Guthrie John Lilly Louis Selken Lucia Venator, Secretary Chairman Grubb called the meeting to order at 10:00 a.m. There was no discussion on Road Dept. or General Fund bills. First order of business was discussion on overnight camping at Smith Rock State Park. Chairman Grubb explained that the state, without notice, started building overnight camping facilities at Smith Rock. Proper channels for zoning and building regulations were not followed. The Commission sent a letter to George Guthrie, local State Parks Director stating the Commission was not in favor of overnight camping at Smith Rock State Park and would be happy to meet and discuss the matter with them. A stop work order was put on the project but work still continued. Finally a call to the Governor's office assured the county that the state would cooperate. Commissioner Young commented he felt the state should follow the necessary procedure before putting in overnight camping at Smith Rock. Commissioner Montgomery agreed with Commissioner Young but does not favor overnight camping at Smith Rock. Chairman Grubb opened the matter to discussion from the audience. Lee Fisher, a teacher at COCC and climber favors overnight camping at Smith Rock but agrees it should be regulated. He said they have been camping at Smith Rock for years. George Guthrie, State Parks Dept., explained by a map where the campground was to be built and assured the Commission and the public that the state would follow the necessary procedures in getting zoning approval to continue the project, and that the state would abide by the decision of the Planning Commission whether it was in favor or against an overnight camping site. 0 f May 5, 1976 Court Day Minutes Page 2 Several residents of the area mentioned their concern about trespassing and policing the area to protect the property owner. It was suggested by climbers that a fee be charged and use this money for enforcing some type of control over the overnight campers. Chairman Grubb closed the discussion at 10:40 a.m. The next step will be public hearings through the planning process. Next item was the discussion of the formation of a Tri-County Airport District. Chairman Grubb read a letter and resolution from the city of Redmond asking the county to initiate the necessary procedures for the possible formation of a Tri-County Airport Dist. In order for an election to be held on this matter, it must be coordinated with Jefferson and Crook Counties and an election be held in each county at the same time with the same ballot measure. Commissioner Montgomery feels it should be voted upon by the people but that they should be informed it would create a new tax district that they will be asked to support. Commissioner Young agreed with Commissioner Montgomery. Chairman Grubb feels it will take a taxing district to get the airport on its feet. Mr. Ed English, Manager of the city of Redmond told the audience that the airport does not take in enough revenue to support itself. At this time Dave Hoerning presented the Commission with a Resolution for the vacation of an unnamed road between Lot 11 & 12 Blk. 1, 1st Addition, Deschutes River Acres Subdivision. The county is initiating this vacation for reasons of maintenance and access. Commissioner Young moved that the resolution be adopted setting June 16, 1976 at 10:00 a.m. as the hearing of objections if any for the vacation of this unnamed road. Commissioner Montgomery seconded the motion with the following vote: A. Young, aye; B. Montgomery, aye; and D. Grubb, aye; motion carried. Dave Hoerning opened discussion of a possible land sale to Central Oregon Electric Coop. There was no one present from the Co-op. The property involved is by Knott Pitt where the Bonneville Power Line cuts across county property. There is a small triangle to the east of this of approximately an acre and a half that serves no purpose for the landfill. Central Electric Co-op has approached the county for this property to build a substation on. Land in this vacinity sells for $1250 to $1500 an acre. In order to close the transaction, a conditional use permit through the Planning Dept. is needed. The county will petition the Planning Commission for a hearing on this matter to be scheduled May 26, 1976. If a conditional use permit is granted, the county will go ahead and sell the property to Central Oregon Electric Co-op. The Co-op would also like a five year option on the property west of this areafor another substation. May 5, 1976 Court Day Minutes Page 3 Rick Craiger, Associate Planner, presented the Planning Dept. items. First was a zone change requested by Carlson Signs from R-1, Urban Resi- dentail to C-2T, General Commercial. This zone change has the unanimous approval of the Planning Commission. Commissioner Montgomery moved that the zone change be granted. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Second was a zone change request for Carlson, Tino & Crabbe from R-1, Urban Residential to C-2, General Commercial. This zone change has the unanimous approval of the Planning Commission. Commissioner Young moved that the zone change be granted. Commissioner Montgomery seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. An amendment to Zoning Ordinance No. PL-5 pertaining to non-conforming use was presented. This amendment allows the non-conforming use of property of those persons who had recently acquired property prior to the existence of the Zoning Ordinance. December 31, 1977 is set as the deadline for getting plans to the Planning Commission for approval unless another completion date has been approved by the Planning Commission. Commissioner Montgomery moved that the amendment to Zoning Ordinance No. PL-5 be adopted with the deletion of section 8.030 and changing the wording in line 18 and 19 on page three to read unless another completion date has been approved by the Planning Commission. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, aye; motion carried. Last Planning item was Proposed Citation Ordinance No. PL-6 pertaining to the enforcement of the Deschutes County Zoning, Subdivision, and Solid Waste Ordinances. This ordinance would give the Planning Dept. authority to cite violators of the above ordinances. Commissioner Montgomery expressed he felt that enforcement should be handled by the Sheriff's Dept. This ordinance was intended to keep the enforcement on a civil level rather than a criminal level. Based on this Commissioner Young moved that the ordinance be adopted to go into effect immediately. Commissioner Grubb seconded the motion with the following vote: Abe Young, aye; Bob Montgomery, no; and Don Grubb, aye; motion carried.
