Marshall Lorin Morgan Lucia Venator, Secretary Chairman Grubb called the meeting to order at 10:00 a.m. Dave Hoerning opened the 10:00 a.m. hearing on the land exchange with Central Oregon ,Irrigation District. There were no objections to the exchange. Bob Anderson representing COI spoke in favor of the exchange. Commissioner Montgomery moved that the order for said exchange be issued and the proper deeds be executed. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. There was no discussion on Road Dept. or General Fund bills. Chairman Grubb told the audience that the Budget Committee had finished their deliberation of the 1976-77 budget last Thursday after a week of work. The committee trimed $450,000 from the budget and issued an order to the Clerk for an election April 20, 1976 for $404,000 over the six percent limitation which is the same as last years levy. Due to the raise in assessed valuation, this would be a nine cent per thousand dollar decrease in taxes. The Budget Board is confident of a successful vote the first time on the budget. Commissioner Young explained that the county could only count on six months of revenue sharing and that the budget committee had to put those items that have been paid out of revenue sharing back into the general funds. Chairman Grubb said that there would be a solid waste levy presented to the voters at the same as the general fund budget. This levy provides for free solid waste disposal for all residents of Deschutes County. April 5, 1976 at 7:30 p.m. in the Courthouse Annex, Conference Room "A" is set as the new hearing date on the Jail Bond issue. A re-hearing had to be set as new publication rules were notfollowed for the first hearing. Next item on the agenda was the bid opening on one 4X4 pickup for the Search and Rescue Dept. Bids were as follows: Marshall Motors, $6,395.00; Robberson Ford, $5,898.56; Thomas Sales $6,334.13; Murray and Holt Motors, $5,875.04; Bob Thomas Chevrolet, $5,884.70. Apparent low bidder was Murray and Holt Motors. The successful bidder will be announced after making sure they complied with the specifications. At 10:20 a.m. the scheduled bid opening on Rock crushing for Deschutes County were opened. There were only two bids: Bend Aggregate, no bid; R. L. Coats, $37,500 for 2" to 4" mineral aggregate in stockpile and $45,000 for 2" to #10 mineral aggregate in stockpile. Proposals went to seven different contractors, but they did not bid. Their reasoning being that the Comprehensive Plan does not allow for quarry sites unless they were in existance before the Plan came into being so rock is hard to get. Commissioner Montgomery moved that this matter be referred to the Planning Commission so provisions could be put into the Plan for more quarry sites. This in turn would produce more com- petitive bidding for rock. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Lorin Morgan told the Commissioners this matter would be on the April 14, 1976 Planning Commission Agenda. Jim Curl explained the no bid for Bend Aggregate because they beleive the county is using poor judgement in stockpiling aggregate when they can buy directly from them or other dealers in the county without moving the aggregate so many times. The county decided to take the one bid under advisement and notify the bidders at a later date of their decision. Don Grubb explained to the audience that the county had been notified that they are way down on the list to receive a $400,000 HUD Grant for the improvement of the Lapine and Tumalo water systems-and the improve- ment of Terrebonne roads.The grant would have also provided for insulation of homes of needy families. Next item on the agenda was the 10:30 a.m. hearing on the land exchange with Horace Fennell. There were no objections to this exchange. Comm- issioner Young moved that the order be issued for this exchange and that the deeds be executed. Commissioner Montgomery seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. At this time, Lorin Morgan, Planning Director had several planning items to present to the Commission. The first item was an amendment to the Deschutes County Zoning Ordinance No. PL-5, pertaining to Definition of Mobile Home and Dwelling. This amendment was prepared by the District Attorney's office to clarify the difference in the definition of a dwelling and a mobile home. Commissioner Young moved that the amendment pertaining to Definition of a Dwelling and Mobile Home be added to Zoning Ordinance No. PL-t. Commissioner Montgomery seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Second item, Temporary Emergency Use Definition was deferred until the April 7, 1976 meeting. Third item was a recommendation by the Planning Commission for Mobile Home Placement Standards amendment to Zoning Ordinance No. PL-5. This is primarily to amend an oversite whereby standards are used in A-1 and RR-1 areas of the county. This amendment would provide for mobile home placement standards in all zones of the County. Commissionter Montgomery moved that the amendment be adopted. Next item Lorin presented was an amendment to the Comprehensive Plan- Lapine Area establishing provision for "schools". This amendment is necessary in order for Lapine to expand their school system to meet demands according to the population growth in the area. Commissioner Montgomery moved that this amendment be adopted. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Another amendment to the Comprehensive Plan, pertaining to definition of Highway Commercial was presented. It was felt that this definition needed to be changed because it is inadequate as it relates to existing land use patterns and uses that will require highway frontage and access. Commissioner Young moved that the amendment to the Comprehensive Plan be adopted. Commissioner Montgomery seconded the motion with the follo- wing vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. Last planning item was a zone change request by Eddie Williamson from C-1, Commercial to C-2, Commercial. The Planning Commission held a public hearing on March 10, 1976 and unanimously recommended this zone change. Based on this Commissioner Montgomery moved that this zone change be granted and Commissioner Young seconded the motion. Vote was: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Chairman Grubb opened the 11:00 a.m. hearing on the Annexation to Rural Fire Protection Dist. No. 2. Dave Hoerning explained that the petition for annexation included all of Section 12, Township 17 South, Range 11 East of the Willamette Meridian in Deschutes County, Oregon. There were no objections to said annexation. Commissioner Young moved that April 7, 1976 be set as the final hearing on this matter. Comm- issioner Montgomery seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. The Anderson Mobile Home Appeal decision was set for this time, but because the transcript from the February 27, 1976 appeal hearing was not prepared in time for both sides to present their findings of fact, Commissioner Montgomery moved that April 7, 1976 be set as the new date for the decision. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Under open discussion, Commissioner Montgomery told the audience that the state wants to close Fryrear Pit again and the county had received an order from Salem to do so. The county is not going to shut down operations of the solid waste site, but will discontinue mining.
