Attendance: Commissioners Albert Young, W. F. Schinkel, and
Joe Peden; Charles L. Plummer, Lorin Morgan, Sheridan Fahnestock,
Pat Gisler, Charles D. Allis, Ron Bryant, and William Holmes.
Chairman Young called the meeting to order at 10:00 am.
First item on the agenda was the Planning Services Contract
with Sisters. A motion was made, seconded and carried that
the County enter into s.aid contract with Sisters.
Next item on the agenda was the vacation of a portion of "G"
Avenue and 12th Street in Terrebonne. A motion was made,
seconded and carried that "G" Avenue and 12th Street be
vacated.
At this time, the Commission appointed Virgil Henkle and
Wallace Cleveland to the Budget Advisory Board.
Charles Plummer, Roadmaster, presented the Commission with
Resolutions to establish Nottingham Court,.Ridgeview Drive,
Ridgeview Court, Ridgeview Place, Woodside Court, Woodside
Road. If there are no objections or remonstrances filed on
account of said proposed roads, an order establishing these
roads will be acted upon November 20, 1974.
Last item on the agenda was the discussion of a Boundary
Commission with those minutes attached.

REGARDING BOUNDARY COMMISSION FORMATION
October 16, 1974
Commission Chairman Abe Young opened the meeting for
discussion of a proposed boundary commission.
Mr. Ron Bryant, Mayor of Redmond, stated that he was
not opposed to the entire proposal but the formation of a
boundary commission should be considered by all service
districts. He felt that the County Commissioners should
take a good look at this proposal and felt that everyone
concerned would need time to really consider this thing.
Pat Gisler, private citizen, stated that boundary
commissions take away your power and indicated that they
have a certain place in highly metropolitan areas but
that it should not be implemented in a place like Deschutes
County. He said that they can be very easily misused and
they are being misused today in a land use planning function.
Bill Holmes, attorney representing Sunriver, stated
that there are adverse affects and problems with respect
to the reasons for forming a boundary commission and that
he would like to see everyone come forward with specific
problems as to why it wouldn't work. He indicated that there
are problems of overlapping districts which can be avoided
by boundary commissions.
Charles Allis, President of Sunriver, stated concern
over the opposition and said that if there was another
method of accomplishing what they wanted without having
a boundary commission, they would do it, but he said they
were advised by their attorney that there was no other
way. He stated that they were in the process of trying
to work out adequate financing.
Ron Bryant stated that petitions would be involved
and that we should take a whole look at what the adverse
affects are.
Lorin Morgan, Planning Director, indicated that he
did not feel a boundary commission is needed for a county
like ours and indicated that boundary commission were in-
tended to be set by the legislature to curb overlapping
problems which occur in metropolitan centers of the
Willamette Valley. He said that it requires more involve-
ment in authority regarding comprehensive plans and such a
commission would be totally atonimous and could require
funding as well as preparation of plans, authority of city
and county planners, etc. He felt we simply did not have
the kinds of problems which warrants another layer of
government.
Paul Ramsey, Avion Water Company, stated that a boundary
commission is a. very dangerous thing,and that it transfers
power to create a state agency. He stated that it has not
worked well in the state and there are proposed amendments
in the '75' legislature. He recommended a very detailed study be
dQne_and how it would affect the people of Deschutes County
to determine what everyone could live with. He recommended
no action be taken.
. Louis Selken, our District Attorney, indicated that,
pertaining to a discussion on the cost of an Attorney Generals
Opinion, we are talking about a few hundred dollars; however,
it depends on the activity involved which could mean a high
expense in getting the legal opinion.
. Abe young, Commission Chairman, stated that boundary
commissions are normally funded by the state and that it
would appear that more study and research needs to be done
before the commission considers a boundary commission which
would involve a whole county. He indicated that it could
mean a high expense to finance such a boundary commission.
Commissioner Joe Peden, asked how long it would take
to get a legal opinion and Louis Selken indicated it could
take six weeks depending on the volume and background that
would be required.
Commissioner Joe Peden then moved that the decision
be deferred until the first court day in December. Motion
was seconded and carried.
Commission Chairman Abe Young adjourned the meeting.
