Matt Jack Elder John Craig Bill Bogie Don Sledge Lucia Venator, Secretary Chairman Grubb called the meeting to order at 10:00 a.m. First scheduled business was the 10:00 a.m. hearing on the formation of Lazy River Special Road District. Dave Hoerning read the notice of final hearing and outlined the boundaries of the proposed road district. There were no objections to said road district. Commissioner Young moved that the order be issued approving Lazy River Special Road District and that Joseph H. Thompson, Mrs. James Minton and Dorothy B. Saxton be appointed as board members. Commissioner Montgomery seconded the motion and it passed with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. Chairman Grubb explained that the Redmond Hi French Club had again re- quested the county's permission to conduct Le Tour Deschutes bike race Saturday, May 15, 1976. This has been an annual even for the past two years. Commissioner Montgomery moved that they be granted permission for the bike race and that the sheriff's dept. and road dept. assist with road safety procedures. Commissioner Young seconded the motion with the follow- ing vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion passed. At this time Chairman Grubb read the Commission's decision on the Anderson Mobile Home Appeal. The Commission denied Mr. Anderson the conditional use permit based on the fact that the area in question is an area of conventionally constructed homes of significant property value and that placing a mobile home in the area would tend to cause economic obsolescence of adjacent properties and consquent depreciation from the upper limits of market value. Commissioner Young moved that the Commission adopt the decision as written. Commissioner Montgomery seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Court Day Minutes April 7, 1976 Page 2 Commissioner Montgomery read a resolution concerning the Monongahela Decision whereby the clear cutting method of timber harvesting has been eliminated. This decision reduces timber sales. Chairman Grubb ex- plained that this decision would not effect our pine forests but it would effect our fir forest areas. Chairman Montgomery moved that the Commission adopt this resolution. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Next item on the agenda was the 10:30 a.m. hearing on the proposed annexation of Section 12, Township 17 South, Range 11 E.W.M. to Rural Fire Protection District No. 2. This is the final hearing on this matter. There were no objections to said annexation so Commissioner Young moved and Commissioner Montgomery seconded that order be issued annexing Section 12 to Rural Fire Protection District No. 2. Vote was: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Dave Hoerning read a resolution for the annexation of a portion of Sec. 11 and Sec. 14, excluding Klippel Acres, all in T. 17 S, R. 11 E.W.M. to Rural Fire Protection District No. 2. Commissioner Young moved that April 21, 1976 be set as the date for the first hearing on this matter. Commissioner Montgomery seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. The Commission announced that they accepted the Rock Crushing bid of R. L. Coats. Chairman Grubb told the audience that April 6, was the hearing on the proposed Jail Bond Issue. All comments received were favorable. Comm- issioner Montgomery moved that the county go for a bond issue of $1,650,000 at the May 25, 1976 primary election. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Next item on the agenda was the discussion of snow plowing to Mt. Bachelor. Chairman Grubb read a letter from the State Highway Dept. to Mt. Bachelor advising them that all but $403.58 of the 60% of the funds for the biennium have been spent plowing snow to Mt. Bachelor. Expenditures for the second year of the biennium are $72,840.00. The Commission felt that the state did not give Mt. Bachelor sufficient time before they notified them that the monies were spent. The Commission wrote letters to Senator Fred Heard and Representative Sam Johnson requesting a meeting to discuss going to the Emergency Board for funds to relieve this situation. The county does not have the funds to snow plow the 11 miles to Mt. Bachelor. Fred Heard and Sam Johnson met with the Commissioners and told them it would do no good to go to the Emergency Board. Court Day Minutes April 7, 1976 Page 3 Under open discussion, Don Grubb complimented Deschutes County's Overall Economic Committee and its Chairman, Jess Butler for the fine job they did in preparing the development plan for Deschutes County. The Comm- ittee spent many hours on this project.
