Chairman Grubb called the meeting to order at 10:00 a.m. First Order
of business was the bid openings for the Briggs Road Constr. Project.
Dave Hoerning opened and read the bids. They were as follows: Central
Oregon Pavers, $40,628.80; Bend Aggregate & Paving, $37,948.60; R. L.
Coats $33,160.00; Engineers estimate $31,591.00; The apparent low bidder
was R. L. Coats and after extensions are checked the official successful
bidder will be announced.
There was no discussion on Road Dept. or General Fund bills.
Chairman Grubb read a resolution relating to the findings of fact
concerning county parking lots. The adoption of the resolution is
necessary in order for the Commission to designate usage of the county
parking lots. Commissioner Young moved that the resolution be adopted.
Commissioner Montgomery seconded the motion with the following vote:
Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried.
Next item on the agenda were resolutions for authority to apply for
funds for the construction of a Justice Building and Road Dept. Bldgs.
Chairman Grubb read the resolutions and explained that this was a
requirement of the Federal Govt. Commissioner Young moved that the
Commission adopt said resolutions. Chairman Grubb seconded the motion.
Commissioner Montgomery was against any such action because he favors
public hearings before any tax money is spent on these projects. He does
not feel tax money of any kind should be used to construct road dept.
buildings. Chairman Grubb explained that there is no money yet available
but the county wanted to be ready with their applications when the money
is made available. Vote on the motion was: Bob Montgomery, no; Abe Young,
aye; and Don Grubb, aye; motion carried.
First item under Planning business was a zone change request by Lois M.
Ross from C-1, Tourist Commercial to C-2 General Commercial. The Planning
Commission held a public hearing on the issue, August 25, 1976 and unan-
imously recommended approval of said zone change based on the fact that
it is in compliance with the Bend Urban Area Comprehensive Plan. Comm-
issioner Montgomery moved that the zone change be approved and Commissioner
Young seconded the motion. Vote was: Bob Montgomery, aye; Abe Young, aye;
and Don Grubb, aye; motion carried.

Lorin Morgan presented the Commission with an amendment to Zoning
Ordinance No. PL-5 pertaining to Class II Rural Subdivision in the A-1
Zone. The amendment would give the Planning Commission rather than
the Planning Director the authority to approve a Class II lot division
in the A-1, Exclusive Agricultural Zone. Such action is consistent
with the Comprehensive Plan for Deschutes County. Based on this,
Commissioner Young moved that the amendment to Zoning Ordinance No. PL-5
be approved. Commissioner Montgomery seconded the motion with the
following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye;
motion passed.
Last item on the agenda was the appointment to the Library Board. Mrs.
Sheri Hahn of Redmond was recommended to the Commission as willing to
serve on the Board. Commissioner Young moved and Commissioner Grubb
seconded that Mrs. Hahn be appointed to the Library Board to fill the
unexpired term of Lucille Jordan. Vote was: Bob Montgomery, aye; Abe
Young, aye; and Don Grubb, aye; motion carried.
Under open discussion, Commissioner Montgomery asked Lorin Morgan if a
citizen wanted to build a park on 200 acres of private property would
they have to go through the planning procedure like recommended in SB
100? Lorin told Bob they would have to apply for a conditional use permit
and hold a public hearing on the matter. Bob then asked why the Forest
Service does not have to go through the same procedure to build a park on
their lava land. He then moved that Lorin Morgan be directed to notify
Mr. Nichols of the Forest Service and ask him why the FS has not followed
the procedures as outlined by the State of Oregon and SB 100 in building
a park in the lava land. The Commission wants the answer in writing.
Commissioner Young seconded the motion with the following vote: Bob
Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried.
There being no further business or discussion, meeting was adjourned at
10:25 a.m.
