would like to review it first. Tom Anderson said notice of the hearing was mailed and they could have obtained a copy of the Order. Commissioner Luke said that this simply establishes the date of ownership, May 13, 1997. The Barnes took a few moments to review the documents at this time. Mr. Anderson stated there is a small error regarding the zoning, which should show EFU-AL. LUKE: Move correction as stated. Before the Board was a Hearing and Consideration of Signature of Order No. 2007-079, a Measure 37 Claim (Claimant: Twiggs). Minutes of Board of Commissioners' Meeting Monday, April 23, 2007 Page 4 of 8 Pages Tom Anderson explained that this involves a single parcel located off Tumalo Road, just west of Deschutes Junction. It is 20 acres zoned EFU-Tumalo Redmond-Bend subzone. The map shows a significant part of the property is located in a flood plain, which is based on FEMA information for a 100-year flood. It was not created by the County but was adopted at FEMA's direction, based on aerial photographs. There is a process for a property owner to dispute the flood plain zone. This involves a flood plain survey to be done by the property owners. There is also an airport safety overlay for a dirt airstrip in the area that may no longer be in use. The claimant wishes to subdivide for residential purposes, 18 or 19 one-acre parcels. The amount of damage claimed is $873,049. Ownership was acquired via contract of sale on July 8, 1966; title was conveyed in November 1988. The property has been continuously owned since 1966. The flood plain and airport safety zone are not exempt per Measure 37. Commissioner Daly opened the hearing. Being no testimony offered, he closed the hearing. Mark Pilliod said that the owner's attorney is located in Salem and may have not received notice, since notice typically goes to the claimant. The Board has until the end of May to make a decision on this issue, and he recommended that the hearing be continued. Commissioner Luke suggested that the attorney be contacted and the matter be brought back to the Board. The attorney may want to comment on the flood plain and airport overlay issues. Before the Board was a Hearing and Consideration of Signature of Order No. 2007-080, a Measure 37 Claim (Claimant: Dowell). Minutes of Board of Commissioners' Meeting Monday, April 23, 2007 Page 5 of 8 Pages Commissioner Luke said that there has been a request for him to step aside of this claim, and it has been suggested that there is some evidence making this necessary. He said he would appreciate knowing about the specifics of this request, and that the information be entered into the record as soon as possible. DALY: Chair votes yes. 8. Before the Board is Consideration of Board Approval and Signature of Decision and Findings on File #TP-06-977, a Tentative Plan for a Measure 37 Subdivision (Applicant: C. Corp Homes/Arnett). Laurie Craghead said that public input has been closed, and this is the time for the Board to consider the final decision. She gave an overview of the process to be followed at this time. Paul Blikstad explained that the applicant was able to address the Hearings Officer's concerns regarding water supply and traffic impacts during the hearing process before the Board. Ms. Craghead stated that Community Development and Legal Counsel agree on the wording of the draft decision document. Via e-mail, attorney Ed Fitch has confirmed the deadline extension to April 27. Commissioner Baney asked if this development will have a community sewer system and, if so, how would they deal with Goal 11. Ms. Craghead stated that this issue is not a part of the record and can't be discussed until the documents are signed and mailed. LUKE: Move approval of the Decision. BANEY: Second. VOTE: BANEY: Yes. Commissioner Luke stated in terms of swearing in people, they don't even swear in people on land use issues. Mark Pilliod said that in response to the question posed about penalties for false swearing, he is not aware of any jurisdiction that requires someone take an oath prior to testifying in a land use matter or in Measure 37 matters. It could be established as a practice, but does create an additional process, and would have to be applied to everyone. He stated that he wonders whether the person suggesting this can point to particular Measure 37 cases in which testimony the Board has relied on has been determined to be intentionally false. In many cases - perhaps most cases - the property owner, based on some case law out of condemnation cases, feels they are entitled to provide an opinion about the value of their property, including the loss of value of their property. That information may not be intentionally false, but is presumably based on their good faith belief in the value of their property. Courts routinely rely on that kind of information in not Measure 37 cases, but in condemnation cases. An expert opinion is not needed to establish loss of value. The legislature could create that hurdle if they wanted to, but they haven't. The County could create that hurdle outside of the Measure 37 context, but it would make it more difficult to get through cases, particularly because the County has finished about 75% or more of all the cases that have been filed, to impose this new procedural obligation. He would not lightly propose this without evidence that there has been widespread misrepresentation or false statements that the Board has relied upon. Commissioner Luke asked what the penalties could be. Mr. Pilliod stated there are criminal sanctions if you can prove that a person intentionally submitted false information, under oath, in a formal proceeding, he or she could be prosecuted for a crime. But the District Attorney may choose not to pursue it. Also, if the Board relied on faulty information, it could have been reliable at the time it was given. And this would not automatically reverse the Board's decision. It could create a problem; probably more of a problem for those people out there who are being honest as much as possible and are appearing in good faith. Minutes of Board of Commissioners' Meeting Monday, April 23, 2007 Page 7 of 8 Pages Commissioner Daly added that if the person claiming this wants to - and he is probably referring to the Dowell claim - he is a neighbor so could rebut information when the claim is opened for testimony. Mr. Pilliod said he does not know what testimony the Dowells or the Kuhns could offer in the context of Measure 37. It seems if there is a dispute that is irrelevant to Measure 37, it needs to be taken someplace else. Commissioner Daly noted that the Board has heard it many times. Commissioner Luke asked that Mr. Pilliod obtain Mr. Kuhn's evidence. Being no further items to come before the Board, Chair Daly adjourned the meeting at 11: 00 a. m. Dear Commissioners, My name is William Kuhn. I live at 65575 Sisemore Road which is pretty much at the center of the northern most portion of the Tumalo Winter Deer Range. My wife Leigh and I have owned our property for 20 years and have lived here since Saturday the 4`h of August 1990. That was the day we lost our home south of Bend to the Awbrey Hall Fire. Please forgive me for interrupting your schedule, I simply do not know the best way or time to bring up this issue, and ask the two questions we have. It is not my intention to give testimony at this time regarding anything on the Commissioners' next agenda or to testify on a specific M37 claim. Why aren't Measure 37 claimants subject to some kind of a false swearing penalty? Deschutes County is being asked time and again to pay hundreds of thousands to millions of dollars in claims based on M37. Many of these claims seem to meet the basic criteria for measure 37; however, some of these claims contain false, deliberately misleading information, or are patently fraudulent. If there were a penalty for giving false testimony to the Commission, the residents of Deschutes County would greatly benefit especially given the way the County simply rubber stamps seemingly all claims presented. By having a simple standard such as enforcement of a penalty for false swearing many of the property rights of all the rest of us who must endure the travesty of the unintended consequences of measure 37 would be lessened. Second, on Monday the County Commission will hear M37-06-145. I have over the course of the past year and a half observed several M37 hearings and I have not been able to determine how or when to ask a specific procedural request. Again - I do not intend to give testimony regarding that claim today. But we would like to know when the appropriate time is to raise a procedural request before the actual hearing begins. We just don't know when the best time is to do that. I also realize that technically I cannot challenge a commissioner from hearing a case/claim unless there is a conflict of interest involving finances. However, in this case the basis for our request is strong and compelling. Commissioner Luke knows of his actions regarding the Dowell property, and unless Commissioner Luke voluntarily recuses himself we would like to know the appropriate way and time to challenge his hearing the case/claim. If Commissioner Luke chooses not to voluntarily recuse himself from these proceedings I would then like to offer some of our evidence which was obtained from the state version of Freedom of Information and via subpoena duces tecum. This evidence, we feel, will show a strong and compelling basis for recusal.
