Thornton Lucia Venator, Secretary Vern Johnson Chairman Grubb called the meeting to order at 10:00 a.m. First order of business was the scheduled bid openings: Dave Hoerning opened and read the bids as follows: Pleasant Ridge Bridge: Douglas Coats Constr. $28,495.00; A. K. Lundmark 9,30 .00; Ross Bros. Constr. $39,944.00 Hannon Bros. Constr. $48,931.00; Engineers estimate: $33,837.00; Wilson Bridge: Douglas Coats Constr. $26,915.00; Ross Bros. Constr. 35,151.80; Hannon Bros. Constr. $42,447.00; A. K. Lundmark $42,106.00; Engineers estimate: $25,745.00; Sed ewick Box Culvert: E. M. Isckson $14,840.00; Engineers estimate: $14,752.00; Successful bidders will be announced after all extensions are checked. There was no discussion on Road Dept. or General Fund bills. Chairman Grubb read an order changing Courtday from November 17, to November 16, 1976 to enable the Commissioners to attend the AOC Conference in Eugene. Commissioner Montgomery moved thatthe November Courtday be changed and Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Next item on the agenda was the proposed formation of Black Butte Ranch Rural Fire Protection District. Chairman Grubb read the order with the legal description. Commissioner Young moved that a hearing on said formation be held November 16, 1976 at 10:00 a.m. Commissioner Montgomery seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Dave Hoerning presented the Commission with a resolution for the vacation of a portion of A. Aldridge Road. Commissioner Young moved that Dec. 1, 1976 be set as the hearing of objections to said vacation. Commissioner Grubb seconded the motion. Commissioner Montgomery abstained on the grounds he did not know where the road was and that a map should be provided for this purpose. Original motion was withdrawn and Commissioner Young moved that this matter be tabled until a better legal description can be prepared and a map produced showing the location of said road. Court Day Minutes October 20, 1976 Page 2 Commissioner Montgomery seconded the motion. Vote on the motion was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Next proposed street vacation was for Jefferson Street in the Centralo Addition upon the petition of William and Lavina Elrod. Commissioner Montgomery moved that December 1, 1976 be set as the hearing of objections if any to said street vacation. Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Lorin Morgan, Planning Director presented the Commission with several zone change requests. The first was by Lee Grimes from C-1, Tourist Commercial to C-2 General Highway Commercial for property described per order dated October 20, 1976. Commissioner Young moved that said zone change be granted. Commissioner Grubb seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; Don Grubb, aye; motion carried. Second zone change request was by Dave Mitchell from A-1, Exclusive Agricultural to R-1, Urban Residential. The request is consistent with the adopted Bend Urban Area Comprehensive Plan. Commissioner Montgomery seconded the motion. Commissioner Montgomery amended the motion that the zone change be granted subject to receiving a dedication from Mr. Mitchell for a road right of way on the corner of said property. Com- missioner Grubb seconded the amended motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Third zone change request was by Charles Church from A-1, Exclusive Agricultural to SR-1, Suburban Residential. This zone change is consistent with the adopted Bend Urban Area Comprehensive Plan. Com- missioner Montgomery moved that said zone change be granted and Com- missioner Young seconded the motion. Vote was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Fourth zone change request was by Orion Reid from A-1, Exclusive Agricultural to SR-1, Suburban Residential. This area is designated for urban residental development and is consistent with the adopted Bend Urban Area Comprehensive Plan. Commissioner Montgomery moved and Commissioner Young seconded that said zone change be granted. Vote was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Fifth zone change request was by Robert Riggs from A-1, Exclusive Agricultural to SR-1, Suburban Residential. The property included in this request is in the Redmond Urban Planning Area and is consistent with the Redmond Area Comprehensive Plan. Commissioner Montgomery moved that said zone change be granted butchange the zone to SR-1-1, which would limit minimum parcel size to one acre. Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Court Day Minutes October 20, 1976 Page 3 Sixth and last zone change request was by Brooks Resources, Corp. from A-1, Exclusive Agricultural to P.D. Planned Unit Development with the addition of T-Standards for property described per order of October 20, 1976. The Planning Commission held a public hearing on this matter September 29, 1976 and unanimously recommended approval. Commissioner Montgomery moved that said zone change be granted and Commissioner Young seconded the motion. Vote was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Last Planning Dept. items were amendments to Zoning Ordinance No. PL-5. First amendment pertained to section 8.020 Discontinuance of a Non- Conforming Use. Because of the confusion of interpreting the amendment, Commissioner Young moved that this matter be tabled until a later date when the amendment is better defined. Commissioner Montgomery seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Second amendment to the zoning ordinance pertained to Section 3.320 Site Plan Review. The amendment would require Planning Commission approval before a use may be substantially changed, a new use added, an existing building substantially enlarged or altered or a new building constructed. Commissioner Young moved that this amendment be adopted providing that no new fee is charged for the site plan approval. Com- missioner Grubb seconded the motion. Vote was: Bob Montgomery, no; Abe Young, aye; and Don Grubb, aye; motion carried. Last item on the agenda was a presentation by the Metropolitan Parks and Recreation Study Committee. Alice Elshoff gave the presentation in which she asked the Commission for approximately 40 acres of county land located at the old city dump site for use by the park district for the formation of a park. Commissioner Montgomery moved that the county start the public hearing process for a land transfer to the park district. Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Under open discussion, Harold Van Horn took the floor and asked the Commission why a mobile home was allowed to be set up on the property next to his when the area in question had just been rezoned R-1. The Commission assured him they would look into the matter and get back to him.
