K. Kopplin R. E. Modress Lucia Venator, Secretary Chairman Grubb called the meeting to order at 10:00 a.m. First order of business was the 10:00 a.m. Hearing on the Community Development Block Grant. Don Grubb explained the purpose of the grant and told the audience that the monies would be used for water systems for Lapine and Tumalo and to improve road conditions in Terrebonne. Commissioner Montgomery explained that once the systems were installed the communities would be responsible for the maintenance and upkeep of the systems. Dave Hoerning explained to the residents of Terrebonne that possible they could use the block grant funds and then form a road assessment district to pick up the blance that the grant funds didn't provide for their road improvement system. Commissioner Young moved that the Commission present the block grant request to 4A-95 review. Commissioner Montgomery seconded the motion. Vote was: Abe Young, aye; Bob Montgomery, aye; Don Grubb, aye; motion carried. There was no discussion on Road Dept. or General Fund bills. Next item on the agenda was the second reading of proposed utility Ordinance No. 203-7. Chairman Grubb read the ordiance title and purpose of ordinance. Because of the length of the ordinance, Commissioner Young moved that the reading be dispensed with. Commissioner Montgomery seconded the motion and the vote was as follows: Abe Young, aye; Bob Montgomery, aye; Don Grubb, aye; motion carried. As there were no objections to said ordinance, Commissioner Montgomery then moved that Utility Ordinance No. 203-7 be adopted. Commissioner Young seconded the motion. Vote was: Abe Young, aye; Bob Montgomery, aye; Don Grubb, aye; motion carried. At this time Commissioner Young moved that Edward Jackson be appointed to fill the vacancy on the Library Board. Commissioner Montgomery seconded the motion and the vote was as follows: Abe Young, aye; Bob Montgomery, aye; Don Grubb, aye; motion carried. Mr. Jackson's four year term expires February 1, 1980. Chairman Grubb read an order for the proposed formation of Lazy River r J Court Day Minutes February 4, 1976 Page 2 Special Road District. The Commission was petitioned by persons who hold title to 100 of the land within the proposed Special Road District. Commissioner Montgomery moved that March 3, 1976 at 10:30 a.m. be set as the date for the hearing of objections if any to said formation. Commissioner Young seconded the motion and it passed with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. Next matter on the agenda was the proposed land exchange with Central Oregon Irrigation District. Commissioner Young explained this land exchange was being done to correct an error whereby Deschutes County sold property originally purchased from COI but during the title search the reversionary clause was missed. Commissioner Young moved that March 17, 1976 at 10:00 a.m. be set as the date for the hearing of objections if any to said land exchange. Commissioner Montgomery seconded the motion and the vote was as follows: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. A possible land exchange with Horace Fennell was next item of discussion. This land exchange was proposed because Hiway 20 severs the county's and Mr. Fennells land. This exchange would consolidate these properties. Commissioner Young moved and Commissioner Montgomery seconded that March 17, 1976 at 10:30 a.m. be set for the hearing of objections, if any. Vote was as follows: Abe Young, aye; Bob Montgomery, aye; Don Grubb, aye; motion passed. Next item on the agenda was the appointments to the Budget Advisory Board. Wallace Cleveland was recommended for a three year term and Robert Herwick for a one year to replace Robert Schock who resigned. Commissioner Montgomery moved that these recommendations be accepted. Abe Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. Lorin Morgan presented the Commission with ,a zone change request for Paul Rukaveno from R-2, Urban Residential/ 91-T, Tourist Commercial with Transitional Standards. The Planning Commission held a public hearing on this matter January 14, 1976 and unanimously recommended the zone change. Based on this Abe Young moved that the zone change be granted. Bob Montgomery seconded the motion. Vote was: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. Under other business, Jane Poor and Mary Jane Newton representing the League of Women Voters and Terry Duffin from Trout Unlimited, voiced their concern and objections to the county selling five parcels of land in the Plainview area which is in the Tumalo Winter Deer Range. The Commission told the audience that the sale had been advertised for several weeks and no one voiced any concern until a week before the sale date. They further stated that no state or federal agencies had approached them on a possible exchange or sale. The Commission decided to go ahead with the sale of these parcels, but said they were open for discussion on exchanges of this property with other government agencies for the preservation of this Winter Deer Range. . Court Day Minutes February 4, 1976 Page 3 Commissioner Young reported that he and Bob Montgomery were elected Directorsto represent Deschutes County on the COLEPA Board. Mr. Young was elected to be Chairman of COLEPA for the coming year. Chairman Grubb announced that the Dog Control Officers would be around the county selling dog licenses for the convenience of those unable to get to the courthouse.
